Benavides Javier J 891017 p3 Rites Set for Shooting Victim; Final rites have been scheduled for Javier Jose Benavides, 21, of Patterson who died Friday night in Modesto after being shot in the chest. Being held in the county jail is Francisco �Frank' Chao, also 21, who telephoned Modesto police about 4:30 am Saturday and soon turned himself in at the police department. The shooting which occurred behind a gas station at the corner of McHenry and Orangeburg avenues, is still under investigation, police officials said Monday. It was witnessed by several people. Another young man, Edward Maldonado of Modesto was wounded in the leg and is recovering at Doctors Medical Center. Benavides has lived here the past eight years and was employed as a farm laborer. He was a member of Sacred Heart Catholic church and a native of Indio. A rosary will be held at 7 pm Tuesday at Hillview Funeral Chapel. A Mass is scheduled for 10:30 am Wednesday at Sacred Heart Church, with burial to follow in Patterson District Cemetery. Visitations will be from 4-8 pm Tuesday at the chapel. Survivors include a son, Javier Jose Benavides Jr. of Patterson; three brothers, Osbaldo Lopes of Patterson, and Leonardo and Jose A. Melendres of Gilroy; three stepbrothers, Gilbert and Danny Torres of Gilroy and George Torres of Patterson; a sister Linda Lopes of Patterson; three stepsisters, Mary Valensiz of San Pedro, Theresa Torres of Patterson and Margie Hernandez of Gilroy; his mother and stepfather, Rebecca and Oetavio Torres of Patterson; and his father, Jose Benavides Diaz of Shafter.
