I will the use of the plantation I now live on...known as Oak Hill to my wife Susannah Smartt. I Will to my son Thomas B. Smartt, my tract of some 350 acres on Catawba R. known as the Owens plantation and bought from Moses Hays, and the negroes Aaron and Silvey and their increase. I request that my executors sell the negroes Charles and Tilly and the surplus of the crop of the present season to assist in paying my debts....Codicil of 28 Feb 1809 Since making the above Will, I have sold 260 acres of the land I bought from Moses Hayes, but I have since repurchased it. Said 260 acres was bought by Hayes from David Kennedy and William McCord. The negroes that I left to my son Thomas B. Smartt have been sold and I substitute the negro Fillis, a daughter of Nanny.
