Marriage to Peggy Brown bondsman was John Hann.

On tax list in Garrard County in 1806, 1807, 1809. Living in Lawrence Co., IN on same page (age 26-45) with David in 1820. (1820 Federal Census, Lawrence County, Indiana, p. 97.)

April 8, 1810, "Ordered that John Finley be summoned to shew cause why his children, To wit, Huston and Milton should not be bound out." Garrard County Order Book 13:329.

May Court 1810, "Clerk of this Court is ordered to bind to Arabia Brown, Huston and Milton Finley, children of John Finley, as the law directs." Garrard County Order Book 13:333.

Peggy Brown vs. John Findley, 12 August 1814, suit for divorce, claims abuse; separated in 1809 or 1810; states John is in Indiana and in the regular army.  [Box 7, bundle 26, suit 193, Order book 5:79]. This document found by Judy Hofstetter, 3008 Houston Blvd., Louisville, KY 40220-2208, JYH1941@aol.com, September 1999.

A John Finley, private, served in Capt. William Kelly's Co., 2 Reg't, Indiana Militia, 16 Jan. to 2 Mar. 1813, 1 month 18 days, and received $12.64.  No pension or bounty land records found. [NARA Muster Roll]

There was a marriage between John Findley and Martha Welton 25 April 1814 in Knox County, IN.  Could this be our John?  Probably not, since this is prior to date Peggy Brown sued for divorce.

John married Margaret (Peggy) BROWN, daughter of Arabia Jackson BROWN and Elizabeth DOOLEY, on 18 Jan 1805 in Garrard Co, KY. Margaret was born 1 on 28 Aug 1786 in Bedford Co, VA.

Birth date found in pension papers of Arabia Brown, along with Bible records.

Arabia J. Brown served as bondsman when she married David W. Hall.

Oct. 12, 1837, "David W. Hall and Peggy his wife convey to Milton Finley, for $260., all their interest real and personal in the estate of Arabia Brown, Sr., father of Peggy." Witnesses: Stephen Brown, Jack Brown, Jr..  Acknowledged and recorded Oct. 16, 1837.  Garranrd County Deed Book M;330.

On Cass County, MO tax list in 1848 owning 80 acres; Edmond & Catherine sell 80 acres in Cass County, 5 June 1852 (Cass Co. Deed Book G:127).

An Edmond Finley was listed on the 1808 and 1809 personal property records in Hardin County, KY.  In 1808 there was one white male over 21 and he had one horse.  In 1809 there was still one white male over 21 and he had two horses.  Owned no land in either year.  Was not listed in any other year from 1805-1812.  Also lists a John Finley in 1805 only and Isaac and Samuel Finley 1807-1812.  (From Charles L. Tyree 7/10/97.

Edmond married Catherine before 1810. Catherine was born about 1784/1785 in TN. She died after 1870 in Cooke Co.? TX.

1860 census, Hunt Co., TX, p. 8 gives age as 76.  She was living with son, Lewis (Louis), at the time.

Extensive court records, Macon Co., IL, between 1836-1841 including property settlement and guardianship of minor children. Willed property to wife, Rachel, and all children, but court records show several suits between John Findley and wife Mahala vs. heirs of Samuel Finley. Samuel listed in Finley family Bible in possession of Marion Shaffer, Healdsburg, CA, copy in possession of Carmen J. Finley.

State of Illinois Public Domain Land Tract Sales Archives show Samuel purchased 6 tracts of land between 4/28/1831 and 7/25/1835 of the following number of acres: 80, 160, 160, 40, 40, 160, totalling 340 acres (Archives vol. 145:22, 145:22, 145:46, 145:47, 145:47, 145:51).

Your petitioners John Finley and Mahaleigh Finley his wife which said Mahalah Finley is heir at law and child of Samuel Finley deceased would humbly show unto you how at that ??? Samuel Finley died in the count of Macon and State of Illinois of the following described estate lying and being in the County of Macon and known and designated as the North West quarter of Section Number twenty eight, and the South West quarter of Section thirty three and the South West quarter of the North East quarter of Section twenty eight all in Township No. sixteen North Range No. two East of the third principal meridian, containing in all three hundred and sixty acres. That the said Samuel Finley did in his lifetime to wit on the fourteenth day of July A.D. 1836 make and execute his last will and testament in writing, that duly attested by Philip D. Williams and George M. Braden two credible witnesses, and duly proved and recorded in the Court of Probate in and for the said County of Macon. That the said Samuel Finley by the said last will and testament did devise all of his real estate between his wife Rachel and his children in equal parts not ascertaining by ??? and boundaries of each of any devisee's share, and you petitioners ??? that the copy of the said last will and testament here to annexed may become a part of this petition.

Your petitioners would further state that the said Mahalah Finley the wife of the said John Finley, Nancy Braden the wife of George M. Braden, Alvin Finley, Jefferson Finley, James Finley, John Finley, Samuel Finley, Elizabeth Finley are the children heirs at law and devisees of the said Samuel Finley deceased and that Rachel Finley is the widow and devisee of the said Samuel Finley. That the said Jefferson, James, John, Samuel and Elizabeth are infants. And your petitioners pray that the said George M. Braden and Nancy his wife and Alvin, Jefferson, James, John, Samuel, Elizabeth and Rachel Finley may be made parties to this petition.

Illinois Public Domain Land Tract Search Results (http://www2.sos.state.il.us/cgi-bin/land), 10/6/99, shows Samuel Finley bought his first land in Macon County, IL on 4/28/31.  Assuming they were living there before Martha's death in 1832, her place of death would have been Macon County.

Wives #1 & #3 were cousins, Mahala & Elizabeth, both daus of Samuel Finley, Edmund.  Had about 25 children by three wives (Ethel Work Balmer). According to Pearl S. Carolina, father was James Maxwell ... while still a baby, family moved to Chuach River, NC where James ran a mill.  In 1808 Maxwells moved to Indiana Territory, near present Greenville.  In 1811 father, James, relocated to Lost River, Orange County.  Joseph W. joined Rangers (to quell Indians) ... filed for land, Cave Springs, Indiana.
Married, late 1815 to Miss Mary Finley, another pioneer family ... 12 children born 1816 to 1842.  Mary died Oct. 1842.  In 1851 Joseph W. remarried and had 6 more children.  He was a devoted Whig, idolized Henry Clay, later became a Republican.  Served as justice of peace in Orange County for many years. Owned 840 acres on Lost River (lost it somehow).  In 1866 he moved to Howard County, IN.  In 1878 moved to Lawrence, KS to live with Mrs. Lindley and Mrs. Newlin, his daughters by Mary Finley.  Was active, read a lot, died in his sleep Jan. 26, 1881.

Wheelwright - farmer; served in War of 1812.  Andrew Swallow Revolutionary War pension application gives his birthdate as 2 March 1783; bible records state birthdate as 31 March 1783. Bible in possession of Sally Finley Nance, Rt. #1, Box 171, Dunlap, TN 37327; copy in possession of James D. Finley, 2320 Cheyenne Way, Modesto, CA 95356.

"Reuben was reared by his mother and Andrew Swallow whom she married in the Spring of 1785. Swallow saw Revolutionary War service, both in Pennsylvania, where he was born, and in North Carolina and Virginia after his move to Montgomery County (later Wythe) around 1780. After his marriage, the family moved to North Carolina and then to Overton
County, Tennessee. He was living in Overton County in September 1832 when he made application for a pension. In those papers, Reuben is listed as the oldest child. They stated his birth date as March 2, 1783, somewhat at variance with existing bible records.

"In November 1814, Reuben was drafted in Hawkins County for the War of 1812 and was discharged at Knoxville, May 14, 1815. He was a Sargeant under Captain Slaten in a Regiment commanded by Colonel Baley in General Colter's Brigade. Sometimes between September 1818 (birth of daughter, Rhoda) and January 1821 (birth of daughter, Polly) the family moved to Overton County. Reuben obtained land grants in Overton County between 1825 and 1839 totalling 250 acres.

"After the death of Reuben's father, Thomas, Alexander Hunter, executor of the estate, apparently tried to locate Reuben. A letter written by Hunter, dated 19 June 1833 explained he had made inquiries of the deceased's brother in Kentucky, to no avail. However, word apparently did reach Reuben, for he wrote to the Ordinary at Abbeville Courthouse to make his whereabouts known. Hunter invited Reuben to visit his stepmother, Jane (Clark) Finley in Abbeville and expressed the opinion she might be willing to give him some of her property before her death. "She has more property than is really useful to her at present. She sometimes addressed a desire that you'd move here and live near her. Whether Reuben made this visit is not known. However Reuben never saw any of the property his father left him for he died soon after, at the age of 54,and Thomas's widow, Jane (Clark) Finley was still living at the time. Thomas Milton Finley below. Nancy lived for some years after Reubens death and on August 16, 1852, she made a deposition for the purpose of claiming bounty land to which she was entitled for his service in the War of 1812, She received a warrant for 80 acres. When a new act of Congress was passed in March 1855, she reapplied for additional bounty land to which she might be entitled. You may or may not remember that our John Finley’s from Augusta Co., Va. son Thomas had an illegitimate son with Catherine Kinder. His name was Reuben Jefferson Finley. At his step father’s hearing for a pension for the Revolutionary War service, Reuben’s half sisters and brother testified that Rueben always went by the name of Finley. Any record we have ever found of him bore this out.
Now, the woman he married in Hawkins County was named Nancy McCulley. In the same, pension hearing mentioned above, testimony was given that she, Nancy McCulley was illegitimate also and that a King was her father. Now, Jim Finley and other family researchers call her Nancy McCulley King. I choose not to do this because that was not her name ever and Hawkins County was full of Kings at that time and there is no way you could ever prove parentage by researching.
My question is: when I describe her parentage do I just say father unknown. Example:
Nancy McCulley b. 13 Jul 1790, Hawkins County, Tennessee, mother Fanny McCulley, father unknown, or father thought to be a King.
