The will of Ruth E. Ackman,
who died June 1, was filed for probate today in Randolph circuit court.
It was executed May 29 with Rowena Diggs and Raymond R. Tanner as witnesses.
Provisions of the will call for: a diamond ring to Patty Capron, a
three-stone ring, two diamonds and one emerald to Mary Capron, a diamond ring
to Ruth Ackman, $1,000 in cash and all articles of
furniture in the deceased's room to William A. Ackman,
$1,000 to Mary Capron. The executor was authorized to sell and convert
the residue of the estate into cash, the residue going to the mother, Grace
Lula Weaver of Colorado Springs, Col.
Lulu Lenkensdofer was nominated as executrix.

Chester A. Arthur is Named
Executor of Asa Addington
Will.
Chester A. Arthur, of Franklin township,
yesterday in Randolph circuit court was appointed executor of the will of Asa R. Addington, who died
February 2. Bond was set at $2,000.
The will, which was produced leaves the widow,
Flora, all household goods and furniture subject only to the right of a son and
daughter to select quilts, dishes and silverware which belonged to Mr. Addington's mother.
Due to the fact that money inheritated by a
first wife, Pearl, $800 from her father and $200 from the Emerson Addington estate, was turned over to the deceased and used
by him to purchase and improve real estate, the will provides that the executor
pay $500 each to a son, Perry O., and a daughter, Kathleen Addington
Patterson, and the wife, Flora. Residue of the estate will go to the
children.
The will was executed October 24, 1940, witnessed by A. L. and John E.
Bales.

Filed For Probate.
Winchester, Ind. - The will of Chas. C. Adelsperger
was filed Monday with the Clerk of the Randolph Circuit Court. Provision
is made for just debts and funeral expenses.
The entire estate is left to the wife, Christina Adelsperger,
for her life time. After her death the estate is to go to the James
Whitcomb Riley Memorial Association of Indianapolis.
Wenner E. Adelsperger
was named executor of the will which was written July 29, 1935 and witnessed by
Walter E. Vernon and Ernest E. Turner.

Alexander Will is Probated in Court.
The will of Barbara Ellen Alexander has been probated in Randolph
circuit court. The executor, Beneville K.
Kelley, is to erect a monument on the Alexander lot in Fountain Park cemetery
and also head stones at the graves of the deceased's parents in Old Dunkirk
cemetery in White River township.
To Volnie Stilts is left real estate, part of
lot 7 in the west front of Winchester, and lot 70 in Beech Grove addition to
Winchester is left to Bertha Monroe for her life-time and then to her children.
The remainder of the estate is to be converted into cash by the executor
and after payment of all debts, the fund is to be
divided equally between Nephews, Bert "Izzie"
Green and William Ernest Pursley, and the nieces,
Ellen Bullens and Pansey
Peters.
The will was executed December 23, 1938, and witnessed by Alice W.
Kelley, Beneville K. Kelley and Raymond Tanner.

The will of Isabell W. Arnold, who died
February 17, was probated in Randolph circuit court yesterday. The
document, executed April 4, 1938, was witnessed by Rev. D. R. Lusk and Mrs.
Nellie V. Lusk.
The will directs the executor to sell real and personal property in Ward
township, including 47.64 acres of land, and to distributed the proceeds as
follows: $500 to the husband, Alva M.; one-third to a daughter, Mary A. Harshmann, who is nominated as executrix; one-third to a
son, Victor M. Mock; and one-sixth each to two grandchildren, Pearl Clapp Foltz
and Earl Clapp, children of Minnie Clapp, a deceased daughter of Mrs. Arnold

Thomas G. Austin is Administrator Mother's Estate.
Thomas Gail Austin, of Muncie route 4, yesterday in Randolph Circuit
court was appointed administrator of the estate of his mother, Addie Austin,
who died October 31 of injuries suffered in an automobile accident.
Bond of $2,000 was furnished with Francis Ralph Austin of Fountain City,
Mabel Cox, Ruth Austin, Sylvia Austin and William K. Moore of Winchester as
sureties.
Lem Austin, husband of Addie Austin, was
instantly killed in the accident, which occurred east of Winchester on the
Greenville pike.

Will Probated in Circuit Court; Executor Named.
Frank O. Barker, of Ridgeville, was appointed administrator with the
will annexed of the estate of Marietta Barker, who died January 6. Bond
of $800 was furnished with the Fidelity and Casualty company
of New York as surety.
The estate is left equally to four children, Louetta
Morgan, Frank O., George W., and Benjamin Barker. The will was executed
October 10, 1916 with Edmon Burton and Walter G.
Parry as witnesses.

Sarah E. Barker Will Probated in Court.
The will of Sarah E. Barker, who died November 4, was probated in Randolph
circuit court Friday. To the son, Warda B. and
his wife Minnie, is bequeathed lot 186, block 10 in John Mumma's
addition to Winchester, residue going to the son.
The late Winchester attorney, George H. Ward, was nominated as executor
of the will, which was executed October 15, 1932 with Gertrude M. Monks and Mr.
Ward as witnesses.

The will of Thaddeus S. Barr, who died recently, was
filed for probate today in Randolph circuit court. A son, Glen, was
nominated as executor of the document which was executed August 31, 1945 at
Union City with Russell E. Wise and Irene Lawson as witnesses.
The will provides that the wife, Pearl L., be sole beneficiary, at her death
the estate to go to the son. Provisions are made for two granddaughters,
Mary Elizabeth Barr Klaus and Leatrice Barr,
including tracts of real estate in Randolph county and Essex county in Ontario,
Canada.

City of Winchester accepts bequests from Beeson Will.
Winchester, Ind. --- The City of Winchester at the Wednesday night
Council meeting accepted the bequests to the City under the terms of the will
of the late Charles H. Beeson.
The estate left to the City includes a business room on North Meridan street, now occupied by the express office, a
residence on North Meridan street, a large farm at
the south edge of the City, near Fountain Park Cemetery, and another farm
located three miles south and two miles west of the City; also all money,
bonds, stocks or other evidence of indebtedness which is part of the residuary
estate.
According to the terms of the will any or all of the property with the
exception of the farm on the south edge of the City, may be sold and the
proceeds be used to establish for and maintaining a park on the farm. One
of the first developments on the park site will , in
all probability, be a municipal golf course.

Last Will Of The Late Laura C. Bemis Has Been Filed
For Probate.
Winchester, Ind. - The will of Laura C. Bemis has been filed with the
Clerk of the Randolph Circuit Court for probate.
Following the payment of just debts and funeral expenses and the
erection of a monument on the Bemis lot in Lisbon Cemetery, not to exceed $400,
the estate is to go to four children Hugo C. Bemis, Hazel M. Parsell, Etta L. Hummel, and Chester E. Bemis.
Lewis Parsell and Hugo C. Bemis are executors
of the will which was written July 5, 1929 and witnessed by Lola H. Frazier and
Clyde N. Chattin.

Lynn Attorney Named Executor of Will of William G. Bennett.
Samuel C. Westlake, Lynn attorney, yesterday in Randolph circuit court
was appointed executor of the will of William G. Bennett, who died at Lynn
March 10. Bond of $4,000 was furnished with the Ohio Casualty Insurance
company as surety. The will, which was probated provides:
To the widow, Julietta, all
household goods; balance of personal property, one-third to the widow,
two-thirds to a daughter, Artellisa Ballanger.
To the widow, lot 7 in Samuel Platt's addition to Lynn; at her death to
a grandson, Junior Ballanger. Balance of the
real estate, one-third to the widow and two-thirds to the daughter.
The will was executed March 14, 1939 with Robert J. Brandon and Gordon
Hunt as witnesses.

The will of Josephine Bickel, who died May 27, was filed for probate today in
Randolph circuit court.
Two granddaughters, Margaret Josephine and Helen Frances Bickel, were
bequeathed $500 each, the residue of the estate to a son, John H. Bickel, who
was nominated as executor.
The will was executed in September of 1945 with Irene Lawson and Charles W. Tritt as witnesses.

Suit Contesting Farmer's Will Being Heard - Jonathan Bowman Will Subject of
Jury Trial in Richmond Court.
Richmond, Ind., Oct. 14 --- A Wayne county jury is hearing
evidence in a will contest action which is being tried here on a change of
venue from Randolph county.
The jury is composed of Ralph Craig, Leon Allison, Walter Simpson,
Hansel Dennis, Charles Wise, Ralph Walker, Charles Burradaile,
Vier J. Radford, Wallace French, W. R. Thomas, George
Stempel, and Guy Anderson.
Witnesses in the case during the Monday afternoon session were John W.
Bickel, Randolph county banker, and Solomon Harter, one of the plaintiffs.
The action is brought by Solomon Harter, George Harter, Charles Harter,
Ralph Harter, and Blanche Mullen against Oro Robinson, as executor of the will
of Jonathan Bowman, wealthy and eccentric Randolph county farmer, who died in
1935, and is to break the will which was probated in December 1935.
Bowman died leaving as his sole heir, his wife, Ella, who was at that
time an inmate of the Richmond State hospital.
In 1936, according to the complaint, the widow died, her death occurring
before the final report of the executor of her husband's will had been filed.
In the meantime her guardian, Max Diggs, had asked the court to
determine if she [?] should inherit under the law or by the terms of the will.
The plaintiffs are all her heirs who seek to break it on grounds the
decedent was of unsound mind at the time he drew it and that as a result Mrs.
Bowman should have had more interest in her husband's estate than the life
estate which the will gave her.
Bickel was an unwilling witness Monday, stating while on the stand that
he "had friends on both sides."
He declared that in his opinion Bowman was of unsound mind and related
conversations he had with him from 1929 on to near the time of his death.
The will was drawn in 1928.
It is estimated that $15,000 is involved in the action.
Richmond, Ind., Oct. 16 --- Judge G. H. Hoelscher
late Tuesday dismissed a jury which had been hearing evidence in the action
brought to break the will of Jonathan Bowman, wealthy Randolph county farmer,
and entered judgment which in effect held that Bowman was of sound mind when he
drew the will and that the will was a valid instrument.
The ruling came after the attorneys for the plaintiffs, Solomon F.,
George, Charles and Ralph Harter and Blanche Mullen, rested their case and
asked for a directed verdict, a move which was countered by a motion of
defendants for a directed verdict.
The defendants in the action were Ora
Robinson, as executor of the will, Della Robinson and Ella Cox.
The case was completed after a 12-man jury had heard evidence for a day
and a half.
Following dismissal of the jury Judge Hoelscher
was told that Mr. Bowman made his home with his brother, Harvey, and had grown
fond of his brother's children, two boys and two girls.
In his will he gave his wife a life interest in the estate and left most
of his property to his brother's children.
Mrs. Bowman, an inmate of the Richmond State hospital, died in 1936, a
year after Mr. Bowman's death, but before the executor had filed a final
report. Her guardian, before her death, had sought a court order to
determine if she should take under the terms of the will or under the law of
inheritance.
Mrs. Bowman's heirs-in-law, who were the plaintiffs in the action disposed of Tuesday, sought to break the will on
grounds that Bowman was of unsound mind at the time he drew it in 1928 when he
was 84 years old.
In his ruling, which he said was the first of its kind he had made in 17
years on the bench, Judge Hoelscher
held that Bowman, known as eccentric all his life apparently knew the extent of
his estate and the persons he wished to benefit in its distribution.
The case was held here on a change of venue from Randolph county.

Smith Executor Bridgman Will; Bond is $22,000. Hanover
College, Marion Home Beneficiaries of Woman's Estate.
Harry A. Smith, of Winchester, yesterday in Randolph circuit court was
appointed executor of the will of Alice F. Bridgman, who died in Winchester
February 12. Bone of $22,000 was furnished with the United States Fidelity
and Guaranty company as surety.
The will of Mrs. Bridgman, widow of the former owner of the Winchester
Journal-Herald and after his death owner in her own right, directs the executor
to erect a monument at the grave of Emma V. Farley in the Franklin cemetery,
cost not to exceed $200.
Specific bequests are:
to a sister, Edna I Tinsley, $10,000, furniture
and bedding, with the request that she dispose of any article of furniture or
bedding she does not wish to keep for her own use.
to a niece, Ruth Margaret Tinsley, $2,500.
to Edna Tinsley, all flat and other silver,
with the proviso that inasmuch as she is well supplied with silverware it was
Mrs. Bridgman's desire that it be distributed to her friends.
to Edna Tinsley, table linens.
To the trustees of Hanover college, $2,500 to be used in establishing
and maintaining the "I. M. Bridgman Library of Indiana History,"
directing that the trustees "use this sum in such manner they deem proper
in the promotion of the study of Indiana history."
To Emily Flinn home of Marion, established and
maintained by the Disciples of Christ, $2,500 to establish and maintain
"The Alice F. Bridgman Room."
All books are bequeathed to the Winchester library, but in case any of
the books are not needed the librarian is directed to make disposition to
deserving boys and girls who desire them.
Residue of the estate is willed to the American Sunday School Union of
Pennsylvania (Philadelphia), the trustees or directors to invest and use the
income in carrying on work of the institution in southern Indiana, or if
advisable to use the principal.
The executor is directed to convert all property not disposed of into
cash to satisfy specific bequests. In case the estate is not sufficient
to satisfy all bequests, all beneficiaries are to be paid in full with the
exception of Hanover college and the Flinn home, which are each to take half of the residue.
The will was executed June 23, 1938 with William L. Cheney and John D.
Wilson as witnesses.

Delphina Britt Will is Probated.
Ethel Britt Van Pelt, 532 East North street,
Winchester, yesterday in Randolph circuit court was appointed executrix of the
will of Delphina Britt, who died February 19.
Bond of $1,000 was furnished with the American Bonding company of Baltimore as
surety.
All real and personal property was bequeathed to a daughter, Hazel M.
Britt. Other bequests were $200 each to three children, Ethel, Russell
and Dewey Britt and a watch, formerly property of a deceased son, Everett, to
Russell Britt.
The will was executed January 8, 1931 with A. L. Bales and Mary Lavin as
witnesses.

died recently, was filed for probate in Randolph circuit court today. It
was written May 13, 1946 with Russell E. Wise and William H. Tibbets as witnesses.
The widow, S. Anna E. Burk, was left the entire estate after two cash bequests
have been made. A niece, Grace Snodgrass, was willed $200; another niece,
Stella Cox, $500.

The will of Clyde W. Burres, who died recently
at Farmland, has been probated in Randolph circuit court. The entire
estate is left to the wife, Lettie, she being
nominated as executrix of the document which was executed November 27, 1934,
witnessed by C. W. Owens and Byron Nixon.

The will of Boyden O. Burrows, who died November 6 at Losantville,
was filed for probate today in Randolph circuit court, a son, Sharron, being
nominated as executor.
Executed November 4 of this year, witnessed by D. S. Wiggins and Paul Brown,
the will provides for the following bequests:
To the wife, Bertha F., a three-acre strip of land immediately north of Losantville.
To the son, Sharron, one acre in the southwest corner of the
farm adjoining Losantville, known as the poultry
house lot.
To three sons, Sharron, Eugene and Ivan, a 203-acre farm north of Losantville, subject to the life estate of the widow.
To a son, Norrice, 60-acre farm three-fourths of a
mile west of Modoc, subject to the widow's life estate.
To the widow, all personal property.

was executed February 17, 1940, were Willard V. Burton and Theodore Bragg.

Millie Campbell Will is Probated in Court Friday.
The will of Millie Campbell, of Winchester route 4, who died December
23, was probated in Randolph circuit court yesterday, the husband, John
Campbell, being made sole beneficiary.
The will which was executed October 9, 1939, with Waldo Hickman, of
Winchester route 4, and Kenneth C. Hinshaw, of Union
City, as witnessess, provides for the following
bequests in the event of the husband's prior death:
Three-sixteenths each to Campbell Richardson of Fergus, Redmond
Richardson of Stratford and John Richarsdson of Ungnon, all in Ontario, Canada; two-sixteenths each to Dora
Stack of Washington, N. C., and Corie Anthony of
Greensburg, N. C.; and one-sixteenth each to Winifred Morgan of Converse, Emmet
Rhoades of Marion and Mr. and Mrs. Harold Hiatt of Winchester route 4.
Mitchell A. Hinshaw, of Winchester route 3,
was nominated as executor.

and Other Relatives.
An authenticated copy of the will of Mrs. Martha Clark, 229 E. Main St.,
this city, has been filed for probate in the Randolph Circuit Court, at
Winchester. After the payment of debts and expenses, the 182 acre farm
located northwest of Union City is to be sold and the proceeds from 77 acres
are to go to a sister, Eliza J. Taylor of Sidney, Ohio, and the proceeds from
the remaining 105 acres to go equally to a niece, Edna L. DuPere
of Lima, Ohio, and two nephews, Walter D. Anderson and Charles D. W. Anderson
of Sidney, Ohio. The one-half interest in a house and lot in Sidney, Ohio
is given to Eliza J. Taylor, Edna L. DuPere, Walter D. Anderson, and Charles D. W. Anderson, in
equal shares. The house at 229 Main street in Union City, Ohio is to be
sold and the proceeds divided equally among Eliza J.(should
read Edna L.) DuPere and Walter D. Anderson, Charles
D. W. Anderson, and George Murray Anderson, subject to bequest of $100 to Roy
W. Anderson, $300 to Olin Daggett, tenant on the Clark farm and $400 permanent
maintenance fund for family graves to Granland Cemetery
at Sidney, Ohio. Other personal bequests include the following:
piano to Edna L. DuPere; tapestry parlor suite to
Walter D. Anderson; radio and diamond ring to Eliza J. Taylor; wearing apparel
to Eliza J. Taylor and Edna L. DuPere.
The will is dated Dec. 12, 1935 and is witnessed by Purl I. Turner and
Edith M. Cline. Walter D. Anderson, A. E. Anderson Taylor, and Charles D.
W. Anderson are named executors.

The will of Benjamin F. Clevenger, who died recently at Modoc, was probated
in Randolph circuit court yesterday.
All real and personal property was bequeathed to the widow, India E.
Clevenger, during her life. Then it is to be divided equally among the
following four children: Mary Wood, Iris Sharp, Marion Clevenger and Acill Stock.
The will was executed September 25, 1933 with C. V. Johnson and H. R.
Lester as witnesses.

A second Will of the late Mary E. Coddingham
is filed for probate.
Winchester, Ind. --- The second will of Mary E. Coddingham
was filed with the clerk of the Randolph Circuit Court, Saturday. This
will leaves the entire estate to the husband, George
W. Coddington for his life time after which the real
estate is to go to a daughter, Thelma Irene Coddington
Farrabbe for her life time. After her death the
real estate is to go to her heirs.
The personal property at the death of George Coddingham
is to be divided between the daughter and her two sons.
This will was written Feb. 22, 1931 and witnessed by A. B. Roosa and Stella Roosa.
A Mary E. Coddingham will
was filed with the clerk Thursday Oct 18, which was written Feb. 23,
1928. This will left the entire estate to the husband for his lifetime
after which the real estate is to go to Irvin O. Allen, trustee, to be held in
trust for the grandson, Chester M. Farrabee, until he
is 30 years old. The will also states that if he should died before he
reaches that age the real estate is then to go to his living children in equal
shares. If he has no children the real estate is to go to Inez M. Allen.

Michael Cotter, of Union City, has been appointed executor of the will
of his father, Patrick Cotter, who died December 27. Frank Stack is
surety on the $100 bond.
The will provides that a 140 acre farm in Greenfork
township be left to the son, Michael, provided that
within five years he pay five brothers and sisters $1,000 each.
The will was executed October 3, 1925, witnessed by F. S. Caldwell and
Frank Stack. A codicil was attached August 24, 1931.

The last will and testament of Emily Matilda Dick, who
died at her home in Parker November 11, was filed for probate in Randolph
circuit court today. It was executed March 13, 1946 with Clyde B.
Williams and Meeks Cockerill, as witnesses.
The document bequeathed a gold watch and chain to a niece, Marion Baxley, and a
sewed quilt to another niece, Alma Ayers. All household furniture that he
wants and needs is left to a brother, Jacob Luther Jones.
Residue of the estate is to be sold at a public or private sale and the
proceeds to be distributed as follows: Preacher's Aid Society of the
Northern Indiana Conference of Methodist Churches, $200; Jacob Luther Jones, a
brother, $500; Dorothy Taylor, Alma Ayers, Mary Elizabeth Bird and Marion
Baxley, nieces, each $200.
After the above bequests are made the balance of the proceeds is to be made as
follows: one-fourth equally to Earl and Harold Jones, children of a
deceased brother, William Wilson Jones; and one-fourth equally to Marion Baxley
and Eurdith Jones, children of a deceased brother, Gatis Jones.

Ernest W. Dudley of Union City route 4 and Earl O. Dudley of Modoc route
2 yesterday in Randolph circuit court were appointed joint executors of the
will of Tyra S. Dudley, who died January 12.
Bond of $9,000 was furnished with the United States Fidelity and Guaranty company as surety.
The executors, by provisions of the will are directed to sell enough
property to pay expenses and debts and for a monument at the deceased's and his
wife's graves. Other provisions are: a piano to the son, Earl O.;
residue to the wife, Mary L. At the death of the wife - $1,200 each to
the following children: Carl L., Ernest W., Arthur W., Earl O., Kenneth
M., Gillie A. Gilpin, wife of Orange T. Gilpin, Millie M. Halstead, wife of
Lewis Halstead (another son, Clinton O., had been advanced this amount).
Remainder of the estate will go equally to all the children, including Clinton.
The will was executed February 25, 1926 with Ruth Blizzard and Raymond
R. Tanner as witnesses.

Provision is first made for payment of just

Winchester. The following bequests were made: the sum of $8,000 is to be
divided among P. E. Goodrich, James P. Goodrich, Edward S. Goodrich, John B.
Goodrich and William W. Goodrich, or their heirs; the sum of $8,000 is to be
divided between Edward M. Semans, and Eleanor Semans or their heirs; $8,000 to Shields S. Macy, Kate M.

Evans was admitted to probate today in Circuit Court after Judge L. A. Guthrie
and a jury in Delaware Circuit Court ruled that the document was admissable to probate in a suit filed by one of the heirs
to contest the will. After the payment of just debts and funeral expenses
a daughter, Daisy V. Sutton, is to receive 40.82 acres of land in Jackson
Township for the duration of her lifetime after which it is to become the
property of a son Walter Evans, who also inherits the residue of the property
both real and personal. The will was drawn October 19, 1933, and
witnessed by J. Fern Green and John D. Wilson. Walter Evans is named
executor.

bequeathed an old fashiond poster bed.

published death notice gave her name as Elizabeth D. Gill and her daughter was

Gray and Mary Burnworth. There were no
provisions for another daughter, Elma, who the deceased had not seen for a long
time and whose husband's name was unknown.

Union City, as sureties.
The will provides the following: Forty acres in
Jackson township are willed to the widow for life and at her death will be to
the son, Glenn G. Hindsley, under the following
terms; He shall pay to a daughter, Edith A. Strader
or heirs $1,500; to a daughter, Cecil M. Kemp or heirs $1,500; to Robert Frye,
whom Mr. Hindsley had reared from the age of 7 years,
$1,000.
All personal property, consisting of household
goods, live stock, crops on hand and all money are left to the widow. To the
daughter, Edith A. Strader is left forty acres; to
the daughter Cecil M. Kemp, forty acres; and to the son, forty acres, all

articles of personal adornment were left to the daughter, Mae Hommon. All the remainder of the personal property
and personal estate goes to a brother, Walter Scott of Eaton, Ind., as
trustee. Tne net profits from the trust fund
are to go to the daughter, Mae Hommon, for her
lifetime. After her death and payment of her funeral expenses the
remainder of the fund is to go to brothers, Walter Scott and Charles Scott, of
South Whitley, Ind. and a sister, Ella Ward of Union City.
The real estate is also left to the daughter for her lifetime. At
her death it is to go to the brothers and sister named above. Walter

The will of Alice C. Howell, of Modoc, who died March 21, 1939, was
probated in Randolph circuit court yesterday, the probate being held in abeyance
for more than a year due to the filing of objections on March 27, 1939.
Robert C. Oliver, Winchester attorney. following the
objections was appointed special and temporary administrator, and yesterday was
name administrator with the will annexed.
The will, executed August 5, 1928 with C. V. Johnson and Maxine Wright
as witnesses, provides for the following: to Mildred, daughter of a son,
Henry, and to Idris Saul, Emerson Harvey, and Royden Harvey, children of a deceased daughter, Bertha,
each $1; to Celia I. Medler, a daughter, who was
nominated as executrix of the will, lots 19 and 20 in Parker; to Dorwin Howell, a son and his wife, Mary E., joint title to
lot 78 in Modoc.
The executrix is directed to sell lot 6 in Modoc and household goods,
proceeds to pay balance due on mortage on lot 78 and
to pay the funeral exenses of Bertha Harvey.
Balance, if any, is to be divided equally between Dorwin
Howell and Celia Medler.

Winchester, Ind. - The will of the Dr. Albert M. Huddleston, who was
killed in a Florida auto accident was admitted for
probate in Randolph Circuit Court yesterday. The will provides that all
just debts and funeral expenses be paid and that a suitable monument be placed
at his grave and the grave of his wife. He wills to the trustees of
Dublin cemetery $300 to be held and loaned and the income therefrom
to be used for the upkeep of the cemetery.
The balance of his property, both real and
personnal to be divided equally between his daugher, Mrs. Ina P. Oler and
son, Eric T. Huddleston. The document was written May 27, 1931 and
witnessed by Louis King and Walter G. Perry. Eric Huddleston filed a
$20,000 bond as executor.

The will of David J. Hutchens, who died May 13, was probated in Randolph
cirucuit court yesterday. The document provides
that the executor reduce all property into cash and divide the proceeds equally
among seven children: Harry L., Bessie M. Stine, Gerturde
Denny, Chauncey S., Ralph M., Nettie J. Jones and Harold C. Hutchens.
Included in the estate is a farm of 88 3/4 acres.
The will was executed December 3, 1929, with Silas A. Canada and Ruth
Blizzard as witnesses. A son, Harry L., was nominated as executor.

Last Will of the late Samuel C. Hutton is filed for probate.
Winchester, Ind. --- The will of Samuel C. Hutton, of Union City, has
been filed for probate in Randolph Circuit Court. The will first provides
for the just payment of debts and funeral expenses. To the daughter,
Nettie White, and the sons, Alfred, Charles W., Robert T., Ray L., and the
grandson, Charles White, was left all of the estate to share and share alike
with the exception of the household goods and furniture which was left to the
daughter, Nettie White. Robert T. White and Nettie Hutton were named
executor and executrix of the will written in December, 1925, and witnessed by
L. L. Taylor and A. W. Shreeve. The executor
and executrix qualified with the clerk of the court today and gave bond in the
sum of $1,000.

last Thursday. He leaves all personal and real estate to his wife during
her natural lifetime; to his grandson, Marion Cox, he leaves $100; to his
daughter, Philena Swindle, twenty-four acres of land in
section 3, township 18, which is to be equally divided at her death between his
grandchildren, Magnolia, Myrtle, and Frank Thornburg, heirs of John H. and
Emily Thornburg. The remainder of his farm is left to his son I. G.
Johnson.

died July 20, was probated in Randolph circuit court yesterday. Alonzo J.
Kabel, a nephew, is named executor.
The will which was executed December 19, 1934 and witnessed by Roger Phistner and Merrill W. Nichols, includes the following
bequests:
To her nephew, Alonzo J. Kabel, she devises
the east half of the east half of inlot number 2 in
the south front of the city of Winchester. This is the brick room on the
south side of the public square in which the Bunsold
market is located. To her nephew, Phillip Kabel,
she devises the west half of the east half of inlot
number 2 in the south front of the city of Winchester. This is the brick
room on the south side of the public square in which the Winchester Auto Supply
is located. To her nephew, Floyd Edwards, she devises the farm in
Washington township.
To the Main street Church of Christ in
Winchester she wills $200.
The remainder of her estate, both real and personal, is to be converted
into cash, and this is to be divided into two equal shares, one of which is to
be divided among her brothers and sisters, and in case of their death among
their heirs, the other half to be divided among the brothers and sisters of her
deceased husband, Adam Kabel, and in case of their
death, among their heirs. Those given special bequests do not share in
this remainder.

acres of real estate is willed to her son, Auda Keever, the fee simple title to go to her daughter, Ina M. Keever, at the death of the life owner.

The last will and testament of George Ketron was admitted to probate in the Randolph Circuit
court Monday. The instrument was executed August 24, 1943, with Marie M.
Brandon and John D. Wilson as witnesses.
The will gives all property, real and personal, to
decedent's wife, Hulda, in the event he predeceases
her. In the event his said wife precedes him in death he gives all
personal property to his son, James, and all real estate to his son, James, for
the period of his natural lifetime. At his death the real estate to be
sold and proceeds divided among the children of the decedent, George Ketron, or the descendants.

A. L. Kitselman Will Probated - Estate in Excess of
Million Dollars Exclusive of Real Estate.
Muncie, Ind., Mar. 21. --- The will of Alva L. Kitselman,
whose death occurred March 4 at Loma Linda, Cal., was admitted to probate here
yesterday. He was head of the Indiana Steel and Wire Company and the Kitselman Company, both Muncie industries. The value
of the estate has not been disclosed. It is understood to be in excess of
a million dollars exclusive of real estate holdings.
Fred M. Crapo, vice-president and general manager of the Indiana Steel
and Wire Company, is nominated as executor.
Other provisions of the will include the naming of a board of trustees
to manage estates set out in the will. The trustees surviving in event of
the demise of either, are empowered to name
successors.
The will make a bequest of $50,000 to Josephine E. Kitselman,
of Hollywood, Cal. and Chicago. Mrs. Rose Dragoo
Bailey, nurse; Oscar Washington, colored, butler; Mrs. Pluma
Powell, colored housekeeper; Mrs. May Florence Armstrong, colored cook in the Kitselman home, are each bequeathed $1,000. in event they survived Mr. Kitselman.
Mrs. Carlock died two days after the death of Mr. Kitselman, and Washington, stricken ill a few days after
Mr. Kitselman's death, has not yet recovered.
The widow, Leslie Curtis Kitselman, widely
known novelist and magazine writer, is given all jewelry, pictures, household
furniture and fixtures, clothing, china, linen, silver, books, bric-a-brac,
ornaments, automobiles and automobile accessories, and all other personal
chattels. She also is given a life estate in the home, Hazelwood, built
on the twnty-six acre tract in University avenue, the fee simple of the home and grounds being given
to their three children, Alva L. Kitselman, Jr., Mrs.
Marjorie Kitselman Hanson, and Donald Curtis Kitselman, in equal shares.
The will directs that the residue be divided into twelve equal
shares. Four shares are to be held as a separate trust for the widow, she
to have the income for life. She has the right of directing by will the
principal of her share of the estate to her issue living at the time of her
death, or should she die without issue to the issue of the testator, or if the
widow die intestate her shares of the estate going to the trust for their three
children.
Two shares each are bequeathed the three children to be held in trust by
the trustees named, the income being paid them by the trustees. One share
each is bequeathed to the two grandchildren, Harry L. Kitselman
and Janet Kitselman Rose.

The will of Margaret J. Laskey, who died March
18, was filed for probate yesterday in Randolph ciruit
court. Debts are to be paid out of first money coming into the hands of
the executor, the Randolph County bank, of Winchester.
The home in Winchester is left to the adopted daughter, Eva J. Elliott,
for her lifetime. She is also to receive all household goods. The
Randolph County bank is named trustee in trust
of all money, notes, bonds and stocks, preferred or otherwise, to be used for
benefit of the adopted daughter during her lifetime.
All the remaining estate after her death is left to Grace Irene Elliott,
John T. Elliott and Robert Elliott, children of the adopted daughter
, in equal shares. The home is also to go to these children at the
death of their mother.
The will was executed March 5, 1929, and witnessed by James S. Engle and
Alice M. Engle.

The mother and son were nominated as joint executors of the will, but
Mrs. Lewis declined to serve and requested the appointment of her son.

The will of Margaret Lewis, deceased, has been
admitted for probate in the Randolph Circuit Court. The will was executed
July 18, 1941, with Mrs. Ethel Lowery, Don Lowery and Robert
C. Oliver as witnesses.
The testatrix directs the executor to sell all
personal property and real estate of which she was the owner at the time of her
death. From the fund derived from said sale she makes the following
bequests: to her son, Ernie Lewis, $200.00; to her son, John Lewis,
$200.00; to her daughter, Ella Baumgartner, $200.00; to her son, Robert Lewis,
$50.00; and to her daughter Lizzie Neff, $100.00.
The residue of said fund is to be divided by the executor
into six equal parts, and one of the six parts is to be given to each of her
five children. The sixth pare is to be divided equally between the
children of a deceased son, George.
The will names decedent's son, Ernie Lewis, as
executor of the will. Said executor has qualified and has filed his bond
in the sum of $7000.00 with the American Banking company of Baltimore, Md., as
surety thereon.

Last Will of the Late Mary M. Moffett Filed For Probate.
Winchester, Ind. - The will of the late Mary M. Moffett has been filed
for probate with the Clerk of the Randolph Circuit Court. Just debts are
to be paid. The home place on Pearl Street, Union City, is to remain the
home of the daughters, Cordella and Mary Moffett as
long as they desire. In case the property should be sold, however, each
of the above daughters is to receive the sum of $1,000 from the proceeds.
The balance is to be equally divided between daughters Ethel Ginns and Nina Tritt and sons Earl
and Reed Moffett.
Cordella Moffett is named executrix of the
will which was written June 29, 1927 and witnessed by Clara D. Richter and
Nettie B. Richter.

Charles H. Money is Appointed Executor of His Mother's Will.
Charles H. Money yesterday in Randolph circuit court was appointed
executor of the will of his mother, Amanda J. Money, who died February 8.
Bond of $2,000 was furnished with Mary E. Flory and Flora A. DeBolt as sureties.
The will provides that a grandson, Wilbur, be given a victrola, and a daughter, Flora DeBolt,
the home farm of 120 acres in Jackson township, subject to the following
conditions: that she pay to Charles Money and Mary Flory one-third of the
assessed valuation for taxation purposes of the real estate within one year
after death.
The document was executed October 31, 1931 with Pauline Porter and Clyde
N. Chattin as witnesses.
A codicil executed August 18, 1937, witnessed by Chattin
and Ruth Gettinger of Union City, provides for a
change in the real estate bequest as follows: that Flora DeBolt pay $4,000 each to Charles Money and Mary Flory
within one year and that she have the option of making the payments totaling
$8,000 or refusing to make the payments, upon refusal the real estate going
equally to the three children.
If she elects to pay the $8,000, the amount shall be a lien against the
real estate until it is paid. The farm is valued at $12,000 and the
deceased, who inherited it from her father, was desirous that it remain within
the family and not fall into "strange" hands.

Winchester, Ind. - The last will and testament of Jesse T. Moorman was
filed for probate Monday with the clerk of the Randolph Circuit Court.
Jame P. Goodrich of Winchester,
was named executor of the will which was written Dec. 29, 1936.
The net income from stocks and bonds owned by the deceased and one-half
interest in 160 acres of land in White River Township, and one-half interest in
lot in Union City, is to go to the daughter, Mrs. Merle C. Willard of Dobbs
Ferry, N. Y. for her lifetime, and then to his granddaughter, Marie Martha
Curtis. The above is to be held in trust by J. P. Goodrich. The
remainder of the estate is to go to the daughter Mrs. Willard.

Blanche M. Ebeling and Lillian J. Oliver, of
Union City route 4, yesterday in Randolph circuit court were named joint
executrices of the will of John W. Morton, who died April 11. Bond of
$15,000 was furnished with John H. Bickel and O. M. Aukerman,
of Union City, as sureties.
Two-thirds of the estate, according to provision of the will executed
March 2, 1936, is willed equally to the two daughters named as executrices, and
one-third equally to two grandsons, John W. and Guy Oscar Morton.
Witnesses to the will were Mary Birum and Ira Vernon.

Winchester, Ind. - The authenticated copy of the will of Mary E. Mote,
of Darke County, was filed with the Clerk of the
Randolph Circuit Court Wednesday for probate.
All personal property and 100 acres off of the west side of farm known as
the "Woodbury Farm" in Randolph County, Section 1, Township 17, Range
1, was left to the daughter, Hazel Wagner. The balance of the farm, 73
1/2 acres, is to be sold by the executrix within six months and the proceeds of
the sale, after deducting the expenses of sale, are to be divided equally
between the following persons: Henry Mote, Lettie
Oswall, Mary Smith and William Bleier.
Hazel Wagner was named executrix of the will which was written Nov. 16,
1934.

the late Benville E. Myers is filed for probate.
Winchester, Ind. --- The will of Benville E. Myers
has been filed for probate in the Randolph Circuit Court. It provides that
after all just debts and funeral expenses have been paid,
the entire estate will go to the widow Sarah E. Myers, for the rest of her
life. After her death, the estate reverts to the heirs, Walter and Herbert
Myers and Mrs. Zola Mable Clayton. Walter Myers and Mrs. Clayton are to be
given an amount of equal to the advance loan to Herbert Myers, as evidenced in
a note to his father, and the residue is to be divided equally among the heirs.
The son, Henry Walter Myers was named executor and the will was witnessed by J.
W. Gants and Fremont Pursley.

The will of Minnie Newlee, who died September 2, has
been probated in Randolph circuit court. Executed June 18, 1941 and
witnessed by C. W. Owens and Violet Wood, specific bequests are made for
various household items with the residue of real and personal property going to
a daughter and four grandchildren.
Arthur Kimber, a nephew, is nominated as executor.
The will provides specific bequests to Lois Saffer, Ada Klein, Hazel Aubrey, Pearl Devis
and Grace Adrion, nieces, and Arthur Kimber and Lloyd Saffer,
nephews. Residue is left to a daughter, Thelma Garringer,
and grandchildren, Robert, Frederick, Barbara and Virginia Garringer.

Winchester, Ind. --- The will of Mrs. Clara Frances Nickey
has been filed for probate with the clerk of the Randolph Circuit Court. Her
automobile is left to the step-grandson, Royce Nickey.
The executor is to convert the remainder of the estate into cash which is to be
added to other cash on hand and the entire fund used and divided as follows:
Payment of all just debts, markers to be erected on the deceased's grave and on
that of her deceased husband, John C. Nickey; $100 to
be paid to the board of trustees of the Reitenour
Cemetery; $700 to Royce A. Nickey; $600 to Marvel Nickey; $50 to Bert and Cora Byrum;
$50 to James and Cora Greathouse. The residue of the
fund is to be divided into seven equal parts, six of which are to go to
Blanches Wall, Clyde Fraze, Benjamin Clevenger, Sally
Harlen, Omer Clevenger, and Iva Warren Link. The
remaining share is to go to Tessie Clevenger, and Alice Clevenger. A sum of $50
is also left to the Goodhope Christian Church. The
will was written September 30, 1932 and witnessed by Frederick Caldwell and
Erma Stormes. Royce A. Nickey, executor, filed bond in the sum of $1,000.

Yesterday.
The will of John Oberender, who died June 15,
was probated in Randolph circuit court yesterday, Clarence C. Oberender of Carlos route 1, a son, being appointed
executor. Bond of $500 was furnished with Russell C. Thomas and James Isenbarger of Lynn as sureties.
After providing for payment to children who
provided for him, the deceased bequeathed his entire estate to his
children, less advances made as follows: Thomas J., Charles R., George
W., Lawrence L. and Clarence C. Oberender and Nellie
Leona Thorn.
The will executed February 1, 1933, was witnessed by Samuel C. Westlake
and Mary E. Chenoweth.

Executor.
Elmer Odle, of Ridgeville, route 3, yesterday
afternoon was appointed executor of the will of his father, Thomas Odle, who died November 10. Bond of $52,000 was
furnished with Elmer, Ned and Harry Olde as sureties.
The following bequests are made in the will which was executed May 25,
1929, with Charles W. and George Mendenhall as witnesses.
To a son, Elmer, real estate in Ward township.
To a son, Ned, 65 acres in Ward township.
To a daughter, Alice Harlan, 43 acres in Ward
township.
To a son, Harry, 80 acres in Ward township.
Bonds are to be devided equally between the

The will of Arnta Oyler
has been filed for probate in the Randolph Circuit Court. It provides
that all indebtedness, including funeral expenses and expense of last illness, and costs of administration be paid. To the
widow, Margaret C. Oyler is left all household goods
and personal property in his residence at the time of his death. The
executor is ordered to sell all real estate and convert it into cash, out of
which the indebtedness is to be paid. The widow is willed $500, also her
life estate in the undivided one-third of his real estate; the remainder is to
be divided as follows: To the daughter, Mary Mae Van Camp $100; to the
son, Carl C. Oyler, $50; the remainder to be divided
equally between Mary Mae Van Camp, Chris H. Oyler and
Carl C. Oyler. Max Diggs was named executor and
has given bond in the sum of $2,000. The will was written January 19,
1938, and was witnessed by George H. Ward and Helen Segraves.

Joseph R. Pratt Will is Probated.
The will of Joseph H. Pratt, prominent Ward township farmer, who died
Monday night at his home, six miles east of Ridgeville, has been filed for
probate in the Randolph circuit court.
The instrument, executed on June 20, just eleven days before his death,
leaves to his widow, Lilly M. Pratt, $500 in cash and one-third of his personal
property, after payment of debts against his estate, and one-third of the rents
and profits of 117 acres of land in Ward township during her life or as long as
she remains a widow. The remaining two-thirds of the personal property
and revenue from the land is to be divided between his children and
grandchildren with one share going to Ollie Pratt, a son; another to Carrie
Ruby, a daughter, and a third jointly to Inez Sipe, a
granddaughter, and Orla Walker, a grandson.
At Mrs. Pratt's death or in the event of her remarriage, all the
property, real and personal would go to the son, daughter and grandchildrn in the same ratio.
The deathbed will was witnessed by John H. Rowe and Raymond Tanner.

Lydia T. Pretlow Will Filed in Circuit Court; Was
Former Resident.
A copy of the will of Lydia T. Pretlow, former
Winchester resident who died in Seattle, Wash., on February 5, was filed in
Randolph circuit court Tuesday. Russell T. Pretlow,
a son, is named executor. The document was executed February 23, 1933
with Alexander Easton Young and Ann Olivia Anderson of Seattle as witnesses.
To the son, Russell is bequeathed a cluster diamond ring and a sealskin
coat; to a son, Joseph, is willed a single stone diamond ring; to Russell,
one-half of the residue; to the Peoples Loan and Trust company of Winchester,
the remaining on-half to be invested for the purpose of paying quarterly
installments to the son Joseph until he is 40 years of age, when the trust terminates
and the principal of the fund goes to the son.
Should the son die before he reaches 40 years of age, the trust
terminates and the principal goes to the other son, Russell.

follows:
To the children of a deceased daughter, Laura May Lamb, $300., the balance equally to Nora Pegg,
Edna Hinshaw and Hattie Virginia Reece. A

Will Filed - Allen P. Rice Leaves His Estate to Wife
and Daughter.
Winchester, Ind. - The Allen P. Rice will has been filed for probate
with the Clerk of the Randolph Circuit Court. The Union Loan and Trust
Company of Union City is named executor of the will which was written May 21,
1927.
The executor is first to dispose of stocks, bonds, notes, and mortages as follows: $5,000 to brother Arthur J. Rice
of Spencer, Ohio; $50 per month to his father, Daniel Rice of Spencer, Ohio, as
long as he lives; the balance of the income from the above property is to be
held in trust for the wife Mabel L. Rice, and to be paid annually until the
daughter, Hazel V. Rice, becomes 21 years old. When the daughter becomes
21 years old the executor is to turn over to the wife one-half of the property
and the other half is to remain in trust for the daughter, the income to be
paid to her annually until she becomes 30 years old. At that time the whole
sum is to be turned over to her. The remainder of the estate is left to
the wife.

J. Richter.
Winchester, Ind. --- Max Diggs was named executor in the will of Attillia J. Richter which was probated in Circuit Court
Saturday. The instrument provides that all just debts be paid; a suitable
marker is to be placed at her grave and specified charnes
[?] are to be made on the markers which are now at the graves of her father and
mother. To her step-daughters, Clara D. Richter and Nettie B. Richter,
she leaves each the sum of $150 and permits their burial on the family burial
lot in Woodlawn Cemetery if they so desire. The balance of the estate is
to be divided in two parts, one part to go to the trustees of Woodlawn
Cemetery, Maxville, the proceeds to be used for the upkeep of the family
graves, and the other part to the trustees of the Mehodist
Episcopal Church, Winchester, the proceeds to be used for repairs and upkeep of
the church. The instrument was dated May 11, 1927 and witnessed by James
S. Engle and Alice M. Engle. Max Diggs qualified as executor and gave
bond in the sum of $3,000.

Union City, has been filed for probate in Circuit Court here. His debts and

deceased), the remainder to be divided equally among his children, Charles H. Romeiser, Hermon M. Romeiser, Ernest G. Romeiser,

and Freda W. Wildermuth, and his wife's daughter,
Lydia Hoelsel, if then living, or to heirs of those

Church Cemetery for the upkeep of the Schrons lot,

named executor of the will, and is directed to place a new monument on the Schrons lot and head markers on all the graves on the lot.
The will was made on October 11, 1932 and was witnessed by Frank J. Hazelmire and L. L. Taylor. Edward Schrons

Mr. Sipe, former Portland attorney and
salesman, made the following bequests: Lots 19 to 36 in north Ridgeville

property in Ridgeville and a 49 acre farm one-half mile north of Ridgeville to
a sister, Winnie G. Eakins of Ridgeville; $100 to a brother, Richard C. of
Portland, Ore.; $200 to a brother, Charles O. of Woody, Cal; $200 to Martin E. Sipe of Cheyenne, Wyo; $500 to a
niece, Leila M. Powell of Osborn, Ohio; $500 to a nephew, John A. Eakins of

Balance of the estate, after the above bequests are made by the executor,
is willed equally to Winnie G. Eakins and Lillie C. Smith.

Winchester, Ind. --- The last will of Mrs. Irene Bell Smith
has been filed for probate in Randolph Circuit Court. Provisions were
first made for the payment of just debts and funeral expenses. Gertrude
Murphy and Ada Beck are to be given her
diamonds. The income from the estate is left to the husband, Samuel D.
Smith, for his lifetime, after which $1,000 is left to Ada
Beck, $500 to Thaddeus Gregory and the remainder to be divided equally among
the brothers, B. F. Murphy, E. W. Murphy, and the children of a deceased
sister, Amy Wilkerson. The Atlas State Bank is executor of the will
written December 15, 1928, and witnessed by Raymond Bennett and Elmer Kerr.

L. Mae Smith Will Probated Tuesday in Winchester Court.
The will of L. Mae Smith, of Winchester, who died recently, was probated
in Randolph circuit court yesterday, the husband, Charles W. and a sister,
Bernice E. Pierce, being made sole beneficiaries.
To the sister is bequeathed all household goods, rings and jewelry with
the exception of two diamond rings with single stones which will go to the
husband; also to the sister, shares of stock in the Eastern Indiana Telephone company of Winchester and 41.22 acres of land adjacent to
the Winchester-Windsor pike.
The husband is willed a 32 acre tract of land and the residue of the
estate is left equally to the two. Mr. Smith was nominated as
executor. The will was executed August 17, 1935, with Fern Green and John
W. Macy, of Winchester, as witnesses.

Winchester, Ind. --- The last will of Dr. Samuel D. Smith was
admitted to probate yesterday in Circuit Court. It provided for the
settlement of all just debts and then the estate converted into cash and
distributed among relatives as follows: Equal parts to Charles A. Smith,
William R. Smith and Harry S. Smith, brothers of the deceased, and Elizabeth Stoneman, Mollie Turner and Etta Kelly, sisters, and to a
sister-in-law, Ella Smith. One share is to be divided between Earl and
Russell Burkett and Gertrude Shaw, children of a deceased sister. The
part willed to Ella Smith is to revert to the estate on her death and to be
divided among the other beneficiaries. The Commercial Bank and Trust
Company, of Union City, is named executor of the estate, according to the terms
of the document, which was drawn December 21, 1934, and witnessed by Ella J.
Morris and Elmer Kerr.

Widow Contests Will of Husband.
Complaint to set aside the will of the late John T. Stanley of Farmland,
who died October 4, 1940, was filed in Randolph circuit court yesterday by
Addie Stanley, widow of the deceased. Defendants are Edward J. Mendenhall
of Farmland, as executor of and trustee under the will, and the beneficiaries,
among whom are Myrtle M. LaFuse, Arvada Wheeler, John
Thompson Stanley, Angie Clark, Zoe Harding and Frederick Lee (Stroube) Stanley.
John D. Wilson, Winchester attorney, represents the plaintiff.
Return date is November 29.
December 20, 1940 - $8,000 Claim is Filed by
Widow.
A claim against the estate of John T. Stanley was filed yesterday in
Randolph circuit court by Addie Stanley, demand being $8,000 on an antenuptial contract. John D. Wilson, Winchester
attorney, is Mrs. Stanley's attorney.
The contract, a copy of which is filed with the claim, was executed
January 9, 1940.

Widow Accepts $3,800 in Full of Her Rights in J. Stanley Estate.
Addie Stanley, widow of the late John F. Stanley of Farmland, yesterday
in Randolph circuit court agreed to accept $3,800 in full of all rights under
an antenuptial contract. Mrs. Stanley last
November had filed an action seeking to have the will of her husband declared
invalid.
Under terms of the agreement she also is relieved from the duty of
caring for Frederick Lee Stanley, to whom a deed to the decendant's
real estate was ordered delivered. Judge John W. Macy ruled the will
valid. A claim of Mrs. Stanley against the estate was dismissed.
Edward J. Mendenhall, of Farmland, is executor and trustee under the will.

Oscar Rowe Named Executor of Will.
Oscar Rowe yesterday was appointed executor of the will of his mother,
Elizabeth Stoneman, who died August 21. Bond of
$1,000 was furnished with the United States Fidelity and Guaranty company as surety.
The entire estate is left equally to the son and two grandchildren -
Grant Lindley and Glee Scott. The will was executed October 20, 1936,
witnesses by William L. Cheney and John W. Macy.

John Strasser yesterday in Randolph circuit

The will provides that the entire estate be left to the husband,
John. It was executed June 28, 1937, witnessed by Frederick S. Caldwell
and Robert C. Oliver.

Children Share in James Sutton Will Probated in Court.
The will of James B. Sutton has been probated in Randolph circuit
court. All just debts, including expense of last sickness and burial, are
first to be paid, according to the will, and a third of the balance is left in
charge of a trustee or guardian to be appointed by the judge of the cirucuit court for the use and benefit of the widow, Mellie D. Sutton who was in ill health when the will was
drawn.
The remainder of the estate is left to the four children, Bessie Monks,
Gracie Kemp, Claude J. Sutton and Ralph D. Sutton in equal shares. The
will was dated April 13, 1929, and witnessed by J. H. Potts and John A. Shockney.
In a codicil daated March 29, 1935, and
witnessed by Ruth Gettinger and Clyde N. Chattin, the amount willed for the use of the widow was
cancelled due to her death; $1 was left to the son, Claude J. Sutton, $600 to
the daughter, Bessie Monks, and $200 to the Daughter Gracie Kemp; the balance
of the estate to be divided equally between the three children, Bessie Monks,
Gracie Kemp and Ralph Sutton. Vinie Hinkle was
named executrix.
In a second codicile dated May 22, 1939, a
son-in-law, Thomas C. Monks, was named executor. This codicile
was witnessed by Mrs. Eileen Johnston and Egnance Boda.

Mary Temple Will Filed for Probate.
The will of Mary E. Temple, of Saratoga, who died July 7, was filed for
probate in the Randolph circuit court Saturday. It divides her household
goods among her three children, Jacob Temple, Mary J. Ohler
and Dora L. McGalliard and leaves all the money to
her credit in the Saratoga bank and elsewhere to Mrs. Ohler,
who is directed to pay debts against the estate. Mention is made of a
warranty deed executed to Mrs. Ohler on the date the
will was signed - August 26, 1936. Witnesses to the signature were Bessie
E. and Victor E. Harman. Joseph Ohler was named
as executor of the will and qualified Saturday.

The will of Nellie M. Tetley, who died October 2, has been probated in Randolph
circuit court and Gath Barnum of Union City route three appointed executor and
Russell E. Wise, Union Cithy attorney, named as admistrator with the will annexed. Bond of $10,000
was furnished with the American Bonding and Surety company
as surety.
Bequests include $1,000 each to Nicholas P. Lawrence and Bess Lawrence of Fort
Smith, Ark; Fred and Warren Buckley of Wayland, N. Y., nephews; N. C. Taylor,
of Union City; Gath Barnum and Bea Barnum, and to the Methodist church of
Bentonville, Ark.
Residue of the estate is bequeathed to Fred and Warren Buckley.
The will was executed April 8, 1946 with John Brizzalora,
John H. Fitzhugh and Mabel O. Riley of Fort Smith as witnesses.

estate which she had at her death; also all personal property is to go to a
sister, Laura E. Lynch of Darlington, Ind. Louis Gruber of Union City,
Ohio and the sister are named executors of the will which was written Nov. 25,
1924.

The will of Cora I. Thornburg, who died recently, was filed for probate today
in Randolph circuit court. Provisions include a bequest of $200 to a
niece, Thelma Lamb, who lived with the deceased for 14 years, the residue to be
divided equally between three children, Mary E. Kemp, R. May Hough and Hazel H.
Lee. Mrs. Kemp was nominated as executrix. The original will was
executed October 29, 1929 with John W. Macy and Fern Green as witnesses.
In a codicil, attached September 24, 1935, the Lamb bequest was increased to
$300 and provision made that if Mrs. Kemp preceded Mrs. Thornburg in death the
other daughters were to be joint executrixes.

Oct. 5, 1931, and witnessed by John W. Bragg and Frank C. Unger.

The will of James T. Trimble, who died recently at Parker, was filed for
probate today in Randolph circuit court. It was executed March 19, 1946
with Nathan Mendenhall and Dorothy Keener, of Winchester, as witnesses.
All household goods, personal effects and an automobile are left to the widow, Melva O., and co-executors are directed to pay her a
monthly sum until creation of a trust fund.
Residue of the estate is bequeathed to two sons, Ralph C. and Claude F. as
co-trustees to be held in trust for Mrs. Trimble. Should she cease to
remain the widow of the decedent, the trust is to be terminated and the estate
divided equally among six children, Ralph C., Claude F., Floyd L., Owen F., and
Harold S. Trimble and Rosellen Van Devanter.
Ralph and Claude Trimble are nominated as co-executors and co-trustees.

The will of James W. Ullom
has been filed with the clerk of the Randolph circuit court for probate.
Just debts are to be paid and provision was made in
the will for the erection of a marker on the burial lot in the Hopewell
cemetery.
Theodore Bragg was named executor of the will which
was written March 24, 1943, and he is authorized to distribute the remaining
estate, equally, between the following persons or their heirs, one year from
the date of the death of Mr. Ullom: daughter, Lavina Doretha Ireland, Nora Neoma Forrest, Luella G. Grove, Pearly G. Eifher, and Ethel V. James, and son, Melvin M. Ullom.
The witnesses were Edward F. Rector and Theodore
Bragg.

Will of George Ward is Probated in Court; Wife is
Beneficiary.
The will of George H. Ward, Winchester attorney who died last Wednesday
night, probated in Randolph circuit court Saturday, names the widow Mary M., as
sole beneficiary under a trusteeship of which Merle Browne of Winchester is
trustee. The will was executed February 19, 1941 with Lester C. King and
Harold J. Bell as witnesses.
The will provides that the executor sell all property at private sale,
balance after funeral expenses and debts are paid to go to Browne as trustee,
who will invest the funds in interest bearing securities and pay the widow or
any institution having charge of her affairs for her support and
maintenance. Mrs. Ward at the time the will was executed was a patient in
the Veteran's hospital in Indianapolis.
Should she become capable of managing her own affairs, the trusteeship
will terminate. Provision is made for her funeral expenses and a lot for
her in a Shelbyville cemetery.
At Mrs. Ward's death, residue of the estate is willed equally to Mary
Elizabeth Arnold Cobb and Myrtle Imley, nieces of
Mrs. Ward and to Helen Segraves, Mr. Ward's secretary
and Gertrude Wasson, both of Winchester.
Should any of the residuary legatees die before Mrs. Ward, her interest
then goes to Randolph Post 39, American Legion.

Winchester, Ind. --- The last will of Tilden H. Warren, of Randolph County, has
been filed with the clerk of the court for probate. It provides for the payment
of all just debts, for the purchase of a lot in the I. O. O. F. Cemetery at
Saratoga, Ind. Also that a monument be erected at place of
burial not to exceed $2, 500. The State Bank of Saratoga is appointed
executor of the will. After the payment of the above, all the remainder of the
estate is to be put in trust with the Saratoga State Bank, the proceeds to be
used for the care of the widow, Bertha Warren, for her life time. At her death
all expenses are to be paid and the remainder of the estate converted into
cash. Three-fifths is to be put into a trust fund for Ruth Ellen Keltner until she is 35 years of age. The other two-fifths goes to his brothers and sisters, Ida Doty, Riley Warren, Ora Warren, Jennie Powers, Pearl Steed, Susie Garringer and Pierre Warren to be divided equally among
them. The will was written September 27, 1929 and witnessed by U. G. Daly and
George H. Ward.

articles of household furniture and such consumable supplies as may be on hand.
The remainder of the estate, after the payment of just debts, etc. is to
go to the two daughters, Eva O'Connor and Mary A. Vernon.
Ira Vernon was named executor of the will which was written Nov. 16,
1929 and witnessed by J. B. Mason and S. F.

The widow, Jennie, according to provisions of the will, is bequeathed a life
estate, or as long as she remains the decedent's widow, to the property, which
at her death or remarriage will go to a daughter, Judith Tha
Williams.
Stock in the hardware store, other merchandise and fixtures already had been
settled upon two sons, Veirl R. and Clyde C.
The will was executed January 12, 1937 with Earl Maines
and Samuel C. Westlake as witnesses.

Will of Late David Wilmore Filed In Court.
The last will and testament of David W. Wilmore was
admitted to probate in the Randolph Circuit court Saturday. The will was
executed May 22, 1944, with Merrill W. Nichols and Louis King as witnesses.
After the payment of just debts and expenses, the 160
acre farm owned by decedent in Randolph county was
devised to his son, Fred S. Wilmore, together with decedent's interest in all
growing crops thereon, feed, livestock, tools, equipment and other personal
property used on or about said farm. The sum of $7,000 in cash is
bequeathed to his grandson, Ralph C. Wilmore. After compliance with the
above, the rest and residue of the property, real and personal, is willed to
his son, Fred S. Wilmore and his grandson, Ralph C. Wilmore, share and share
alike.
The will names Fred S. Wilmore as executor of the
will. Said executor has filed his bond in the sum of $20,000 with the
General Casualty Company of America as surety thereon, and has qualified as
such executor.

Blaine Barr and Florence Mote, of Union City, yesterday in Randolph circuit
court were appointed execuror and executrix of the
estate of Alice Woodbury, who died December 22. Bond of $4,000 was
furnished with Glen Barr and William H. Grimes of Union City as sureties.
The entire estate, as provided by the will, is left to five daughters,
Florence Mote, Clara Warner, Myrtle Thompson, Blanche Rowe and Hazel
Barr. Four of the daughters are to be paid amounts equal an indebtedness
of Blance Rowe and then the residue is to be divided
equally.
The will was executed June 19, 1923 with Frank J. Haselmire
and L. L. Taylor as sureties. [Probably should read as witnesses.]

Clarence Woodbury Named Executor of His Mother's Will.
Clarence Otto Woodbury has been appointed in Randolph circuit court as
executor of the Anna B. Woodbury will, which was probated yesterday. Bond
of $1,000 was furnished with the American Bonding company of Baltimore, Md., as
surety.
The son was named executor in the will of his mother, which was executed
November 12, 1932 with Mary A. Howard, Alicia Evans and Elmer Kerr as
witnesses.
Provision is first made for funeral expenses, after which personal
bequests were made to the son, Clarence Otto, including his father's tool chest
and watch. All cash on deposit at banks is left to the above named son
and the daughter, Della May Austerman, in equal
shares. To the above daughter is also left furnishings, linens,
silverware, household, and personal effects at the home, 1004 West Oak street, Union City. Remainder of the estate, including
the property on Oak street and any other property not
before mentioned, is left for disposal to the direction of the executor, and
the proceeds are to divided equally between the son, Clarence Otto, and the
daughter, Della May, or to her child, Clarence Richard.

Valarah Yost Will is Probated
in Randolph Court.
The will of Valarah Yost, who died February 8,
executed at Glasgow, Mont., in 1935, was probated in Randolph circuit court
yesterday.
To a grandson, Harlan S. Yost, is bequeathed $500, residue of the estate
going to the following children: Albert M. of Spokane, Wash., Blanche Jelley of Glasgow, Mont., Cina
McKnight of Winchester and Myrtle of Cincinnati. The two daughters, Cina and Myrtle are nominated as executrices and are
requested to sell the farming land near Winchester and divide the
proceeds. It is also requested that the executrices be appointed
guardians of the estate of Harlan Yost for the purpose of administering the
bequest.
The will was executed May 2, 1935 at Glasgow, Mont., with Maud L. Currey and George E. Birmingham as witnesses.
