Personally appeared before me, Isham P. Gibson, Judge of Probate in and for said County, M. V. Shelton, who, being duly sworn, deposeth and saith that when a Private Soldier in Company ?C? of 22nd Regiment of Georgia Infantry and while in discharge of his duty on the - of June 1862, at Seven Pines in the State of Virginia he was wounded by Gun shot in left-hip and in consequence of which wound or wounds, he has been rendered physically incapable of making a livelihood by labor; that he was a resident of Alabama on the 13th day of February 1891, and is a resident at the date of his application; that he is engaged in the business of Farming; that his taxable property dies not exceed four hundred dollars in value, and that his Salary and Gross Income does not amount to four hundred dollars per year.

Personally appeared before me, Isham P. Gibson, Judge of Probate in and for said County, M. V. To the Honorable Board of Pension Examiners of Said County:
Your petitioner M. V. Shelton, Respectfully represents to your Honorable Board, that he is a resident citizen of Lawrence County, in the State of Alabama, and that he resided in said State on the first day of January in 1899; that he is enlisted in the service of the State, or Confederate States, as a Private in Company ?C? in the 22nd Georgia Regiment Infantry on the --- day of December 1861, at Dallas in the State of Georgia and that he was honorably discharged from such service on the 10th day of April, 1865; that he did not desert the service of the Confederate States, or of the State of Alabama; that he was wounded at the battle of Seven Pines, in the State of Virginia; that he is now unable to make a living by manual labor on account of said wounds; that he is at the time of filing this application 59 years of age, and that his post office address is Jacobs, Alabama; that he does not own property either in his own name, nor that of his wife, to the value of Four Hundred Dollars ($400); and that he has no children upon whom he can depend for support. Your petitioner files herewith a complete schedule of all the property owned by himself and wife. In consideration of the foregoing facts, your petitioner asks that his name be placed upon the pension rolls, in the class that your Honorable Board may adjudge him to belong, that he may participate in the division of the fund provided for the relief of Confederate and Alabama soldiers and their widows, by Act of the General Assembly approved February 10, 1899.

To the board of Pension Examiners of said County:
The undersigned M. V. Shelton, respectfully represents that his name is on the pension rolls of said County as a 4th Class pensioner, that since he was placed in the 4th Class he has suffered injuries and loss of health that has very greatly increased his disabilities, and on that account he files this, his petition asking that he be advanced to a higher class on said pension roll.
That he is now 70 years old. That he was wounded at the battle of Seven Pines by an exploded shell, one part of which went through the left side of his bowels and lodged in the hip bone, and another piece crushed the right shoulder bone , and taking off a part of it, that now there is no union between the shoulder and the collar bone.
That about 4 years ago he received a fall from which his right leg was broken above the knees. That at the time his leg was broken, a bale of cotton fell on him, from which he sustained internal injuries, and from that time he has suffered greatly from Hemorrhoids and Rheumatism. That he is now unable to perform labor of any kind.

At a regular meeting of the board of Pension Examiners of said County, held at the Court House of said County, on this the 6th day of July 1910, personally appeared M. V. Shelton, who after being duly sworn, was examined in reference to his application for a transfer to a higher class, with the following result, viz:
We find that the facts stated in his application are practicably true, and from examination of him find that he bears ridged marks of his wounds and injuries complained of. We further find that his physical condition is such that he is unable to perform manual labor.
We therefore recommend that his application be granted and that he be transferred to the 2 Class.

The above named pensioner was duly cited to appear within twenty days from the 7 day of October, 1914, and on the 11th day of October, 1914, did appear and made the following defense or explanation of the charges against him,
This man offers his ??? ?? affidavit of ???? ????? Circumstances which ??? State he served ??? Faithfully in Company ?C?, 22 Georgia Infantry Regiment. I refute he is eligible to a pension.

You are hereby notified that a charge has been duly preferred against you to the effect that you are ineligible to a pension under the laws of this State, because, The records show that M. V. Shelton was absent without leave from his command since December 22, 1864 - No later of his record found.
Within Twenty Days from this date you can appear before me, at my office in the State Capital, in person or by counsel, and offer testimony by witness or the affidavits of witnesses in explanation or refutation of said charges. In case you make your defense by the affidavits of witnesses, those affidavits must be made and signed and sworn to before the Probate Judge of your county, and duly attested by his official signature.
In the event that you fail within twenty days to answer or defense to said charge, the charge will be taken as confessed, and your default will be duly reported to the State Board of Pension Examiners for final determination.
Witness my official signature, this the 7th day of October, 1914.

Before me J. C. Kumpe, Judge of Probate, in and for said State and County, personally appeared J. K. P. Shelton, whom I certify to be a person of integrity and veracity, being duly sworn deposes and says, in answer to citation issued to M. V. Shelton, dated October 7, 1914. And signed by F. P. Stephens, Committee Pension Board Examiner, which states as follows: ?The records show that M. V. Shelton was absent without leave from his command since December 22, 1864. No Later record of him found.?
He states that the said M. V. Shelton enlisted in the spring of 1862, in Company ?C? - 22nd Georgia, in Wright?s Brigade, Bill Mahone division at Hills Corps, and I know that he was gone in the war until in December 1864, when he came home on a furlough for sixty days, and while he was at home he was taken very sick with the measles and remained at home very sick until the spring of 1865, and that he received a parole at the close of the war. I have seen his parole many times and know that he was paroled. After he had the measles, he had a relapse and was unable to return to the war. He also had a rison in his ear which has caused him to be deaf in his left ear from that day to the present time.

The undersigned M. V. Shelton, who has been cited by the said Pension Board of Examiners to show cause why he should not be dropped from the Pension Rolls because, ?The records show that M. V. Shelton was absent without leave from his command since December 22, 1864, No Later record of his found?.
He states that he was a member of Co. C Georgia Inf. And that he enlisted in Co. C in spring of 1862 and served as a soldier from then until in December in 1864, just four months before the surrender when I was furloughed home. While at home I was taken sick with the measles and was very sick after I was about to get well I had relapse and was unable to join the army any more before the surrender. I also had a rison in my left ear and from that time I have been deaf in that ear. I was still at home when they surrendered but my brother, J. M. Shelton brought my parole to me and I received a parole from my commanding officer and had it for some time but have lost it.

Shelton since the year 1858; that he knew he enlisted as a soldier in the Virginia Army in 1862, and that he remained in the Army until December 1864, when he was permitted to go home on a furlough, for sixty days. While at home on said furlough he was taken with measles, and remained an invalid until the spring on 1865.
