This Indenture made the 7th
day of October in the year Eighteen hundred and fifty six between James T.
Ellis Administrator of the goods and chattles rights & credits & which
were of Richard P. Ellis decsd of the first part and C. S. Westmoreland of
the second part. Witnesseth that whereas the ordinary of the said County
of Spalding did at his court holden in the month of July last past appoint
the said James T. Ellis as Admr as aforesaid to sell & dispose of all the
real estate of the said Richard P. Ellis Decd and whereas the said James
T. Ellis having given public notice of said sale for sixty days in the
Empire State a Gazette published in the City of Griffin and said County
and having complied with all the requisitions of the law therein did on
the first Tuesday in the present month proceed to expose the Lot of Land
hereinafter described at the Court House in said County between the hours
limited by law for such sales and whereas the said C. S. Westmoreland
bought said lot at and for the sum of eleven hundred & fifty dollars which
was the highest sum bid for the same at such sale, Now the Jas T. Ellis
Admr as aforesaid in consideration of the said sum of Eleven hundred and
fifty dollars to him in hand paid the receipt whereof is hereby
acknowledged has granted bargained and sold & by these presents doth grant
bargain & sell unto the said C. S. Westmoreland his heirs and assigns a
hundred acres of land in said County of Spalding known in the plan of said
County as the west half of Lot Number thirty six in the third district of
Originally Henry now Spalding County to have and to hold the said premises
to the said C. S. Westmoreland heirs and assigns forever in fee simple.
In testimony whereof the said James T. Ellis Admr has hereunto set his
hand and seal the day and year above written.

Thomas Ellis to Radford Ellis

Spalding County
This indenture made and entered into this the 27th day of October AD
1859 between Thomas Ellis of the one part and Radford Ellis of the
other part both of the County and State aforesaid. Witnesseth that
the said Thomas Ellis for and in consideration of the sum of one
hundred dollars to him in hand paid by the said Randolph Ellis at
and before the sealing and delivery of these presents the receipt
whereof is hereby acknowledged hath bargained sold and conveyed and
doth be these presents grant bargain sell and convey unto the said
Randolph Ellis his heirs & assigns all that tract or parcel of land
known and distinguished by lot no. (101) one hundred and one in the
third district of originally Henry now Spalding County it being ten
acres on the south west corner of said lot bounded by Short Step
Creek on the east being the line between said land and Wm S.
Heronton it being ten acres more or less to have and to hold said
described parcel of land with all and singular to the said Radford
Ellis his heirs and assigns together with all the rights members and
appurtenances to the same or in any manner belonging to his and
their own proper use benefit and behoof forever in fee simple and
the said Thomas J. Ellis for himself his heirs executors &
administrators the said bargained premises together with the right
title & possession thereof unto the said Radford Ellis his heirs I
will warrant and forever defend the right and title thereof against
the themselves and against the claim of all other persons whatsoever

Puckett Family to

Whereas on the ninth day of January in the year of
our lord eighteen hundred and fifty-one Nathaniel M Lawrence made his
certain instrument in writing commonly called a Deed of Trust, whereby he
conveyed to Benjamin A W Puckett in trust for the sole and separate use of
Sarah A. F. Puckett, Sophronia E Puckett and George T Puckett children
of the said B A W Puckett one town lot in the City of Griffin in said
county situate and lying and being in that part of the city of Griffin
North of Solomon Street in what is called West Griffin and known and
distinguished in the plan of said city by lot number nineteen containing
one acre more or less and whereas Sarah Ann F. Puckett intermarried with
William T. Ellis who with the assistance of B. A. W. Puckett has erected a
small dwelling house on the west half of said lot and whereas the said B.
A. W. Puckett has departed this life, the said children named in the said
deed are desirous of dividing said property. It is therefore contracted
consented and agreed that said west half of said lot is hereby conveyed
thru the said Castes Qui Trust consenting in trust to the said William T.
Ellis with all the rights members & appurtenances thereunto belonging for
the sole and separate use of his wife Sarah Ann F. Ellis formerly Puckett
during her natural and after her death to her children free from the debts
or contracts of her present or any future husband and it is further agreed
and consented that the East half of said lot with the rights members and
appurtenances thereto belonging remain the property of Sophronia McKee
formerly Puckett and George Puckett to dispose of as they may think proper
& at joint tenancy or tenancy in common so far as the said Sarah Ann F.
Ellis is concerned is by these presents severed and the interest of each
defined by these premises as aforesaid and all the parties aforesaid
hereby conveying it & relinquish to each other as aforesaid the said
William T. Ellis consenting and hereby accepting said trust by his
signature to this indenture. To have and to hold the same forever in fee
simple. And the parties aforesaid by signing this indenture relinquish
their interest to said premises as set forth in this Indenture, against
themselves, their heirs executors administrators and assigns forever and
all other persons whatsoever.

This Indenture made this 28th day of March
in the year of our Lord one thousand Eight hundred and sixty between John
a. Ellis, Elijah Wilson, Wm J. Ellis, James T. Ellis and the legatees of
Richard P. Ellis of said County of the one part and the Savannah Griffin &
North Alabama Rail Road Company of the other part Witnesseth that the said
John A. Ellis, Elijah Wilson, William J. Ellis, James T. Ellis and the
legatees of Richard P. Ellis for and in consideration of running their
certain plated Rail Road on and along his land as well as in consideration
of the sum of five Dollars to him in hand paid at and before the sealing
and delivery of these presents the receipt whereof is hereby acknowledged,
hath given granted bargained & sold, and doth by these presents give grant
bargain and sell unto the said Savannah, Griffin & North Alabama Rail
Road Company, and its successors and assigns the right of way over which
to pass at all times by themselves, Directors, Officers, Agents, servants
and hirelings, in any manner they may think proper and particularly for
the purpose of running erecting and establishing thereon a Railroad, with
double track & turn outs, or with single track and turn out as may at
times be at the discretion of said Company, pursuant to a charter of
incorporation granted to said Company passed the eleventh day of February,
eighteen hundred and fifty four. And to this end the limits of said right
of way shall extend in width an average of Fifty feet on each side from
the center of the roadway of the said Rail Road, when completed, and to
extend in length through the whole tract of land owned & claimed by the
said John A. Ellis, Elijah Wilson, Wm J. Ellis, Wm J. Ellis, James T.
Ellis and the legatees of Richard P. Ellis, situate, lying & being in the
said County, adjoining lands of James T. Ellis, John T. Ransom and Elijah
Wilson known as part of lot No. 66, and running in such direction through
said tract of land as the said Savannah, Griffin and North Alabama Rail
Road Company, by their Agents, Managers or Workmen, shall think best
suited for the purpose of locating and establishing their said work, And
connected with said right of _____, said Company shall have the right to
cut down and remove all such timers or other growth on each side of said
Road, as _______ by falling on or skirting the same, injure the _____
other parts of said Road together with the right to pass over said
premises in any direction, with teams or otherwise aforesaid,
______________ construction, maintainance and management of said Road.
Together with all and singular the rights members and appurtenances to the
said strip, tract or parcel of land being, belonging or in any wise
appertaining and more especially the right of way over the same. To have
and to hold the same unto the said Savannah, Griffin and North Alabama
Rail Road Company their successors and assigns to their own proper use
benefit and behoof forever, in fee simple. Upon Co. ______, and it is
expressly understood that should the said Rail Road Co. __________ as
aforesaid be not run, located and established on and along said strip,
tract or parcel of land described in the above and foregoing indenture
then said indenture is to be wholly null & void, and of no effect. And
the said John A. Ellis, Elijah Wilson, William J. Ellis, James T. Ellis
and the legatees of Richard P. Ellis for themselves their heirs, assigns
the said bargained premises with the Savannah Griffin & North Alabama Rail
Road Company, their successors or assigns will warrant & defend the title
thereof against the claims of themselves only by virtue of these
premises.

the legatees of Richard P. Ellis hath hereunto set their hand and affixed
