Nicholas Zeigler born abt 1809 in SC and died before Oct. 1858 in Coosa Co., AL. He was the son of Jacob and Catherine Zeigler who resided in Autauga Co. As Nicholas died without any direct heirs his heirs-at-law were his siblings and their heirs.

This day came Albert Crumpler administrator of the Estate of Nicholas Zeigler Deceased and filed his application in writing and under oath praying an order of sale of certain land described therein as the property of said decedent at the time of his death for the purpose of division upon the ground that the cannot be Equitably divided amongst the heirs and distributees of said Estate.

And it appearing from an inspection of said petition that the heirs and distributees of said Deceased are Charlotte Zeigler wife of John Fralick formerly Charlotte Zeigler, Francis Durden formerly Francis Zeigler, Mary Ann White formerly Mary Ann Zeigler, Nancy Goree wife of John S. Goree formerly Nancy Graves, Eliza Goree wife of Milton Goree formerly Eliza Graves, Sally Dickason wife of Columbus Dickason formerly Sally Graves, John Graves, Thomas Graves a Minor, Robert Graves a Minor, William Graves a Minor, Alabama Graves a Minor, Richard Spigener, Mary Ann Spigener formerly Mary Ann Zeigler, Malichi Spigener, Henry Spigener, Elizabeth Stalnicker wife of Joseph Stalnicker formerly Elizabeth Tyler.

William Zeigler a Minor, George L. Zeigler, John J. Zeigler, William Zeigler, Joel Zeigler, Nancy Zeigler wife of Henry Zeigler, (Sarah Zeigler wife of Lewis Zeigler is crossed out) all of whom Reside in the State of Alabama, Sarah Zeigler wife of Lewis Zeigler who Reside in the State of Louisiana & Catharine Lemby wife of Daniel Lemby formerly Catharine Graves Residing in the same state of La, Daniel Zeigler who Resides in the State of South Carolina, Samuel Jones who Resides in the State of Texas. Elizabeth Wiley wife of William Wiley formerly Elizabeth Spigener who Reside in the State of Georgia, Francis Higgs wife of Simon Higgs formerly Frances Spigener who Resides in the state of Mississippi, Ann Smith wife of Braxton Smith formerly Ann Spigener who Resides in the State of Mississippi & Maria Crumpler wife of Albert Crumpler formerly Maria Zeigler who Resides in the County of Coosa and state of Alabama.

It is therefore ordered that the 12th day of December next 1858. be and is hereby appointed a day for hearing the said application and the proofs which may be submitted in support of the same.

It is further ordered that due notice of the nature of said application and of the time above sit for the hearing thereof be given at least forty days before the said day of hearing by publication in the Wetumpka Dispatcher a Newspaper published in the City of Wetumpka for all persons in interest to appear and contest said application if they think proper.

It is also further ordered that said heirs and distributees have notice of this proceeding and of the day set for the hearing thereof by citation to be served personally on them those Residing in the state of Alabama

It is also further ordered that a copy of said published Notice be forwarded through the Post office Postage paid to all of said non Resident heirs. It is also further ordered that Henry W. Cox (Henry W. Cox is crossed out) H. Cleveland be and he is hereby appointed Guardian ad litern to represent and protect the interest of the Minor heirs of said Estate and the hearing of said application & that he have notice of his appointment.

Coosa County Term December 13th A.D. 1858

This being the day appointed more than forty days since for hearing the application of Albert Crumpler admr of the Estate of N. Zeigler Deceased for an order to sell certain lands herinafter described for the purpose of Division of the Ground that the same cannot be Equitably divided amongst the heirs and distributee of said Estate. And Sarah Zeigler wife of Lewis Zeiger, Catharine Lemby wife of Daniel Lemby Residing in the state of Louisiana and Daniel Zeigler who Resides in the state of South Carolina, Samuel Jones Residing in the state of Texas Elizabeth Wiley wife of William Wiley Residing in the state of Georgia, Francis Higgs wife of Simon Higgs, Ann Smith wife of Braxton Smith Residing in the state of Mississippi, who are non residence of this state having been duly brought into court by publication in a News paper in said County to wit the Wetumpka Dispatch in all Respect strictly according to the order of this court made and entered in the prini?d?? on the 25th day of October 1858.

Now comes the said administrator and moves the court that said application be granted and also comes J. H. Cleveland Esqr who is not of kin to said administrator nor in any way interested in this proceeding and who was heretofore duly appointed and has consented to act as Guardian ad litern to represent the interest of the Minor heirs of said Estate on the hearing of said application having filed his answer in writing as such Guardian denying the allegation contained in said application, on this day, And Joel Zeigler, George L. Zeigler, William Zeigler, Malchi Spigener, M. A. Goree, Eliza Goree, John J. Zeigler, Nancy Goree, John S. Goree, Thomas Graves, Richard Spigener, Mary A. Spigener, John Graves, Henry Spigener, Mary Ann White, Henry Zeigler, Nancy Zeigler, Elizabeth Stalnicker, Y. Stallnicker, having had notice Strictly in accordance with the order of this Court made and entered in this proceeding on the 25th day of October 1858 as is now shown to the satisfaction of the Court And it having been proven to the satisfaction of the Court by the oath of H. Allen and Harrison Smith who are disinterested witnesses and whose testimony has been taken by Deposition upon direct Interrogations as in chancery cases and which testimony has been filed of Record in this proceeding that it is necessary that the Laws described as follows Viz. The W of the NE & the E of the NW of Section (30) Township Twenty Two (22) of Range (19) & the South West of the NW of Section (30) Township (22) Range (19) all in said County of Coosa.

Should be sold for the purpose of division being all the Lands belonging to said Estate. It is therefore Ordered decreed & adjudged that said application be granted And said administrator is hereby Ordered to sell the above described Land at public Outcry before the Court House Door of said County after having first given Notice for at least three Successive Weeks of the Time place & terms of Sale by Notices posted on the Court House Door & three other public places in said County.

Ordered that said admr sell said Land on a credit not Exceeding twelve months.

Nicholas Zeigler Estate of

The State of Alabama Probate Court vacation

Coosa County February 28th, 1861

This day came Albert Crumpler Administrator of the Estate of Nicholas Zeigler Deceased and filed his Statement, accounts vouchers, and evidences for a final Settlement of his Said administration and Said accounts having been Examined by the Court, and found apparently correct, and being now Reported for Such Settlement.

It is ordered that the matter of Said Settlement be Set for a hearing on the 1st Monday in April next 1861 and that notice of the time and nature of Such Settlement be given by publication for three Successive weeks in the Wetumpka Enquirer a Newspaper published in Said County.

It is further ordered that Horace McLean Esqr be and he is hereby appointed Guardian ad litern to represent and protect the interest of the Minor heirs of Said Estate in Such Settlement.

It is further ordered that Said McLean have notice of this appointment.

Estate of Nicholas Zeigler Deceased

Coosa County April 1st, 1861

This day having been Set to hear and determine all matters as to the accounts heretofore filed by Albert Crumpler as the Administrator of said Estate for a final Settlement of his Said administration. Now comes the Said Administrator and moves the court that his Said accounts may be passed and allowed as the Same has been by him filed as aforesaid.

And it appearing that due Notice of the nature of and of the time Set to make Such Settlement has been given in all respects according to Law and Strictly in persuance?? of the order of Court in Said Estate made and entered on this 28th day of February 1861.

And Horace McLean who has heretofore duly appointed by the Court to act as Guardian ad litern to represent and protect the interest of the Minor Heirs of Said Estate in this proceeding and Settlement now appearing in open court and consenting to act and proceeding to contest said Settlement the Court proceeds to hear the matters pertaining to Said Settlement and to consider the evidence relating thereto: Whereupon it is shown by Sufficient evidence that Said Administrator has received of the assets of said Estate the Sum of Eleven thousand three Hundred and fifty Six & 87/100 Dollars. And that he has justly expended in and about the cost and charges necessary and incident to Said administration and in the payment of the first debt of Said Deceased the Sum of Sixteen Hundred and Eighty Eight Dollars and 17 cents.

And also having Reserved One Hundred and forty Six Dollars and 16 cents for the payment of a certain note made payable to John A. Graham which Leaves a balance of Nine thousand five Hundred and thirty two & 54/100 Dollars for distribution amongst those entitled. And Said account appearing to be full and correct.

It is ordered and decreed by the Court that Said account be and the Same are hereby in all things passed and allowed as above Stated and it further appearing from Said account that Said Deceased left him Surviving. The Heirs at Law of George Spigener Deceased viz Richard Spigener, Malachi Spigener, Henry Spigener, Frances Higs, Elizabeth Wiley, Ann Smith, Robert ???Graves. The heirs at Law of Henry Zeigler Deceased, Viz Charlotte Fralick, Francis Darden, Mary Ann White. The heirs at Law of Nancy Graves Deceased viz Robert Graves, (Mary crossed out), Nancy Goree, Wm Graves, Eliza Goree, Alabama Graves, Sarah Dickinson, Catharine Lumbly, John Graves, Thomas Graves, Nancy Zeigler (Jr. is crossed out), Mariah Crumpler.

The Heirs at Law of Wm Zeigler Deceased Viz Elizabeth Stallnicker, Wm Zeigler, George L. Zeigler, John J. Zeigler, Wm Zeigler Jr., Joel Zeigler, Mary Ann Spigener, Sam Jones, & Daniel Zeigler all of whom are entitled to share Said Estate as follows, Mariah Crumpler, Sarah Zeigler, Nancy Zeigler, Daniel Zeigler, and Samuel Jones being each entitled to one ninth part of Said $9532.54 which is the Sum of one thousand Fifty Nine & 17/100 Dollars & Frances Darden, Mary Ann White, Charlotte Fralick who are the Heirs at Law of Henry Zeigler Deceased being each entitled to one 27th part of Said Sum of $9532.54 which is the Sum of $355.05.

Richard Spigener, Malachi Spigener, Henry Spigener, Francis Higgs, Elizabeth Wiley, Ann Smith all of whom are the heirs at Law of George Spigener deceased being each entitled to one 54th part of Said Sum of $9532.54 which is the Sum of One Hundred and Seventy Six & 53/100 Dollars & Robert Graves, Nancy Goree, William Graves, Eliza Goree, Alabama Graves, Sarah Dickinson, Catherian Lumly, John Graves & Thomas Graves who are the Heirs of Nancy Graves Deceased being each entitled to one 81th part of Said Sum of $9532.54 which is the Sum of One Hundred and Seventeen & 68/100 Dollars & Elizabeth Stallnicker, Wm Zeigler, Wm Zeigler Jr. Joel Zeigler, George L. Zeigler, John J. Zeigler & Mary Ann Spigener who are the Heirs at Law of Wm. Zeigler Deceased being each entitled to one 63rd part of Said Sum of $9532.54 which is the Sum of One Hundred and fifth one & 31/100 Dollars;

It is therefore ordered adjuged and Decreed that the Said Distribution ?? each have and recover of and from the aforesaid Administrator for the Sums to which they are respectively entitled as mentioned above and for which Execution may Issue as follows
