Grimes WARRANTY DEED. Filed for record the 1st day of March 1907, A.A. Stewart, Clerk of the Circuit Court This Indenture, made the 17th day of January in the year of our Lord one thousand nine hundred and seven (1907) BETWEEN Robt L Motlow and Huldah Motlow, his wife of the County of Brevard and State of Florida of the first part, and Edgar E Grimes of Brevard County Florida of the second part, WITNESSETH, that the said parties of the first part for and in consideration of the sum of Two thousand DOLLARS lawful money of the United States of America, to them in hand paid by the said party of the second part, at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, remised, released, conveyed and confirmed, and by these presents do grant, bargain, sell, alien, remise, release, convey and confirm unto the said party of the second part, and his heirs and assigns forever, all those certain lots or parcels of lands lying and being in the County of Brevard, and State of Florida, and described as follows: "Commencing on the West bounds of Delanoy Ave at a stone post, run Westerly 114 feet more or less to a stone post, being the North West corner of a lot heretofore sold to Miss Kate & Harry Eyer, thence run North 20 feet, thence East 114 feet more or less to the West bounds of Delanoy Ave, thence South 20 feet to place of beginning, bounded on the South by lands of Kate & Harry Eyer, on the East by Delanoy Ave and North and West by lands of O.K. Wood, Lizzie Wood his wife and Addie M. Wood & recorded in Brevard Co. Florida March 21st 1891 in Book "P" page 150. This being the same land conveyed to Robt. L. Motlow by Kate Frink (Spinster) according to deed as recorded in deed Book "HH" page 171 &c Brevard Co, Florida records" Also: "Commence at a stone corner with a cross on top in the West bounds of Delanoy Ave and in the North line of land formerly owned by John Tompkins thence Westerly on said Tompkins North line 114 feet to a stone corner, thence Notherly and parallel with the West bounds of Delanoy Ave 39 & 3/4 feet, to a stone corner, thence Easterly 114 feet to the West bounds of Delanoy Avenue and a stone corner, thence Southerly on West bounds of Delanoy Avenue 40 feet to place of beginning and in the South East part of a portion of lot 3 in Section 33 Township 24 South Range 36 East in Brevard County as deeded to Mrs. Lizzie Wood and Miss Addie M. Wood by Aaron Fries and Loretta P. Fries his wife & dated Nov 15th 1890 and recorded in Brevard Co. Clerks office Mch 21st 1891 in Book "P" page 150 reference is hereby made to said deed for a more perfect description. This being the same land conveyed to Robt L. Motlow by G.W. Michael and wife, according to deed as recorded in deed Book "HH" page 264 Brevard Co. Florida records" Also: "Commencing at the North West corner of land heretofore deeded by parties of the first part to H.M. Hill, running thence Easterly in Hills North line to the Highway (Delanoy Avenue) thence North 20 feet to lands formerly occupied by Edward Stiling, thence Westerly in said Stilings South line 114 feet to a point North of the place of beginning, thence South to place of beginning. This being the same land conveyed to Robt L. Motlow by Addie M. Wood (Spinster) Lizzie Wood and O.K. Wood her husband, according to deed as recorded in deed Book "KK" page 230 Brevard Co. Florida records" All the above lands being in the town of Cocoa, Brevard County, Florida and being part of Section 33 Twp 24 S.R. 36 E. TOGETHER with all and singular the rights easements, tenements, hereditaments and appurtenances thereunto belonging, or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof AND ALSO, all the estate, right, title, interest, dower and right of dower, separate estate, property, possession, claim and demand whatsoever, as well in law as in equity, of the said parties of the first part, of, in and to the same, and every part and parcel thereof with the appurtenancs. TO HAVE AND TO HOLD the above granted, bargained and described premises, with the appurtenances, unto the said party of the second part, his heirs and assigns to their own proper use, benefit and behoof forever. And the said parties of the first part for themselves and for their heirs, executors and administrators, do covenant, promise and agree to and with the said party of the second part his heirs and assigns, that the said parties of the first part hereto at the time of the sealing and delivery of these presents are lawfully seized in fee simple of a good, absolute and indefesible estate of inheritance of and in all and singular the above granted, bargained and described premises with the appurtenances thereto belonging and have good right, full power and lawful authority to grant, bargain, sell and convey the same in manner and form aforesaid. And that the said party of the second part his heirs and assigns shall and may at all times hereafter peaceably and quietly have, hold, use, occupy, possess and enjoy the above-granted premises, and every part and parcel thereof with the appurtenances, without any let, suit, trouble, molestation, eviction or disturbance of the said parties of the first part their heirs or assigns, or of any other person or persons lawfully claiming or to claim the same. And that the same are now free, clear, discharged and unincumbered of and from all former and other grants, titles, charges, estates, judgments, taxes, assessments and incumbrances of what nature and kind soever. The taxes that may be levied for the year 1907 to be paid by the party of the second part hereto. And the said parties of the first part, for themselves and their heirs the above-described and hereby granted and released premises, and every part and parcel thereof, with the appurtenances, unto the said party of the second part his heirs and assigns against the said parties of the first part, and their heirs, and against all and every person or persons whomsoever, lawfully claiming or to claim the same, shall and will warrant and by these presents forever defend. IN WITNESS WHEREOF, the said parties of the first part have hereunto set their hands and seals the day and year first above written. Motlow do by these presents, made and executed by me separate and apart from my said husband, and in the presence of O.T. Richey a Notary Public of the State of [Florida is crossed out] acknowledge and declare that I did make myself a party to and executed the foregoing Deed of Conveyance for the purpose of releasing my dower and right of dower in and to the lands in said Conveyance described and granted, and that I did the same freely and voluntarily, and without any compulsion, constraint, apprehension or fear of or from my said husband. IN WITNESS WHEREOF, I hereunto subscribe my name and affix my seal this 16th day of February A.D. one thousand nine hundred and seven Huldah Motlow Territory of Arizona County of Pima TO ALL WHOM IT MAY CONCERN: Be it known that on this 23rd day of January A.D. 1907 personally appeared before me a Notary Public of the [State of Florida is crossed out] Territory of Arizona, the above-named Huldah Motlow to me well known as the wife of Robt. Motlow and as one of the persons described in and who executed the foregoing Deed of Conveyance, who being at the time separate and apart from her husband, the said Huldah Motlow did then and there make and execute the foregoing acknowledgment, her name being with her own hand subscribed and her seal affixed in my presence WITNESS my hand and seal at Tucson Arizona the day and year above written.
