Know all men by these presents, that whereas I David Burch of Warwick Tribe in the Somer Islands als Bermuda have made and declared my last and testament in writing bearing date the second day of February last being in the year of our Lord one thousand seven hundred and fifteen. I the said David Burch to be by this present codicil confirm and certifye my said last will and testament and do give bequeath unto my sons Thomas Burch and Benjamin Burch, and unto my son in law Phillip Lea and to the heirs forever equally among them all my right title of interest in the piece of land which was lately given to me by my loving brother in law Thomas Gibbs, which piece of land is scituate lying and being in Southampton Tribe in the Islands forev'r being the northeast part of the land there as by his last will and testament will appear and if any of my aforesaid sons or son in law should decease before they come of age or possess or dispose of the same then the part of him or them so dying shall go and be to the survivors or survivor of them.

Item. I do hereby further ordain or direct that my wives children (viz:as) Copeland, Phillip, Sarah, Mary, and Susannah Lea have what belongs to them of their deceased mother--- Phillip Lea his estate w:ch is two thirds of the same according to inventory paid and secured to be paid, before any division be made of my estate and that nothing be deducted from the same for their bringing up and over and above which I give and bequeath to each of them the sum of five pounds which I desire they will accept in remembrance of me. I doo hereby also order will and direct that my dear and loving daughter Mary Burch have the use and benefit of the middle north chamber in my dwelling house with liberty to pass and repass during the time she remains unmarried.

Lastly my will and meaning is that the codicil be as part of my last will and testament as if it were therein set down. In witness whereof I have hereunto set my hand and seal this fourteenth day of May Anno Dni 1716.

These are to certifye that this the 6th day of Decemb:r 1716 personally appeared before me the Gov:r and Ordinary aforesaid Nathaniel Astwood & Nathaniel White both of these Islands and severally made oath on the holy evangelists of Almighty God that they respectively saw the within named David Burch sign seal and acknowledge the within written codicil as part of his last will and testament and that at the same time he the testator was of sound and disposing mind and memory. In testimony whereof I have hereunto set my hand the day and year above mentioned.

The above and before written will probated and codicil received from the originals and examined

These are to certifye that this 16th day of December 1734 personally appeared before me the Governor aforesaid Copeland Burch and Thomas Burch who are nominated executors of the within written will and severally made oath on the holy evangelists that the same will was made signed and published by the within testator David Burch (father of these deponents) and also proved, during their infancy and without their consent or knowledge & that they or either of them however did directly nor indirectly intermeddle with the execution of the last will in any manner howsoever, wherefore the s'd deponents as they further say do absolutely renounce the s'd executorship. In testimony whereof I have hereunto set my hand the day and year abovewritten.
