Know all men by these present, that I make and declare this my last will and testament, revoking all others, here-to-fore by me made.

Item 1. I, having settled in full with my six sons, to wit: John, Joseph, Milledge, Elijah, Richard, and Edmund, children by my former wife, by paying them in full, all their rights, or title, in my estate, therefore they are to have no more.

Item 2. I will and bequeath to my five daughters, to wit: Mourning, Anna, Fanny, the children of Evaline Northcut, dec'd, and Lucinda, daughters of my first wife, the sum of two hundred dollars each. [ed. note: Evaline Northcutt was Elijah's deceased daughter and not his first wife, who was Anna Richardson]

Item 3. I will and bequeath to my present wife, Polly Dorsett and her five children, to wit: Marion, Washington, Andrew, Perry, and James Henry and such others as she may have by me or may survive at my death, like equally divided (240) two hundred, forty acres of land. Lot #118), one hundred-eighteen and the north half of Lot (#119) one hundred and nineteen, both in the Fifth District and fourth section of said County. Also, one negro boy, named Ham, about nineteen years old and Jude, a negro girl, about seventeen years old, likewise all my stock of horses, hogs, cattle, and sheep, my houshold and kitchen furniture and plantation tools together with all the ready money notes and accounts I may have at my death after paying my just debts.

Item 4. I hereby will and appoint James Herendon, my lawful executor to carry the provisions of this my last will and testament.

The within will and testament of Elijah Dorsett, dec'd, being presented by the court at this reqular term for probate and the same being proved upon the oath of Josiah Flourney, one of the subscribing witnesses, it is ordered that the same be admitted to record.
