Henry King vs. William Johnston--23d September, 1795. John Crips is enlisted in the United States Army and about to march.
George Keezell, of Rockingham, vs. John Crookshanks, of Shenandore-- Contract for sale of land near the town. George has laid out in Rockingham County, 1787.
Zachariah Johnston vs. James Caruthers--Slander. Rockbridge. Defendant said plaintiff had forged a record from Virginia and had Christian Lookenbill arrested in Pennsylvania.
John Erwin vs. Samuel Erwin--Rockingham, Slander. John Erwin deposeth, 15th August, 1793: In year 1776 plaintiff (Samuel Erwin) came to defendant's father's house and told defendant that himself and his brothers, Benjamin, Andrew, John and William Erwin, had come to agreement to value the land their father formerly possessed at £300, and that Samuel Erwin and his brothers, Benjamin and Andrew, had purchased the shares belonging to John and William Erwin. Deposition of Thomas Woodall, 25th March, 1797: John Erwin was a man of good character, but some persons spoke badly of him. Thomas is about to remove to Kentucky.
Edward Erwin vs. Alexander Curry--Mary Curry, a witness in Pendleton County, deposes that a number of years ago her father, the present defendant, called on her uncles, viz: Benjamin, Samuel and Andy, to give their bonds for her grandmother's maintenance. Thomas Woodell deposes, 24th March, 1797: In April, 1795, defendant told Edward Erwin, son of plaintiff, &c.

Allison vs. Kennedy--Special verdict. Mentions patent to William Russell in year 1740. William Russell owned land in Beverley Manor prior to 1740. In 1742, 27th May, William conveyed his lands to Joseph Bloodworth, Joseph's will, dated 3d October, 1743, wife, Mary Bloodworth, devise to Mary Margaret Kennerley, wife of Thomas Kennerley. After Joseph's death, widow Mary married Michael Lawler. Thomas and Mary Margaret sold land to James Kennerley, but died before making deed, and Thomas, eldest son and heir; John Kennerley and Mary, his wife, conveyed the land to James. James Kennerley died, June, 1797. Survey was made for Russell, 1739. 1796 (A to M).

On 20th February, 1798, following inhabitants of ye Great Calf Pasture, petitioned to change the river road: Thomas Hughart, John Montgomery, Archibald Kinkead, James Gwinn, Jacob Peck, Thomas Kinkead, William Kinkead, Joseph Gwinn, Thomas Gwinn, James Fulton, William Moore, Samuel Black, Peter Simpson, William Yeuel, Samuel Neil, William Steele, Thomas Philips, Adam Hickle.
McPheeters vs. Moffett--Involves land conveyed to Beverley to Crockett, 26th February, 1740. Copy of deed. Deed, Robert Crockett and Margaret to William McPheeters, 23d November, 1743. Deed Robert Crockett and wife, same. William McPheeters, demandant, is son of above William McPheeters. Deposition James McClery, taken in Fayette County, Kentucky, third Monday June, 1798: In the Spring of 1742 he settled in Augusta County within 3 miles of lands in dispute. He lived in Augusta until October, 1785. Deposition before Samuel Blair, J. P., J. Bell, Elij Poage, George Trotter. John Brownlee deposes in Augusta, 3d July, 1798, that he has lived where he now lives since 1st November, 1740; he has always been a member of that society, and is nearly related to John Moffett, the defendant. John Tate also deposes that he has lived where he now lives for 53 years in October last, and had been acquainted with the lands for two years before he came to live in the neighborhood. Captain Samuel McPheeters deposes at same time that he has lived in and near where he now lives since 1741. Mathew Wilson deposes at same time that he has lived near where he now lives 60 years. John Young lived on the plantation 55 years ago and upwards.

Andrew Shanklin vs. Elizabeth Francis--Slander, from Rockingham. Daughter Betty. Declaimant recites he is "an old man, the father of a family, an honest, sober, and has been generally believed, a religious man, a teacher of the ignorant, eyes to the blind, and feet to the lame; a magistrate, a terror to the evil doer, but a praise to those who do well," &c.
Scott vs. Moore & Parris--Defendants, operators of Nancy Furnace, in Rockbridge. Contract of partnership, 1798, for seven years.
Peggy Thompson vs. Robert White--Breach promise marriage.
James Houston and Cornelius Alexander, guardians of orphans of George Weir, deceased, vs. James Mitchel, executor of last will and testament of James Beard, deceased--Suit on arbitration to determine a legacy left by James Beard to his daughter, Jane (Weir ?). Arbitrators decided that Mitchell shall pay to the plaintiffs £22 on or before Jane's eldest child arrives at full age. Dated 21st November, 1786.

Beverley vs. John Doake--Deposition of Thomas Mitchell. 14th October, 1805, aged 73, says: Samuel Doak lived on the land in dispute upwards of sixty years ago and John has lived on it ever since Sam's death. Deposition of Hugh Fulton, 14th October, 1805, aged 77, says: He was acquainted with Samuel, father of John.
West vs. Byrd--Certified copy will of Andrew Byrd, dated 27th February, 1788. Probated 28th January, 1799, Rockingham County. Wife, Mary; daughter, Catherine Circle; place where she now lives. Son, Andrew Bird. Granddaughters, Mary, Elizabeth, Catherine and Nancy West. Grandson, William West; place where his mother lives; infant. Son Abraham. Deposition of William West and his wife Mary, 15th August, 1805, in Greene County, Tennessee, says: The negro in question was given to James West in 1773, about one year and a half after James and Caty West were married; Andrew Bird was hurt by a fall from a horse, and there was question whether he was of right mind afterwards. West. Her husband was James West. Administration was granted in Rockingham, 25th November, 1782, to Catherine West on estate of James West. Appraisement (copy filed) 10th September, 1783. Deposition of James West, of Hawkins County, Tennessee, 15th August, 1805. Children and heirs of James West, viz: Daniel Bealer and Polly (Mary), Catty and William. Bird had a negro wench, Sall, for several years before he sold her to the Baptist Society.

Bartholomew Fryatt vs. Thomas Kerr--James Quigley, of Rockbridge. Special bail, 24th July, 1806. In 1806 James Quigley bought land in Rockbridge. David Rapp swears in Rockbridge County, 3d June, 1806, that in September last he was at the house of Bartholomew Friatt, who then lived in Chilicothe, in Ohio, and he still lives there. Charge was that Bartholomew took two of Thomas' horses with him when he went from Quigley's.

Vanscone vs. Gladden--Deposition in Wythe County, 24th April, 1793, of Lucretia Vanscoyoe (Vanscoit) before James Campbell, says: In 1792 robbers came to the house of James Dougherty, in Rockbridge, whose housekeeper she was, and mistreated her.

Samuel Miller vs. Smith Lofland--Deposition of Plummer Thurston, 17th August, 1801, at house of Peggy Thurston, in King and Queen County. Plummer is son of Peggy. Deposition at same place and time of Peggy Thurston, aged about 54 years: In 1798 she sold the slave to Samuel Jesse, of Middlesex. She employed physicians for the slave, viz: One negro doctor and two women doctors, "whom had been much approved of in many cases of sickness." Deposition of Philip Sears at same time and place.
Messick vs. Ingram--1st September, 1801, Abraham Ingram and Elizabeth Ingram, of Bath County, are about to remove from the State of Virginia.
Peter Piper vs. Peter Hartley--Defendant in 179_, in County of York, Pennsylvania, was indebted to plaintiff. Certificate by Benjamin Wright, "member of the Abolition Society for the relief of five negroes unlawfully held in bondage," 14th December, 1779, that the negro was brought from Maryland to Pennsylvania, contrary to law of Pennsylvania, and was, therefore, free.

Frenger vs. Rev. William Wilson--Deposition of Conrad Highbarger, 19th December, 1803: In April last he went to Staunton, it being the day for election of members to General Assembly. Rev. William Wilson struck him in the crowd and called him a damned rascal.

Celia Blair vs. Wm. McKemy. Celia is dau. of Nancy Blair, the dau. of George Blair of Albemarle. Her father was a negro slave. She was put into care of Robert Cooper who married another daughter of sd. Blair's she was to be carried to Penna. to he educated, but Cooper brought her to Augusta and put her in possession of William McKenny, married Cooper's sister, in whose family she has remained--She is now over 21 and Wm. McKemy is dead and his son John detains her--April 2, 1803. Petition for freedom.

She christened the child, threw a basin of water on it and called it Cela--threw a basin of water on it in the name of the Commonwealth.

Depn. of David Snyder 26 Mar 1806--Ann took the Jerks--she was exercised for some time when she rose up & began dancing. Maj. H____ took hold of her arm saying it would not do to dance in Meeting--Daniel Lyle prevented him--James Decker came to Houston's assistce. & she was removed to the shade of a tree. "Depositions show that Houston's action met the approval of the Congregation and of Mr. Blair the pastor."

Miles vs. Henry Brill--"I, Henry Brill, of Heidelburg Township, County of Lancaster, Penna., yeoman," bond to Miles, &c., 4th June, 1783. John Bright and others petition June, 1797, for a road from James Rowan's at Rockbridge line to the great road passing through Greenville, as it is cut off by Christopher Myers. Sinlington vs. McClenachan--Certificate by Alexr. McClanachan of his obligation to deliver to Maj. Wm. Long warrant for 1,000 acres for his services in Continental service 1st December, 1783.
APRIL, 1808.
Beverley vs. Hutchinson--Papers, Writ right by Peter R. Beverley vs. George Hutchinson, 15 acres. Depn. 13th April, 1808, of James Gibson, aged 56 years, in Augusta. Depn. of Saml. Pilson 24th September, 1807, where he was about 9 or 10; he is now in his 69th year. Depn. of Joseph Brock of Orange County, 1813; in 1808 Maj. George Gibson was living near Cumberland Gap, Lee County. Depn. Benj. Stuart 17th October, 1807; he recollects that Wm. and Andrew Carr lived on the land 60 to 65 years ago. Benj. is now in 72d year. Alexr. Stuart deposes that about 1742, when he was a small boy, his father came into the neighborhood of the land in controversy and settled there. The two Carrs were then living there. Deponent lived in the neighborhood until 1766. Involves deed, Beverley to David Henderson, 1749.

Lukinbill vs. Z. Johnston. Moore vs. Gane--Depn. Jacob Peck, aged upwards of 90, at house of Jacob Cooper 1st April, 1797, near Fincastle. Bott. Nichols is son to Benj. Benden, Seni's eldest daughter. Jacob arrived in this country from Germany 52 years ago and Nichols was born 2 years after. Depn. of Lydia Peck, wife of above, sister to the mother of Wm. Nichols, and aged 80.

Alexander Humphreys vs. George G. McIntosh--Covenant. Parties entered into a partnership 12th November, 1793, jointly to practice physic and surgery and vending and compounding medicines. Dismissed at defendant's costs.
