Probate for Reuben Graham, Crawford Co., Illinois
Miles Flinn Administrator of Reuben Graham vs. Elizabeth Graham and
Susannah Graham, Petition for Sale of Real Estate to Pay debts. Term
July 1863.
Now at this day causes the said administrator and gives the court to
understand that Susannah Graham one of the defendants herein is an
infant under the age of legal majority and au motion of said
Administrator Ed. S. Wilson Esgn is appointed guardian of said infant
defendant Susannah Graham and the said Ed S. Wilson appears in open
court and waiver further notice herein. Causes also the said
guardian Ed. Wilson and files the answer of Susannah Graham infant
defendant herein in substance that he knows nothing of the matter and
things in said petition and calls for proof of the same.
And the residence of the said defendants being each three times
solemnly called causes not but makes default herein. And it
appearing to the satisfaction of the court that there has been due
service of process herein. Upon the said Elizabeth Graham.
It is therefore ordered by the court the matters and things contained
in said petition be taken as confessed by the said Elizabeth Graham
the adult defendant herein. And the court being fully advised and
satisfied from the petitions answer of guardian exhibits and proofs
addressed that the said administrator has made a just and true
account of the condition of said deceased and that the personal
estate of said deceased will not be sufficient to pay the debts of
said estate cast of administration and the probate amount that will
be required to be raised out of the real estate of said deceased will
be the sum of $150.00.
And the court being also satisfied from the proofs that the said
deceased died seized of his own right in the North East quarter of
the North West quarter of Section Eleven, Township five, North of
Range fourteen, west lying and being in the County of Crawford, State
of Illinois.
It is therefore ordered by the court that the said administrator
proceed to sell said tract of land at the premises or at the North
front door of the court house in the town of Robinson in said county
at public venue. On a credit of six and twelve months after posting
up written notices of the time and place of said sale for the space
of six weeks and causing the same to be published in some newspapers
of general circulation as required by the statutes in such cases made
and provided. And that he take from the purchaser notes with
approved permission security and a mortgage on the premises sold and
that he execute to the purchases a deed of conveyance for the same
and that he apply the proceeds of said sale to the payment of the
debt of said deceased and the costs of administration and that he
make report of his actings and doings herein to this court at some
subsequent term to which time this cause is continued.

In the matter of the estate of Lewis Graham, deceased. Order on
appraisement bill and estimate to widow.
Now at this day comes John Sheets and James Leib Administrators of
the Estate of said deceased and presents to the court an appraisement
bill of the goods of said deceased accounting to the sum of $356.50
also are appraisers estimate of specific property allowed by law to
the widow for herself and family accounting to the sum of $462.50 and
the court having exercised the said appraised bell and estimate and
being sufficiently advised deed satisfied concerning the same it is.
Ordered that the same be approved and it is further ordered that the
same filed & recorded.
In the matter of the estate of Lewis Graham, deceased. Order on
Inventory to widow and inventory Real Estate.
Now at this day comes John Sheets and James Leib Administrators of
the Estate of Lewis Graham deceased and presents to the court an
inventory of property taken by the widow of said deceased amounting
to the sum of $351.20m also the inventory of the real estate of said
deceased amounting to the sum of $--.-and the court having examined
the said account & bills and being sufficiently advised and satisfied
concerning the same it is ordered that the same be approved and is
further ordered that the same be filed & recorded.
In the matter of the estate of Lewis Graham, deceased. Admin.
Appointed equal.
Ordered that John Sheets and James Lieb be appointed Administrators
of the estate of Lewis Graham who died in said county on or about the
1st day of January A.D. 1866, upon their entering into bond in the
penal sum of five hundred dollars with good security and taking the
oath required by law.
And now again comes the said John Sheets and James Lieb and presents
to the court for approval their bond as before by this court required
with Edward Neely as security thereon and the court having examined
said bond and being sufficiently advised and satisfied concerning the

Information on the Graham family
The earliest that I can find Burrill Graham is in the 1810 North
Carolina census. He is found there as Burl Graham, in Richmond
County.
He is listed in the 1812 North Carolina Muster Rolls for the 1812
War. He is found in the Third Regiment, (Believe to be Cavalry)
of Richmond County. The captain is Pleasen M. Mask, 1st Lt.
Henry Thomas, 2nd Lt. John MacKinnon, 3rd Lt. John Carmichael and
Ensign Shelsby Cobman. Also found in that unit is Archibald
Graham Jr, could this be a brother of Burrill? Another Archibald
Graham (Believe to be the father) is found in Moore County, Third
Regiment. (Just speculation on the relationships.)
It is a possibility that the Graham family arrived in Indiana
between 1815 and 1819. Reuben, born 1808 in N.C., Nelson, born
1810 in N.C., Burrill Jr, born 1813 in N.C. and John, born 1815
in N.C.
Burrill is found in the 1820 Indiana census, page 130, Orange
County. He is listed as GREYHAM, Burnell. The census reads
males: 410010 and females as: 21010, occupation as 0300. He can
also be found in the Indiana 1820 Enumeration of Males of Orange
County, Indiana. This enumeration comes from the 1816 Indiana
Constitution requiring an accounting of eligible males throughout
the state for purposes of determining the number of legislative
members. In this enumeration he is found as GREYHAM, Burrell.
Burrill is still found in Orange County, Indiana in the 1830
census. He is found on page 40, as GRAHM, Burrell. The census
reads males: 11022001 and females 1110001. This can explain why
Lewis, the son, is show as being born in Indiana, when his
brothers were born in North Carolina.
While in Orange County, Indiana, he can be found in a Will. He
is listed for Lewis THOMAS, 4 Feb. 1824, 13 April 1926, beloved
wife (name not given); children Ruth, Tilden, Lewis, Joseph, and
Stephen; Charles Bouchman, John Bouchman, Burrell Graham, Eli
Morris, James Atkinson, William Trueblood, Daniel Lambdin, Exec:
Son Tilden, friend Shadrach, not witness. (Could this be the
reason that someone came up with the surname Thomas for Rebecca,
unknown at the moment.)?
In the 1840 Illinois, Clark County census Burrill can be found
listed as Basel Graham, page 81, and line 22. The census reads 1
male 15/20, 2 males 20/30, 2 males 30/40, 1 male 70/80, while
the females read 1female 10/15, 2 females 20/30 and 1 female
40/50.
This puts Graham family arriving in Illinois in the 1830's.
Burrill's son Nelson married Zilphen Boswell in Orange County on
17 August 1831. Nelson's daughter Milla was born in 1835 in
Indiana (per the 1850 census) and Burrill bought land in 1836, so
now the travel period has been narrowed down to 1835 to July
25th, 1836.
Burrill bought land in Melrose Township, Clark County, Illinois,
two land sections: Section 29, Town 9N, Range 12W, W1/2-NW1/2
Lot, 80 acres, and Section 30, Town 9N, Range 12 W, E1/2-SW1/2
lot, 80 acres. This property was bought on July 25th, 1836, for
a cost of $1.25 p/acre.

There is a L. Graham from Clark County, in Information about
individuals prior to 1850, in Ft. Wayne, Indiana. It states: The
individual was a commissioned 1st Lt., of the 36th Regiment, 25 Jan.
1843, Executive Record 1843-1847, volume 4, page 6. Could this be
why Lewis didn't have to pay for his land?
I believe that Agnes Graham who married George W. Bryant on 29
September 1840 in Clark County; Illinois is Burrill's daughter.
She was listed as being born in Indiana in the 1860 Illinois,
Clark County census; Melrose Township, page 55, line 423/370,
with her husband George W. Bryant. He is listed as age 42, born
in Kentucky and she is listed as age 36. With them are their
children Burrill age 16, born in Illinois, and Eliza age 12, born
in Illinois. Her son would have been named after her father
Burrill. Also in the 1850 census the family is listed in Melrose
Township with the other Grahams'.
The other possible daughters could be Rebecca Graham to Joseph
Cohoon on 3 April 1845 and Judith Graham to Milton Gill on 12
October 1843 both in Clark County, Illinois.
Burrill Sr, is found in the 1850 Mortality Schedule, V.1-3, P.29,
Clark County, Illinois, District #48, and Enumerated by James Martin,
P.118. as Burrill Graham, age 76, married, b. N.C., was a farmer and
died of Sudan in August.

New information as of April 2001
The following information on the Graham Family was sent to me by
George Thomas, 9936 Huntwyck Dr., Raleigh, N.C. 27603. George
researched the North Carolina Archives for this information. Without
his help I never would have been able to make it this far, and for
that, I owe him my gratitude. You will notice I have submitted his
comments to me, pertaining to the information. I find them very
informative and thought it gave a great presentation of the material.
In the research of Burrill Graham, the only information that has been
found that hasn't been previously documented is now listed below.
George Graham #1 appears in census records up and through 1830 at
which time he was enumerated as 70-80 years and living in Richmond
County NC. Looking at the 1840 census, there is no longer a George
whose age tracks to be 80-90 years. So, George Sr. died after 1830
and before 1840. In support of this idea, we know that George Graham
Sr. deeded land to his son John and "youngest son Peter" in 1831.
From other transaction made by George Sr., we know that he had
brothers or relatives of equal generation named William and John. In
1830 the elder George Graham Sr. was listed beside what appears to be
his son named John. In that year, there is only one other male
living in the house of George Graham Sr. This was likely his youngest
son Peter. Of particular interest, in 1830, a John Graham of same
age was enumerated on the same page as George Graham Sr. This John
Graham is listed beside what appears to be a son George, named in
honor of his brother.
In 1796, George Sr. deeded land to what appears to be his namesake
son known at that time as George Jr. In the 1830 census, this George
Jr, was listed on a separate page from his father. George Jr. lived
on past the 1830, leaving a will in 1856. This George also had a son
named George.
Reviewing the record of George Graham Sr., how and where does our
Burrill fit into this family? We know from the 1830 census that
George Graham Sr. was born 1750-1760. From deeds, we know that
George Graham lived near the Thomas's in southern Richmond County
near the Quaker community known as "Piney Grove." Burrill is listed
next to Lewis Thomas [jr.] in a Richmond County NC roster of War of
1812 soldiers. By 1820, he has moved to Orange County IN with the
same Thomas family. As appears in the Orange County IN will of Lewis
Thomas, we know that Burrill married his daughter Rebeckah. Indiana
census records indicate Burrill Graham was born ca. 1760-1770.
Looking at the early North Carolina Secretary of State Land Grants
issued to George Graham [Sr.], we find that several of the 1790's
documents name "Burrell Graham" as chain carrier. Being a friend,
neighbor, or member of the family, the chain carrier assisted the
surveyor and served as witness to insure a proper survey. Notice
that George Graham [Jr.] was also listed along side of Burrill as
chain carrier in these grants. From the census recorded ages for
Burrill and George Graham Sr., it is possible that Burrill is the
oldest son or younger brother of George Graham Sr. We believe him
to be an older son of George Graham.
There are more deeds for Richmond County that pertain to this family.
The records below were put together in support of the belief that
George Graham Sr. is the father of Burrill Graham. All comments,

two George Graham Sr., by the Sr. George Graham (unable to decipher

if this may be the George Graham who died in 1856. He also states
there was a George who appears to be the son of John above who was
also in Richmond early, he also has pointed out, was the George who

Sr.!!! We know by this deed that in 1831, he had a" youngest son"
named Peter. Note that the George Graham who wrote a will in 1856
also had a son named Peter? If George Graham, father of Burrell,
was 70-80 in 1830, he would be 96-106 at the time of writing of the
will. ...Possible, but not likely. The will was likely for George
Jr. After his father died in the 1830's, George Jr. became Sr. It
appears George Jr. had a son named Peter in honor of his brother's
name? But still at issue,...was the 1831 deed of George Sr. to
youngest son Peter,...was this the old George or his son George?)

In the name of God Amen I George Graham of the state of North
Carolina and county of Richmond do make and publish this my last will
and testament in manner and form following.
(Viz.) and first I direct that my body be decently buried and that my
funeral be conducted in the manner corresponding to my Estate and
situation in life and that the funeral expenses together with all my
just debts be paid by my Executor herein after named out of the first
monies due to me which may be collected after my death.
I give and bequeath unto my beloved wife Sally my negro boys Moses
and Dennis, my negro girls Eliza and India, also the use of all my
land my stock of any kind farming utensils my buggy, waggon and cart
all my household and kitchen furniture, also four hundred dollars in
notes and money. The above named property to be hers during her
widowhood only, except the notes and money which are absolutely her
________. To my son Peter Graham, I give and bequeath ten dollars,
with what he has already received. To my son Calvin Graham, I give
and bequeath my negro girl Julia after the death of his mother. To
my son William Graham, I give and bequeath my negro boy Andrew. To
my son George H. Graham, I give and bequeath my negro boy Charles.
To my daughter Miranda Graham, I give and bequeath my two negros,
Jesse and Milly to herself and the heirs of her _____.
To my son James Graham, I give and bequeath my negros Moses and John,
said John to be his where he become of lawful age and Moses to be his
at the death of his mother also my upper tract of land commencing at
a stake in James Grahams line near a large pine and runs to Bridge
Creek at or near second branch a line the road and over the creek to
Robert Harly's line continuing about three hundred acres to be his at
the death of his mother. To my son Henry Graham, I give and bequeath
my negros Dennis and Eliza to be his at the death of his mother, also
my lower tract of land including the balance of my land to be his at
the death of his mother. To my grand daughter Sarah Graham, James
Grahams daughter. I give and bequeath my negro boy Nelson. I devise
and direct that at the death of my beloved wife Sally that all the
property there on hand including stock, farming utensils, household
and kitchen furniture be sold at public sale and the proceeds be
equally divided between all my children.
And lastly I do hereby constitute and appoint my truly friend Alex C
McKinnon, my lawful Executor to all intent will purposes to execute
this my last will and testament according to the true intent and
meaning the same and every part and clauses.
Thereof hereby according and declaring utterly void all other
wills and testaments by me heretofore made.

the State of Illinois.
Your petitioners Mary Shade late Mary Graham and widow of John Graham
deceased and Elizabeth Graham daughter of said John Graham decd.
That on or about the 11th day of January AD 1861 said John Graham
departed this life intestate at the said County of Crawford and dying
was seized of the following described real estate to with, West ½,
West ½ of lot number two in town (5) five, and South West gn (?),
South West gn (?) Section twenty five (25) and the North West gn (?)
S.E. gn (?) of section twenty four (24) in Town Six, and all in Range
fourteen (14) West the Crawford County, Illinois. That said John
Graham left surviving him your petitioner Mary Shade his widow and
George Graham, Dun Graham, Elizabeth Graham, Judith Graham, William
Graham, Hannah Graham and Matilda Jane Graham his children and only
heirs as low. That on or about the 20th day of January AD 1864 the
said Dun Graham departed this life intestate and unmarried leaving
him surviving you petitioner Mary Shade his mother and George Graham,
Elizabeth Graham, Judith Graham, William Graham, Hannah Graham and
Matilda Graham his brother and sisters and his as low. That said
George Graham departed this life intestate on or about the 18th day
of March AD 1865 leaving Sarah Graham his widow and Joshua E. Graham
his only child and heir as low. That by reason of the peruses (?)
your petitioner Mary Shade is entitled as widow of said John Graham
deceased to a dower state of one third part of said lands during her
eternal life and to two equal parts with parts thereof as heir of
said Dun Graham deceased, that said Elizabeth Graham, Judith Graham,
William Graham, Hannah Graham and Matilda Jane Graham as children's
and heirs of said John Graham deceased are each served of one seventh
part of said lands subject to the dower estate thereon of their said
mother, and to one forty ninth part thereof as heirs of the said Dun
Graham deceased. That said Joanca E. Graham is subject as a heir of
said George Graham deceased of one seventh and one forty ninth part
of said lands subject to said dower state.
And your petitioner show unto your Honor that ever since the death of
the said John Graham, said lands have been held in common and
undivided and one still so held.
Your petitioner pray that said Sarah Graham widow and Joanca E.
Graham child of said George Graham deceased, and said Judith Graham,
William Graham, Hannah Graham and Matilda Jane Graham may be made
parties defendant to this petition and that a guardian at later may
be appointed to defend said Joanca E. Graham, Judith, William, Hannah
and Matilda Jane Graham who are in parts.
And your petitioners pray that on a find hearing of this petition the
court will order and adjudge that division and partition of said
lands shall be made according to the respected rights and interests
of the parties as (?) wherefore stated and such forth of the same can
be done consistently within the interests of said estate and in case
the same common be so partitioned then that the same may be sold
under the judgement of the court. That the value of said dower
estate may be offered and paid and the residue of the proceeds of
such sale shall be distributed among the parties according to their
respective rights and interests and that your petitioner may have
such other and further relief in the (?) both of a general (?),

Reuben Graham land sale in Crawford County:
From Land Sales, Book E, page 292, 1843, located in Crawford County,
State of Illinois; This indenture made this twenty seventh day of
November in the year of our Lord one thousand eight hundred and forty
three between Reuben Graham and wife Sarah Anne of the County of
Clark and State of Illinois of the first part, and Burrel Graham of
the county of Clark and State of Illinois of the second part (?).
That the said party of the first part, for and in consideration of
the sum of Sixty Dollars to them in hand paid by the said party of
the Second Part the receipt whereof is hereby acknowledged, hath
granted, bargained, sold aligned, conveyed and confirmed, and by
these presents do grant, bargain, sell alien, convey and confirm,
unto the said party of the second part his heirs and apigns forever
the following described real estate, situated, lying and being in the
county of Clark and State of Illinois and known and designated as
follows to wit: it being a part of the South East quarter of the
Northeast quarter of section thirty one in township nine north of
Range twelve west commencing at he North west corner of the above
described forty acres and from thence South forty poles thence east
sixteen poles thence North forty poles thence Sixteen poles west to
the Place of Beginning. So as to contain four acres of ground.
Together with all the estate right title and interest both at law and
in equity of the said party of the first part of in and to the same
at law as in equity with privileges and appointenances thereinto
belonging or in anywide appertaining. To have and to hold the
aforegranted premises with the appointenances to the only proper use
benefit and behoof of the said party of the second part his being
apigns forever and the said party of the first part for themselves,
their heirs executives and administrators and apigns that we are the
true lawfully owner of the aforegranted premises. And have good
night full power and authority to sell and convey the same in the
manner aforesaid, and that said premises are now free clear and
discharged and unencumbered of and from all former and other grants
titles (?) charges and heirs of what nature and kind serve, and that
said party of the second part his heirs and apigns shall at all times
hereafter peaceably and quietly have hold occupy and enjoy said
premises and every part thereof with the appointenances without any
suit, molestation or emotion of any person lawfully claiming or to
claim the same, and further that the said party of the first part
their heirs executors and administrators will warrant and forever
defend the aforegranted premises with the appointenances and every
part thereof unto the said party of the second part his heirs and
apigns against all person lawfully claiming as to claim title to the

of conveyance and who acknowledged that the executed the same freely
and voluntarily for the uses and purposes therein expected. In
interest whereof & laws hereunto set my hand and seal on the day and
year last above written and the said Sarah Anne wife of the said
Reuben Graham being examined by one separate said apart from the said
husband acknowledged she executed the same freely without the fear of
consequences of the said husband the date first above written.
