Georgia, Madison County: By virtue of an order from the honorable the Inferior
Court of said county sitting for Ordinary purposes at November Term 1842, for the purpose
of dividing and allotting the slaves of James Carithers, late of said county, deceased, to
the heirs of said deceased, to us directed (to wit) Richard B. Gholston, Henry P. Smith
and Willis Strickland, commissioners appointed by said court to assign and allot to each
of the distributees of said deceased their equal number or share of said slaves according
to valuation at the time of this assignment, that is legally authorized to ---- the same,
the commissioners first being sworn to allot and assign the same according to law and
equity and to the best of their skill and understanding. And finding that there are twelve
legal heirs of said deceased proceeded to allot and assign to the heirs of said deceased
in the manner following, to wit:

Which several shares or lots of the above and foregoing apportioned slaves
belonging to the estate of the said James Carithers, dec’d represents each of the
said distributees’ shares or portion by name and value so far as they are of lawful
age or lawfully represented, there being seven of the above shares not drawn, viz, No. 1,
3, 4, 5, 6, 8, 12 which remain undrawn and unassigned, belonging to the minor heirs of
said dec’d and the shares so allotted, drawed and assigned to those the heirs that
are of lawful age or legally authorized to receive the same to be held, possessed and
enjoyed by each distributee as aforesaid, the other seven shares to remain in the hand of
the administratrix and administrator until the persons legally entitled to the same comply
with the requisitions of the law in such cases made and provided. And the administrator
and administratrix are required to retain in their hands a sufficient amount of money to
make all the shares of the distributees of equal value according to the foregoing estimate
and assignment, viz, making each distributive share or lot the sum of three hundred and
sixty four dollars sixteen and two third cents. Given under our hands this twenty first
day of December eighteen hundred and forty two.

Which several lots or shares of the above and foregoing apportioned slaves
belonging to the estate of the said James Carithers, deceased, each of the said
distributees’ shares or portion by name and value so far as they are of lawful age or
lawfully represented, there being six of the above shares not drawn, to wit, No. 1, 2, 3,
4, 5 & 6, which remains undrawn and unassigned belonging to the minor heirs of said
deceased; and the share so allotted, drawn and assigned to receive to the heir that is of
lawful age or legally authorized to receive the same to be held, possessed and enjoyed by
the distributee as aforesaid, the undrawn shares to remain in the hands of the
administratrix and administrator until the person legally entitled to the same comply with
the requisition of the law in such cases made and provided. And the administratrix and
administrator are required to retain in their hands to a sufficient amount of money to
make all the shares of the distributees of equal value according to the foregoing estimate
and assignment, to wit, making each distributive share or lot the sum of four hundred
thirty nine dollars, twenty eight and a half cents.

legal representatives may each receive an equal share of said slaves – to us directed
(to wit) Rich’d B. Gholston, Henry P. Smith & Willis Strickland, Commissioners
appointed by said court to allot and assign as aforesaid according to valuation, we the
commissioners first being sworn to allot and assign the same according to law and equity
and to the best of our skill and understanding, have proceeded to value, allot and assign

Making the whole valuation of said slaves twenty five hundred and twenty five
dollars. And there being six legal heirs of the said deceased who have not heretofore
received their share of the negro slaves of said deceased, Lot No. 3 in the foregoing
allotment was drawn and assigned to Israel R. Wood, guardian of Mary
F. Wood, minor heir of Mary A. Wood, now deceased, formerly Mary A. Carrethers, one of the heirs of James Carrithers, deceased – to be held,
possessed and managed by the said Israel R. Wood, guardian as aforesaid, he the said
guardian first paying back to the administrators of said estate the sum of One hundred
& four dollars sixteen & two third cents. Lot No. 3 being that sum over and above
an equal share, making each distributive share or lot the sum of Four hundred & twenty
dollars, eighty three & one third cents, and also complying with the law in such cases
made and provided. Lots No. 1, 2, 4, 5 & 6 not drawn to be managed by the
administrator and administratrix as heretofore.

dec’d and the share so allotted, drawed and assigned to John J. Carithers to be be
held, possessed and enjoyed by him as one of the heirs of the said dec’d, the undrawn
shares to remain in the hands of the administratrix and administrator until the said John
J. Cairthers complies with the requisition of the law in such cases made and provided. And
the administratrix and administrator are required to retain in their hands to a sufficient
amount of money to make all the shares of the distributees of equal value according to the
foregoing estimate and assignment, to wit, making each distributive share or lot the sum
of four hundred and forty five dollars. Given under our hand this 30th day of
December eighteen hundred and forty five.

foregoing estimate and assignment, to wit, making each distributive share or lot the sum
of five hundred and eighty seven dollars & fifty cents. Given under our hand this 31st

Georgia, Madison County: By virtue of an order from the honorable Inferior
court when sitting for Ordinary purposes of said county on the first Monday in November
1842, to us directed authorizing and requiring us to make distribution of the estate of
James Carithers, late of said county, deceased, among the distributees entitled to the
same, we proceed this day to the performance of that duty –
There were three distributees, to wit, Isham J. M. Goss
in right of his wife Frances Goss, formerly Frances Carithers, and Hugh Carithers, daughter and son of said deceased of full age, and Nancy Carithers, minor child of said deceased whose interest in
said distribution was not represented. Three shares was numbered 1, 2, 3 and Isham J. M.
Goss was not represented, he not being present.

distribution of the estate of James Carithers, late of said county, deceased, among the
distributees entitled to the same, we proceeded this day to the performance of that duty.
There were two distributees, to wit, Isham J. M. Goss in right of
his wife Frances Goss, formerly Frances Carithers, daughter of said deceased, of
full age, and Nancy Carithers, minor child of said deceased,
