Will Of Cynthia Nicholson

In The Name Of God Amen
I Cynthia Nicholson a citizen of Lawrence County and the state of Alabama 
do make and ordain and declare this instrument which is subscribed with my 
name to be my last will and testament revoking all others.

1st I wish all my debts to be punctually and speedily paid out of my notes 
and accounts that is given to my heirs.

2nd I will and bequeath to James H. Nicholson, Penelope M. Nicholson and 
Eliza H. Nicholson my own children jointly all my stock of cattle, hogs, 
household and kitchen furniture all the cord corn and fodder oats with the 
present crop of corn and cotton to have an to hold as their own and for their 
own use and benefit jointly and severely.

3rd I will and bequeath to James H. Nicholson, my son separately my young 
sorrel horse, my rifle gun and his saddle.

4th 1 will and bequeath to Penelope M. Nicholson my daughter my black 
horse Sam.

5th I will and bequeath to Eliza H. Nicholson my daughter my Roan filly 
and sidesaddle.

6th  I will and bequeath to my daughter Martha Ann Irwin my old sorrel 
horse Joe.

7th I will and bequeath to James H. Nicholson, Penelope M. Nicholson, 
Eliza H. Nicholson all my own children jointly my wagon and carry all to use 
and benefits of all my real estate till they are all of age then the real estate 
to be disposed of as the law directs everything else to be as above stated. 

I also will and bequeath to James, Penelope and Eliza H. Nicholson all my farming 
instruments of every kind.

In testimony where I hereto set my hand and seal this seventh day of 
October one thousand eight hundred and forty.

*Note; This likely is the widow of William Nicholson. Per "The Hargrove Study" 
Dorothy Beebe and Johnny Hargrove, published in 1993 pages 261 and 571-72 record 
a Cynthia Hargrove as the wife of William Nicholson. No further information is given on 
their children.

Madison County Orphan Court Book 4, page 322:
Cynthia Ann Hargrove has intermarried to Wm. Nicholson and vouchers paid to heir 
were 1307.33 and was due back 178.47 to Mary Hargrove.

Settlement of James Hargrove, Sr. estate Dec'd 1817, Madison Co., Ala. His will can be 
found in the Territorial Deed Book for Madison County.

If the above is correct, Cynthia is the daughter of James Hargrove, Sr. and wife Mary 
(last name unk.)
