Walker County, Alabama, Will of Davidson Blackwell, Will Book A, pages 51-54

"I, DAVIDSON BLACKWELL, considering the uncertainty of this life and being of sound mind and memory do make and publish this my last will and testament in manner and form following.

 

First, I give and bequeath to my beloved wife, MATILDA BLACKWELL, the sum of one seventh part of all my effects except beds and bedding.  I give and bequeath unto my oldest son, ALEXANDER H. BLACKWELL, one seventh of all my effects except beds and bedding.  I give and bequeath unto the heirs of my deceased son, JOHN P. BLACKWELL, one seventy part of my effects except beds and bedding. I give and bequeath unto my youngest son, WILLIAM R. BLACKWELL, one seventh of all my effects except beds and bedding.

 

To my oldest daughter, SARAH E. McDADE, I give and bequeath one seventh of all my effects and one half of my beds and bedding added thereto to be equally divided by her and her youngest sister, BUNAVISTA MORRIS.  To the heirs of my deceased daughter, MARY A. DAVIS, I give and bequeath one seventh of all my effects except beds and bedding.  To my youngest daughter, BUNAVISTA MORRIS, I give her one half of my beds and bedding to be equally divided between her and her oldest sister, SARAH E. McDADE.

 

I hereby constitute and appoint WILLIAM L. DAVIS as guardian for the heirs of my daughter, MARY A. DAVIS and I also constitute and appoint MARGARET M. BLACKWELL as guardian for the heirs for my deceased son, JOHN P. BLACKWELL.

 

I hereby appoint my youngest son, WILLIAM R. BLACKWELL and my son in law, GEORGE W. McDADE with full and legal power to take all my effects, real and personal, in charge forthwith after my death and sell into the highest bidder or equally divide it as my heirs or a majority of them may think best.  And, I want WM. BLACKWELL and GEORGE W. McDADE to have reasonable compensation for all their trouble.

 

And I further avow and declare this to be my last will and testament and that it is my desire that it should be carried out to a letter and should any of my heirs or guardians for heirs or minor heirs become dissatisfied with, and try to break said will or any part thereof, that the parts or several parts of such disaffected heirs or guardians shall be taken from them and equally divided amongst the remainder of my heirs and guardians equal, the same as the rest of my property.

 

In witness whereof, I have hereunto set my hand and seal the 4th day of October in the year of our Lord 1884."

Signed and declared by the above named DAVIDSON BLACKWELL to be his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator.

I, JOHN B. SHIELDS, Judge of the Court of Probate and for said County, do hereby certify that the written instrument of writing has this day, in said court, and before me, as the judge thereof, been duly proven by the proper testimony, to be the genuine last will and testament of DAVIDSON BLACKWELL, deceased and that said will, together with the said proof thereof, have been recorded in my office, in Book of Wills No. 1, pages 52-3-4.  In witness whereof I have hereto set my hand and seal of said Court this the 25th day of July 1887.

WILL OF GEORGE PAYTON BAUGHN

The State of Alabama , Walker County

Know all men by these premences that I George Payton Baughn of Walker County in the state of Alabama being of ailing health but of sound mind do make this my last will and testament hereby revoking all former wills by me made at any time heretofore made.

As to my wordly estate and real and personnel property at which I may die seized and posessed or which shall be intitled to at the time of my death I devise , bequeath and dispose of in the following manner to wit.

1st: That my body be decently burried according to my circumstances in life.
2nd: That my funeral expense and all my just debts shall be paid out of my estate as soon after my death as circumstance and conveniense will permit.
3rd: and I do hereby give, bequeath, and devise to my son, Joseph Frederick Baughn, and my wife, Susan Elizabeth Baughn, all my property both real and personnel as long
as my said wife live and remains a Widow but in case my said wife shall marry again then it is my will that all my property both real and personnel is to go in the hands of my son Joseph F. Baughn and in case of death of my said wife Susan E. Baughn , ? my son Joseph F. Baughn is yet living then it is my will that all my property both real and personnel shall go into the hands of my son Joseph F. Baughn.
And this will is made with the consideration that my said son, Joseph F. Baughn, shall of necessary care for and support myself and his mother, Susan E. Baughn throughout the remainder of our lives and in case he does care and support us throughout the remainder of out lives then this will is of full force but in case my said son Joseph F. Baughn refuses to care for or support myself and his mother if necessary then this will is to be null and void.

And I hereby choose and select my brother Joseph H. Baughn of Lynn in Winston County in the state of Alabama as my executor and he is hereby authorised to take charge of all my business as soon as after my death and look after the needs of my said son, Joseph F. Baughn and my wife, Susan E. Baughn in ? as necessary support them out of my estate until my said son Joseph F. Baughn becomes Twenty One Years old
then all my property both real and personnel is to be turned over to the hands of my said son Joseph F. Baughn his mother, Susan E. Baughn. and my execurtor Joseph H. Baughn is hereby to take from my estate, any money necessary for his expenses in attending to and looking after the business of my estate and I pening implicit confidence in the man Joseph H. Baughn on my  part do met require any ? to be made by him as Execurtor of my estate.

In testimony whereof I George P. Baughn have to this my last will and testament subscribed my name and affixed my seal this the 10th day of March A.D. 1927
