Section II And be it futher enacted by the authority aforesaid, That the new county described in this first section of this act, shall be called and known by the name of Polk County and shall be attached to the fortieth sentorial district, Blu Ridge Judicial Circuit and to the first Brigade of the Eleventh Division Georgia militia.
Section V Be it futher enacted by the authority aforesaid, That the election of the county generally and the public business thereof, shall be held and transacted at Cedartown, in the second district of the fourth section, until the public site shall be located by the Inferior Court as foresaid, and until the organization of the Militia District, after which, in each of said districts, there shall be election precincts, and votes recived at them accordingly.
Section XI Be it futher enacted by the authority aforesaid, That from the sale of town lots at the new county site to be located in such new county site to be located in such new county, it shall be and is hereby made the duty of the Inferior Court of such new county, to pay to the citizens resident within the corporate limits of the town of Van Wert, whatever amount of damages they may sustain to their property within thereform, such damage to be assessed by five freeholders to be appointed by the Inferior Court of said new county.

Section I The General Assembly of the State of Georgia do enact, That John R. Scurry, H. W. Allen, S. B. Pierce, Charles T. Parker and Rufus P. Heslip be, and they are hereby appointed Commissioners of the town of Van Wert, in Polk County, Georgia, with power and authority to make such by-laws for the Government of said town as may be necessary for the preservation of good order; Provided, said by-laws be not repugnant to the Constitution and laws of this state or of the United States.
Section II Be it further enacted by the authority aforesaid, That the said town of Van Wert is hereby incorporated, and the limits of the incorporation shall extend from the courthouse in every direction five hundred yards.
