BRIAN MCLENDON-BOZE KITCHENS

This indenture made this 8th day of December 1795 between Bryan McLendon of the County of Warren and State of Georgia of the one part, and William Kitchen of the other part, of the same county—Witnesseth for and in consideration of the sum of Twenty Pounds, in hand paid by the said William Kitchens, the reciept whereof is hereby acknowledged he the said Brian McLendon have given, granted, bargained and sold, and by these presents doth give, grant, bargain, sell, release and confirm unto the said William Kitchen his heirs and assigns forever, a certain tract, or parcel of land, containing ninety five acres, being part of a Tract lying and being on the waters of Rocky Comfort in the said county, beginning at a water oak on the creek, runing on

____s line to a pine x on Booze Kitchens line, thence on that line to the Branch, thence with the Branch to Rock Comfort, thence with Rock Comfort to the beginning x. Together with all and singular the Houses, buildings, orchards, woods and underwoods whatsoever thereunto belonging, or in anywise appertaining, and all the Interest, claim & demand of the said Brian McLendon, to the said Tract of Land & promises hereby conveyed, do have and to hold, the above Tract of land with the appertainances hereby conveyed, unto the said William Kitchens his heirs and assigns forever, the only proper use and behoof of him the said Wm Kitchens, and to no other use or purpose whatsoever; and the said Brian McLendon for himself, his heirs and assigns and every other person or persons will warrant and forever defend by these presents—In witness whereof of the said McLendon have hereunto set his hand and seal, the day and date above written

Georgia Warren County} This indenture made this thirteenth day of December, in the year of our Lord one thousand eight hundred and fourteen between Larry Kitchens of the said State and County of the one part & Charles McAllister of the same State and County of the other part. Georgia Warren County} This indenture made this Twenty fourth day of December in the year of our Lord one thousand eight hundred and fourteen, between John Burnett of the state of South Carolina Abbeville County, & Larry Kitchens of the State of Georgia & Warren County of the other part, witnesseth, that the said John Burnett do for the just & full sum of three hundred dollars to him in hand paid by the said Larry Kitcehns at or before the sealing and delivering of these presents, the receipt whereof, is hereby acknowledged by him the said John Burnett witnesseth, that the said John Burnett hath bargained, Sold & doth warrant & forever defends from myself, my heirs and assigns, and all other person or persons whatsoever shall come; All that tract, lott or parcel of Land laying and being in the county of Warren in said State of Georgia on the waters of Rocky Comfort Creek, the same to begin at a pine corner on the south side of said creek, a line runing North 37 degrees 10.15-50 to a pine corner, thence South 53 degrees W 23:50 to a pine corner, thence S. 37 . Georgia Warren County This indenture made this Twenty Seventh day of February, in the year of out Lord, one Thousand eight hundred and fifteen, between Batt Kitchens of the said State and County of the one part, and Booze Kitchens of the same State and County of Jones of the other part, witnesseth, that the said Batt Kitchens doth, for the consideration of the Just and full sum of Three hundred Dollars, to him in hand paid by the said Booze Kitching, the receipt where of is hereby acknowledged by him the said Batt Kitchens witnesseth that the …..Batt Kitchens hath bargained, sold and doth make over, and doth warrant & forever defend from myseld, my heirs and assigns, and all other person or person whomsoever Shall come, all that lot tract or parcel of land, lying and being in Said County on Rocky Comfort Creek-- the same to begin at a water oak on the creek, and runing on Charles McCallister’s line to a pine corner, thence on said McCallisters line to the branch, with the various meanders of Said Branch to Rocky Comfort Creek, thence up said Rocky Comfort to the beginning water oak, the Same to contain Ninety five acres of Land, be the same more or less, the same granted to Briant McClendon, together with all the houses, so ever belonging or in any wise appertaining, and all the Interest, claims and demands of him the said Batt Kitchens, his heirs and assigns, and all other person or person unto the said Booze Kitchens, his heirs and assigns, and to no other person or persons, to be conveyed to their own proper use and benefit, to have and to hold the above mentioned tract of land forever in fee simple, ____ date first above written

Georgia Warren County} This indenture made this twenty fourth day of November, in the year of our Lord one thousand eight hundred and fifteen, between Charles McCallister of said State and County of the one part and Batt Kitchens of the same state and county of the other part, witnessed, that the said Charles Mc Callister, do for the inconsideration of the Just and full… of two hundred Dollars to him in hand paid by the said Batt Kitchens, at or before the signing and delivering of these presents, the receipt of ….. is hereby acknoledged, by him the said Charles McCallister, witnessed, that the said Charles McCallister hath bargained sold conveyed and made over, and doth warrant & forever defend, for myself, my heirs ans assigns, and all other persons, whomsoever shall come, unto him the….. Georgia Warren County} This indenture made this 27th day of December in the year of our Lord one Thousand eight hundred and Thirty Seven between William R Kent of the County and State aforesaid of the one part and Henry Walden of the same place of the other part. Witnesseth that the said William R Kent for and in consideration of the sum of three hundred and Twenty five dollars to him in hand paid by the said Henry Walden at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and by these presents do grant bargain sell and convey unto the said Henry Walden his heirs and assigns a part of Two tracts of Land lying and being in the County of of Warren and State aforesaid on the west side of Joes Creek containing one hundred and fifty acres to the same more or less butted and bounded as follows beginning at a post oak corner and runing to a black gum corner. Georgia Warren County } Know all men by these present that I Lewis Pilcher of the County of Washington and State aforesaid hath for and in consideration of the sum of Three Hundred and fifty Dollars to him in hand paid by Joseph B May of the county of Warren and State aforesaid, hath bargained Sold and delivered and by these present doth bargain Sell and deliver unto Joseph B May his heirs and assigns all that tract or parcel of Land containing Three ;Hundred and Thirty Seven acres more or less lying and being in the county of Warren and state aforesaid on the waters of the Ogeechee River bounded by Seaborn Glovers land commencing at a North west stake corner on a branch commonly known as the flat Branch thence up the branch to a pine corner on the old Georgetown road ;and thence along the Georgetown road easterly until intersecting with the Savannah road to a pine corner fronting the House occupied by John and Eliza Davis and thence Southwardly to a pine corner and thence Southeasterly to a hickory corner and thence west to a pine corner (near the place now owned by James Johnson) and thence northwest to the beginning, together with all and singular the right members/numbers and appertenances to the said premises belonging or in anywise incident or appertaining thereunto to have and to hold all and Singular the premises before mentioned unto the said Joseph B May his heirs and assigns forever and I do hereby bind myself my heirs and assigns to warrant and defend all and singular the said premises unto the said Joseph B May his heirs and assigns against every other person or persons or claimants whatsoever the same or any part thereof.

Witnesseth that the said Simpson for the in consideration of the sum of fifty Dollars to him in hand paid by the said Kent at or before the signing sealing and delivering of the presants the receipt thereof is hereby acknowledged hath bargained sold and conveyed and do by these presants bargain and sell a certain tract or parcel of land containing One Hundred acres more or less Situate lying and being in the County and State aforesaid and on the waters of Big Creek adjoining Lands of said Kent and Land of Thigpen and Lands of Thomas Downs to have and to hold, the said tract or parcel of Land to his now proper use benefit and behoof in fee simple. Georgia Warren County} This indenture made this fourth day of June Eighteen Hundred and forty five between Vinson Johnson of the one part and Vinson A Johnson of the other part both of the County and State aforesaid. Georgia Warren County} This indenture made this 12th day of May in the year of our Lord one thousand eight hundred and fifty between Thomas Kent of the County and State aforesaid, of the one part and Reny Walden of the same ____ of the other part witnesseth that the said Thomas Kent for and in consideration of the sum of 500 dollars to him in hand paid at and before the sealing and delivering of these presents, the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and by these presents do grant bargain sell and convey unto the said Reny her heirs and assigns all that tract or parcel of Land situate lying and being in the County aforesaid on the waters of Joes Creek containing one hundred and thirty two acres being the one half of a Tract of Land granted to the said Thomas Kent grant beaning date the 4th day of April 1834 beginning at the big Road at a pine corner thence S. 51 W. 37 to a pine thence nearly a South course to a Blackgum corner to on the contract line of Lorenzo D Downs thence across to the big Road to a corner thence up said Road to the beginning corner and the said Thomas Kent for himself his heirs executors and adminstrators the said bargained unto the said Reny Walden her heirs and assigns will warrant and forever defend the right and titles thereof against himself and against the claims of all other persons whatever in witness whereof the said Thomas Kent hath hereunto set his hand and seal the day and year above written

Georgia Warren County} This indenture made the twenty ninth day of July Eighteen Hundred and thirty Six between Henry T Burnley of the one part and Thomas Roney of the other part both of the aforesaid State & County Witnesseth that the said Henry T Burnley for and in consideration of the sum of thirty dollars to him in hand paid at or before the signing, Sealing & delivery of these presents the Receipt whereof is hereby acknowledged have bargained and Sold to the said Thomas Roney his heirs & assigns all tha tract or parcel of land in the State and County aforesaid on the waters of Sweetwater Creek containing by estimation ten acres more or less beginning at a Stake Corner on Burleys Land & running N82 W ___ chains up a Branch to a Gum Corner thence South nineteen chains & fifty links to a gum corner on a Branch thence down said Branch to a popler corner on Said Branch near the ford. Thence North fifteen chains to the beginning Stake Corner on a Branch Said Land adjoining Watson on the North, Burnley on the East and Watson on the South & West. Together with all and Singular the Rights Members & Appertenances thereof unto the said Thomas Roney his heirs & assigns to have & to hold for their own proper use benefit & behoof forever in fee simple. Also one third of eighty acres in Warren County adjoining White & Watson on Sweetwater Creek Together with all and Singular the rights members & appartenances thereof unto the Said Thomas Roney his heirs and assigns to have and to hold for their own proper use benefit and behoof forever in fee simple. The said Benjamin A Story for himself his heirs Executors and Administrators do warrant and defend the right and title thereof from themselves and all other persons whatever.

Georgia Warren County} Whereas Boze B Kitchens of said County Administrater of Lawrence Kitchens late of said County deceast did on the Seventh day of November in the year aforesaid our Lord Eighteen Hundred and forty four commenced the publication of a notice in the Chronicle _____ published at Augusta to all concerned that at the _____ of four months from that date said B B Kitchens, Adm as aforesaid would apply to the Honorable Inferior Court of Warren County when ?filling for ordinary purposes for leave to sell the land belonging to the Estate of said Deceast and whereas their being no objection made to said application the said Court did on the eighth day of April in the year of our Lord eighteen hundred and forty five pass an order granting leave to said B B Kitchens Admr as aforesaid to sell said land and whereas in

_____ of said order and after the publication of the notice of sale in the Chronicle and ____ for Sixty days said B B Kitchens Adm as aforesaid did on the first Tursday in September in the year of out Lord Eighteen hundred and forty five at the Court House door at Warrenton in said County between the lawful hours of sale put up at publick outcry a certain tract or lot of Land in said County containing four hundred & twenty five acres more of less as appear by oridginal Survey and Timothy Kitchens being the Highest & best bidder said Lot of land was knocked of to him at and for the sum of one hundred & ninety five dollars.

This Indenture made this thirteenth day of July in the year of our Lord one thousand eight hundred and fifty three between Joseph B. Ivy of the County and State aforesaid of the one part and Robert R. Beck of the same place of the other part Witnesseth that the said Joseph B. Ivy for and in consideration of the sum of eight hundred dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted, bargained sold and conveyed and does by these presents grant, bargain, sell and convey unto the said Robert R. Beck his heirs and assigns all that tract or parcel of land situate lying and being in the County and State aforesaid. The boundary line beginning and running as follows: at the mouth of Whiteside Creek thence up said creek to a Birch adjoining Thomas P. Cooper thence to a stone corner. Coopers corner thence 3.35 W 16.76 to a Rock corner thence L 65 E 14.29 Latitude thence N 21 E to a stake on Thomas Dyers line thence to a Rock on Thos. Dyers line, thence to a _____ thence down the old Road landing to Hills Creek to white oak. Thence by a _____ line to a stake corner known as the said Thomas Dyers & Thos T. Ba______ corner thence by a short line to a rock on the bank of Little River. Thence up the said River to the mouth of Whitesides Creek the beginning point. To have and to hold said tract or parcel of land unto him the said Robert R. Beck his heirs and assigns together with all and singular use rights members and appurtenances. Thereof to the same in any manner belonging to his and their own proper use benefit and be hoof forever in fee simple. And the said Joseph B. Ivy for himself his heirs executors and administrators the said bargained premises unto the said Robert R. Beck his heirs and assigns will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatever. In witness whereof the said Joseph B. HARMON PERRYMAN AND EPHRAIM IVY
14TH DAY OF DECEMBER 1810

This Indenture made this fourteenth day of December in the year of our Lord one thousand eight hundred and ten between Harmon Perryman of the County of Warren and State of Georgia of the one part and Epram Ivey of the same State and County aforesaid of the other part. Witnesseth that the said Harmon Perryman for and in consideration of the sum of five hundred dollars to him in hand will and truly paid by the said Ephaim Ivey the receipt whereof is hereby acknowledged hath granted, bargained, sold, released, conveyed and confirmed and by these presents doth grant bargain sell release convey and confirm unto the said Ephaaim Ivey his heirs and assigns forever, all that tract or parcel of land lying and being in the County of Warren aforesaid butting and bounding as follows, viz: beginning at a black Jack, thence North twenty-two degrees, East forty-eight chains by other lands of William Cawthon pine corner, thence North twenty-five degrees West eleven chains and fifty links to a pine, thence by Kemp land North sixty-five degrees East thirty-one chain and fifty links to a Hickory corner. Thence North twenty-nine degrees East five chains to a Stake, thence by John Parrhams land South eighty-three degrees West fifty-eight chains and seventy __ links to a pine corner, thence to the place of beginning containing one hundred and forty acres be the same more or less, with _____and singular the rights, members and appurtenances thereof, whatsoever, to the said tract of land belonging or in any wise appertaining and the remainders unto ____ and profits thereof and of every part and parcel thereof. To have and to hold the said tract of land and all and singular the premises and appurtenances thereunto belonging, or in any wise appertaining and every tract and parcel thereof unto the aforesaid Ephraim Ivey, his heirs and assigns forever and the said Harmon Perryman for him and his heirs the said tract of land and premises and every part and parcel thereof unto the said Ephraim Ivey his heirs and assigns against him the said Harmon Perryman and his heirs &c. against all and every other person or persons whatsoever shall and will warrant and forever defend by these presents. 20TH DAY OF AUGUST 1860

This Indenture made this the twentieth day of August in the year Eighteen hundred and Sixty. Between Zacheus Ivy of said State and County of the first part and Elizabeth S. Hill of same place of the second. Witnesseth that the said Zacheus Ivy for and in consideration of the sum of Seven Hundred Dollars to him in hand paid by the said Elizabeth S. Hill the receipt whereof is hereby acknowledged does by these presents give, grant, bargain, and sell and convey unto the said Elizabeth S. Hill her heirs and assigns a certain tract or parcel of land lying situate and being in the County of Warren containing one hundred acres more or less adjoining or bounded by lands belonging to George W. Ray, Edmund C. Hardaway and Fleming Geesling. Together with all the privileges, thereunto in any wise appertaining. To have and to hold the said lot or parcel of land to the said Elizabeth S. Hill her heirs and assigns in fee simple.

And the said Zacheus Ivy will and his heirs, Executors and Administrators shall the said property to the said Elizabeth S. Hill her heirs, Executors and Administrators forever Warrant and defend against the Lawful demands of all persons unknown.

20TH DAY OF AUGUST 1860

This Indenture made this the twentieth day of August in the year eighteen hundred and sixty between Zacheus Ivy of the County of Warren and State aforesaid of the first part and Jacob Printup of the same place of the second part. Witnesseth that the said Zacheus Ivy for and in consideration of the sum of One Thousand Dollars to him in hand paid by the said Jacob Printup the receipt whereof is hereby acknowledged does by these presents grant, bargain, sell and convey at the death of my mother in law Catherine Grinade the one half interest in a certain tract or parcel of land situate lying and being in the County of Warren adjoining lands belonging to said Jacob Printup, George W. Ray, Seaborn Ivy and Edmund C. Hardaway and containing two hundred acres more or less. The one half interest being one hundred acres together with all the privileges thereto in any wise appertaining to have and to hold the said granted premises of one hundred acres unto the said Jacob Printup his heirs and assigns in fee simple.

And the said Zacheus Ivy will and his heirs, Executors, and Administrators shall the said property to the said Jacob Printup his heirs, Executors, and Administrators forever warrant and defend against the lawful demand of all persons whatever.

Witnesseth that the said Harmon Perryman for and in consideration of the sum of five hundred dollars to him in hand will and truly paid by the said Ephraim Ivey at or before the Sealing and delivery of these presents, the receipt whereof is hereby acknowledged hath granted, bargained, sold and released and confirmed and by these presents doth grant, bargain, sell, release and confirm unto the said Ephraim Ivey his heirs and assigns all that tract or parcel of land Situate lying and being in the County and State aforesaid having such marks and forms natural and artificial as are ________ and delineated in the annexed plat, beginning at a post oak on Balls land running N 65 E 34.70 to a sweet-gum corner on Slatter & Persons land thence N 25, W 31.70 to a hickory on said Perrymans land thence S 65 W 31.70 to a pine on Do(ditto) thence S 25 E 12.25 to a pine on Do(ditto) thence S 76 W 35 to a pine on James Cooper's Decs thence S 33 E 43 to a black jack on Ball's land thence N 45 W 30 to a " P" oak as Do(ditto) thence N 25 W 2 to the beginning corner for two hundred acres be the same more or less together with all and singular the rights members and appurtenances thereunto whatsoever to the said tract of land being belonging or in any wise appertaining and remainders, reversions, rents issues, profits thereof to have and to hold the said tract of land and all and singular the premises and appurtenances thereunto belonging as aforesaid and every part thereof unto the said Ephraim Ivey his heirs and assigns to the only proper use benefit and be hoof of the said Ephraim Ivey his heirs and assigns forever and the said Harmon Perryman his heirs &C the said tract of land and premises aforesaid and every part thereof unto the said Ephraim Ivey his heirs and assigns against himself the said Perryman his heirs and all and every person or persons whatsoever shall and will warrant and forever defend by these presents. ROBERT BARTON AND JAMES McDADE
APRIL 9, 1798

Record Submitted by Mary Thoeni at Email: bsolut@chugach.net The following record, dated April 9, 1798., is found in Deed Book A, p. 453, Warren Co., GA. (Warren Co., was created in 1793 from Washington, Richmond and Wilkes Counties.

"Indenture between Robert Barton, planter and James McDade, planter, for fifty pounds sterling, 100 acres on Rockey Comfort Creek on Watery and Bon Branches. Signed: James McDade and Elizabeth McDade. Witnesses: James Barton and Samuel Beatty.

Prior to 1793, James McDade and wife Elizabeth lived in Washington Co. He is a Revolutionary Soldier, served under Col. Anderson before the reduction of Charleston (S.C. Hist. Com. 175F, 54. Columbia). James McDade moved his family to Alabama between 1818 and 1819.
