Creation of Shoemaker Cemetery

	The state of Alabama, Lawrence County.
Know all men by these presents:  That we Jessie H. Burgess and wife M. M. Burgess, for and 
in consideration of Ten Dollars, to us paid in hand by J. M. Shoemaker, the receipt whereof is 
hereby acknowledged, do grant, bargain, sell and convey into the said J. M. Shoemaker, in trust, 
to be held as a burial ground for the heirs and relatives of J. Y. Shoemaker, dead, the following 
described property, to wit:  A tract of land in the NE ¼ of SE ¼ Sec. 29-T-6-R-7-W bounded on the 
East by Moulton Hillsboro Macadam Road and extending along said road 220 feet more or less, being 
more particularly described as follows:

	Beginning at a stake in the NE corner of said parcel of land, (said stake is 1043.5 feet 
from the SE corner of NE ¼ sec. 79, T-6-R-7-W, measured in a straight line on a bearing S 37 
degrees 05 minutes W (magnetic),) thence on a bearing of 33 degrees 28 minutes W. 220 feet, more 
or less, to the S. E. corner of said tract, (said SE corner is 46.6 feet from the tomb of J. Y. 
and Rebbecca Shoemaker, measured on a bearing N 17 degrees 05 minutes W); thence N. 83 degrees 55 
minutes W, 202.2 feet more or less to the S.W. corner of said tract; thence N. 33 degrees 28 
minutes E. 220 feet more or less to the N.W. corner of said tract; thence N 83 degrees 55 minutes E, 
202.2 feet more or less to the point of beginning.

	Said parcel of land contains 1.02 acres and is substantially as shown on attached blue 
print map.

	Situated, lying and being in the County of Lawrence and State of Alabama.

	To have and to hold the same unto the said J. M. Shoemaker as Trustee, for heirs and 
relatives of J. Y. Shoemaker, dead, for a Burial Ground, forever.  And we do for ours along 
and our heirs, executors and administrators, covenant with the said J. M. Shoemaker, as such 
Trustee, that we are lawfully seized in fee-simple of said premises.  That they are free from 
all encumbrances and that we have a good right to sell and convey the said property; that we 
will, and our heirs, executors, and administrators shall warrant and defend the same to said 
J. Y. Shoemaker, as such Trustee heirs executors and assigns forever, against the lawful claims 
of all persons whatsoever.

The State of Alabama Lawrence County

	I, E. B. Downing a Notary Public in and for said county, hereby certify that 
Jessie H. Burgess and wife, M. M. Burgess whose names are signed to the foregoing conveyance and 
who are known to me, acknowledged before me on this day that being informed of the contents of 
the conveyance, they execute the same voluntarily on the day the same bears date.

	Given under my hand this the 8th day of Feb. ad 1915.

I, E. B. Downing a Notary Public in and for said County hereby certify that on the 8th day of 
Feb. 1915 came before me the within named M. M. Burgess, known to me to be the wife of the 
within named Jesse H. Burgess who being examined separate and apart from the husband touching 
her signature to the foregoing conveyance acknowledged that she signed the same of her own free 
will and accord, and without fear, constraint or threats on the part of the husband.

	In witness whereof, I have hereunto set my hand the 8th day of February 1915.

The Shoemaker Cemetery was established in 1859 as a private cemetery for the heirs and 
relatives of John Yancy Shoemaker.
Effective March 1, 2000, only Shoemaker heirs and relatives may be buried at the Shoemaker 
Cemetery, with the exception being the spouse of an individual already buried there.
