War of 1812---Claim of Widow for PensionState of Georgia--County of Forsyth
On the 21st day of June, A.D. one thousand eight hundred and seventy eight personally appeared before me, W.D. Bently, Ordinary, the same being a Court of Record within and for the county and state aforesaid, Sarah Hamby aged 63 years, a resident of Cherokee County, in the State of Georgia, who, being duly sworn according to law, declares that she is a widow of John Hamby deceased, who is the identical John Hamby, who served under the name of John Hamby as a private in the company commanded by Captain Joshua Ingram, in the regiment of South Carolina Militia commanded by Colonel Nash in the War of 1812; that her said husband volunteered at Pendleton Court House on or about the first day of September, A.D. 1814, for the term of six months, and continued in actual service in said war for the term of about 6 months and whose services terminated, by reason of Honorable Discharge at Abbeville Court House S.C., on the 1st day of March, A.D. 1815. She further states that the following is a full description of her said husband at the time of his enlistment, viz: about 6 feet high, blue eyes, dark hair, complexion-fair, occupation--a farmer, born in Greenville, S.C., resided in Pendleton District, S.C. She further states that she was married to the said John Hamby in the county of Gwinnett, and in the State of Georgia, on the 23rd day of October A.D. 1833, by one John Mills, who was a Justice of the Peace, and that her name before her said marriage was Sarah Cook, and that she has not remarried since the death of the said soldier; and she further states that her said husband had been previously married to Hannah Butler, who died about the year 1818. And, that she has never been previously married, only to John Hamby and that her said husband John Hamby, died at Lumpkin County in the State of Georgia, on the 31st day of August, A.D. 1852; and she further declares that the following have been the places of residence of herself and her said hushand since the date of his discharge from the Army, viz: Greenville District, S.C. to 1830, in Gwinnett County, Georgia to 1833. Also in Gwinnett Co. 2 years thereafter, then in Lumpkin Co. where he died in 1852 & where she resided to 1874, then in Cherokee County to the present. She makes this declaration for the purpose of obtaining the pension to which she may be entitled under the provisions of Sections 4736 to 4740 inclusive revised Statutes, and the Act of March 9, 1878, and hereby constitutes and appoints with full power of substitution and revocation, H.H. Walker of Crosscreek Georgia her true and Lawful Attorney, to prosecute her claim and she further declares that she has heretofore made no application for pension-but received a Land Warrant for 40 or 80 acres after he died upon an application he made before he died. She has never received any pension and that her residence is in the County of Cherokee, State of Georgia, and that her post-office address is Mica, Pickens County, Georgia.
