THE CAINS
---------
So far as is known there was only one family of Cains living in Wilkinson
co. Mississippi from the time of it's formation (1802) until 1850.  There
were no Cains listed on the 1850 & 1860 Census.  Some Cains were listed
on the 1870 Census but are unknown to me.  jc
This line of Cains spanning over three centuries from Baltimore co.
Maryland to Texas, Oklahoma, Lousiana and other places was put together
by the efforts of many people working independently.

To All in whom these presents shall come, Greeting:
KNOW YE, That WILLIAM CAIN, assignee of Reuben Dunham, having deposited
in the Treasury, a Certificate of the Register of the Land Office west of
the Pearl River, whereby it appears that full payment has been made for
the Section twelve in Township one north of Range one east of the
Washington Meridian, Mississippi, containing four hundred thirty-five and
fifty-four-hundredths acres of the lands directed to be sold at the Land
Office west of the Pearl River, in pursuance of the laws providing for
the sale of the lands of United States in the Mississippi Territory;
THERE IS GRANTED, by the United States, unto the said WILLIAM CAIN, the
section of land above described: TO HAVE AND TO HOLD, the said section of
land, with the appurtenances, unto the said WILLIAM CAIN, and to his
heirs and assigns, forever.
This patent is granted as and for a patent intended to have been granted
and issued on July 30, 1812, but the issuance of which is not
sufficiently evidenced by the records of the General Land Office or by
other obtainable evidence.
In Testimony whereof, I, Woodrow Wilson
President of the United States of America, have caused these letters to
be made Patent, and the seal of the General Land Office to be hereunto
affixed.

GIVEN under my hand, at the City of Washington, the FOURTEENTH day of

Pearl River, M.  T. I have surveyed for WILLIAM CANE, Afsignee of Reuben
Dunham, a tract of land on the waters of Thompson's Creek, being Section
No. 12 in Township No. 1, Range No. 1 East of the Basis-meridian and
bounded as follows:

Beginning at a White Oak standing on a line of Joseph Dunham's claim and
running thence with said line South eight degrees East thirty two chains
to a Magnolia standing on the said line thence South fifty two degrees
West fifty five chains to a stake, thence North forty seven degrees West
sixty nine chains to a Dogwood; thence North forty five degrees East
fifty eight chains to a Holly; thence South thirty three degrees and
forty five minutes East thirty two chains & four links to Safsafras;
thence North eighty two degrees & fifteen minutes East 31.21 ch. to the
place of beginning.  Containing 434 Acres and 54 hundredths of an Acre;
and having such shape, form and marks, natural and artificial, as are

WILLIAM CAIN to the Shiloh Church.  Filed 22 May 1815.
This indenture made this eighteenth day of June in the year of our Lord
one thousand eight hundred and fourteen between WILLIAM CAIN; of the one
part and Davis Cooper, Thomas Cason, David Cox and William Irwin trustees
for the Baptist Church known by the name of Shiloh; of the other part all
of the County of Wilkinson and Mississippi Territory.  Witnesseth that
for and in consideration of the sum one dollar in hand paid by the
aforesaid trustees of the aforesaid Church called Shiloh to the said
WILLIAM CAIN, the rect. and payment whereof are hereby acknowledged; Hath
bargained, sold, aliened, enfroffed (?), conveyed and confirmed; and by
these presents doth bargain and sell, alien, enfroff (?), and convey and
confirm unto the said D. Cooper, Th. Cason, D. Cox and Wm. Irwin and
their successors for the aforesaid Church.  It being for the use and
benefit of said Church as a place for Religious Worship forever.  All
that lot or parcel of land being a part of the tract of Land whereon the
said WILLIAM CAIN now lives situate lying and being in the County of
Wilkinson and Territory aforesaid on the head waters of Thompson's Creek.
beginning at a Holly (?), and running thence North sixty nine yards to a
stake thence east sixty nine yards to a stake thence South sixty nine
yards to a stake; thence sixty nine yards to the beginning containing
4761 square yards more or less.  To have and to hold to the aforesaid
Trustees of the Church aforesaid and their successors forever with all of
the appurtenances thereunto belonging or in any wise appertaining.
Together with all and singular the benefits and Emoluments therefrom to
arise And (?) the said WILLIAM CAIN as aforesaid for himself, his heirs,
Executors, Administrators doth hereby command, grant and agree to and
with the aforesaid Trustees of the Church aforesaid and their successors
that unto them, he and they the aforesaid lot or parcel of land, shall
and will warrant and forever defend against the claims of all persons
whomever lawfully claiming by, through, or under the said WILLIAM CAIN
his heirs, Executors or Administrators or either of them.

This indenture made and entered into this twenty second day of December
in the year of our Lord one thousand eight hundred and twenty three
between JOHN CAIN administrator of the estate of WILLIAM CAIN decd. of
the County of Wilkinson and state of Mississippi of the first part, and
Nancy Scudder Administratrix and guardian of the minor children of
Nathaniel Scudder of said county and state deceased of the other part.
That whereas in conformity with a bond executed by WILLIAM CAIN decd. in
his lifetime to wit on the thirteenth day of May in the year eight
hundred and eighteen and by virtue of a decree of the Honorable Court of
Probate of said county and state dated twenty second day of December in
the year of our Lord one thousand eight hundred and twenty three, the
said JOHN CAIN administrator as aforesaid does hereby sell, grant, convey
to Nancy Scudder - a certain tract of land in the county and state
aforesaid on the Northwest side of Thompson's Creek and known as a
fractional section number thirteen in township one of Range one east in
the district of lands west of the Pearl River containing sixty four acres
bounded as follows.  Beginning at a Red Oak on said CAIN'S pre-emption
claim and running thence along said line north 47 degrees west sixteen
chains and thirty link to a stake the NW corner of said fraction thence
south along said section line sixty four chains to said Scudder Mill
creek; thence up the meander of said creek to a marked tree on NW side of
said creek; thence due north to the Red Oak on CAIN'S line the beginning.

Wilkinson and State of Mississippi in consideration of the natural love
and affection which I have and bear to my sons HUGH, JAMES, and WILLIAM
CAIN have this day given, granted, released and confirmed unto my said
sons HUGH, JAMES, and WILLIAM and by these presents do give grant, sell
and confirm to my said sons HUGH, JAMES and WILLIAM all my right title &
interest to all my land lying in the said county of Wilkinson together
with all the appurtenances & hereditaments to the same in any wise
pertaining; the said land to be equally divided between the said HUGH,
JAMES, and WILLIAM at my death and also in consideration of the natural
love and affection which I bear to my daughters DORRINDA, FANNY and
ADALINE, I, the said ALLEN CAIN have this day given, granted, released
and confirmed to my said sons, daughters jointly my slaves Comit (?),
Mark, Millie, Ned, Errick, Big Jerry, Little Jerry, Sal, Doe, James, Dick
& Hannah together with all my stock, farming utensils and every other ---

This indenture made this 10th day of September in the year of our Lord
one thousand eight hundred and thirty six Between HUGH CAIN and WILLIAM
CAIN of the County of Wilkinson, State of Mississippi on the one part and
Lewis Cason of the same State & County of the other part.  Witnesfth that
whereas Jesse Jones & William Hall become liable as securities on a
certain joint and several promissory note given by HUGH CAIN and WILLIAM
CAIN on the 18th day of January, AD 1836 for the sum of four thousand two
hundred and eighty dollars and twenty (5)cents and made payable six
months after date to Jesse Jones and William Hall, Co-Administrators of
the estate of ALLEN CAIN, deceased.  And the said HUGH CAIN & WILLIAM
CAIN being desirous to to secure the said Jesse Jones & William Hall on
account thereof, and in consideration of the sum of one dollar to them in
hand paid by the said Lewis Cason the said HUGH CAIN & WILLIAM CAIN have
given, granted, bargained, sold, conveyed, released and delivered and by
these presents do grant, bargain, sell, convey, release and deliver unto
the said Lewis Cason, the following described property to wit:  A Negro
woman named Sarah about 50 years, a Negro man named Ned age about 45
years, a Negro man named Ellick about 40 years, a boy named James(?)
about 14, and a boy Dick about 10 years old.  Also all the right, title,
interest and claim whatsoever of them, the said HUGH CAIN & WILLIAM CAIN
in & to the tract of land deeded to them by ALLEN CAIN and on which the
said ALLEN CAIN resided at the time of his death, Together with all the
Right, Title & interest of them the said HUGH & WILLIAM CAIN in & to a
certain tract or parsel of Land lying in said State and County and owned
by WILLIAM CAIN Senior at the time of his death and which deeded to his
heirs at this death, The said ALLEN CAIN, dec. being one of those heirs
through whom the said HUGH and WILLIAM CAIN acquired their title and
which said undivided interest in & to the last mentioned land was perhaps
also deeded by the said ALLEN CAIN in his lifetime to the said HUGH CAIN
and WILLIAM CAIN to have and to hold the above described property unto
the said Lewis Cason, his heirs, Executors, Administrators forever, upon
the following conditions, that is to say, if the said HUGH CAIN and
WILLIAM CAIN or either of them  shall well and truly pay or cause to be
paid the above described note, together with all and damages when the
same shall become due and payable and thereby save harmlefs and from any
lofs the said Jesse Jones & William Hall, Then this obligation to be
void, But in case the said HUGH CAIN & WILLIAM CAIN shall fail to pay the
aforesaid note together with all interest costs, damages, etc. when the
same shall become due and payable.  That then it shall be the duty of the
said Lewis Cason when requested by the said Jones or Hall to seize the
above described property, and after giving thirty days public notice in
some newspaper printed in the town of Woodville & County of Wilkinson of
the time and place of sales to sell the same to the highest bidder for
cash and to make good and sufficient title to the purchaser or purchasers
to the same and out of the proceeds of said sales to pay the said all
such sum or sums of money as they or either may have paid by reason of
the securityship aforesaid balance of proceeds of said sales, after
deducting the cost of executing this trust to pay over to the HUGH &
WILLIAM CAIN or their executors or administrators.  And it is further
agreed by and between the parties aforesaid that if the said Lewis Cason
shall refuse or become unable to execute this trust according to the true
intent and meaning thereof then the said Lewis Cason or his executors or
administrators shall have power under their hands and seals to appoint
some ----- person to do the same whose acts done in the premises shall be
as valid to all intents and purposes as if the said Lewis Cason had done
the same, and the said Lewis Cason hereby accepts this trust and hereby
agrees to execute the same according to the true intent and meaning
thereof.  In Witnesf whereof the said parties have hereunto set their
hands and seals the day and year first above written.

RE: A certain deed of trust made by HUGH & WILLIAM CAIN on the 18th day
of Jan 1836.
Whereas Lewis Cason is authorized on the failure of HUGH & WILLIAM CAIN
to pay & satisfy a certain promissory note given by them on 18 Jan 1836
and payable six months after that date to Jesse Jones and William Hall,
co-administrators of the estate of ALLEN CAIN, dec for the sum of
$4280.25.  Lewis Cason to sell 85ac of land, it being 2/3 of the 2/5 of
one third of 750ac of land formerly owned by WILLIAM CAIN, Sr., it being
the same on which WM. CAIN, SR. lived before and at the time of his death
and known as the CAIN Tract and adjoining to Mount Pleasant.  Bought by
Felix Embree for $154.

Articles of agreement made and entered into this fifth day of December AD
1838 between Margaret Cason of the County of Wilkinson and State of
Mississippi, widow of the late Lewis Cason, dec. of the one part & Henry
L.  Cason of the said state & county, one of the legal heirs &
representatives of the said Lewis Cason, dec of the other part.
Witnefseth that the said Margaret Cason as aforesaid for and in
consideration of the premises hereinafter mentioned, and in consideration
of one dollar to her in hand paid at or before the signing and delivery
of these presents extinguishes and forever quit claim all her right,
title & interest as aforesaid in and to all property, both real &
personal belonging to the estate of the said Lewis Cason, dec.  to the
said Henry L.  Cason, his heirs and assigns forever and the said Henry L.
Cason in consideration of the premises aforesaid agrees on his part and
binds himself and his heirs, administrators, and executors to support &
maintain, in a genteel and comfortable manner, the said Margaret Cason
for & during her natural life and to allow the said Margaret Cason to
have the use & control of a Negro girl named Caroline for & during her
said natural life.  And the said Henry L. Cason further agrees & binds
himself, his heirs, executors and administrators to pay ARCHIBALD W. CAIN
of the County of Amite in said state the sum of fifteen hundred dollars,
at the death of the said Margaret Cason.  In witness whereof the said
Margaret Cason & Henry L. Cason have hereunto set their hands & seals the
day and year above written.

Last Will and Testament of JAMES CAIN of Wilkinson County, Mississippi 14
Jan 1837.
In the name of God amen, I, JAMES CAIN of Wilkinson co., State of
Mississippi being sick & weak in body but of sound mind & memory and
understanding & considering the certainty of death and uncertainty of the
time thereof and to this end I may be better prepared to leave this world
whenever it shall please God to call me, hence do therefore make and
declare this my last will & testament in manner following that is to say.
I will that all my just debts as shall be by me owing at my death
together with my funeral expenses and all charges _______ & otherwise
concerning this my will shall in the first place out of my personal
estate & effects be fully paid & satisfied and ____ and after payment
thereof and subject ______ there my will is that all ______ of my goods,
stock, chattels, merchandize & household furniture shall be impartially
appraised and after such appraisements made I give and bequeath my loving
wife NANCY L. CAIN this whole of my property and one Negro woman Chaney,
my stock of Horses, Cattle, Hogs, Household & Kitchen Furniture.  And
also one section of land containing 161 acres 67/100 purchased by me 22
Nov 1816.  Township no. 2, Range no. one West in the district of lands
west of the Pearl River in the county aforesaid.  I appoint Peter W.
Smith my executor to this my last will & testament.  In Witness whereof I
JAMES CAIN have hereunto set my hand & seal this fourteenth day of
January AD1837.

Abott, Nicholas Devongham appraisers of said estate.

An instrument of writing purporting to be the last will and testament of
JAMES CAIN dec. was brought into court and proved by the oaths of Lewis
Cason and Thos. Logan two of the subscribing witnesses to said will who
on their oaths say that they saw the testator sign, seal & publish the
same as his last will and testament & that he was of sound and disposing
mind & memory & that they signed the same at the request of the testator
& in his presence & in the presence of each other.  Whereon said will was
ordered to be recorded.

estate of JAMES CAIN dec. on her entering into bond in the sum of two

waived his right to administer.  It is therefore ordered that letters of
administration with the will annexed be granted said Richard Slack on the
estate of JAMES CAIN dec. on his entering into Bond the sum of two
thousand dollars with Jacob Seber & Joshua G. Rutledge as his securities

It appearing to the satisfaction of this court that the personal estate
of JAMES CAIN decd. is insufficient to pay the debts of said estate it is
ordered that a citation issue to all persons interested in the lands,
tenements and hereditaments of said estate to appear at the next December
term of this court & show cause if any they can why the said lands,
tenements & hereditaments should not be sold. (to wit - a tract of land
containing one hundred fifty three acres on which JAMES CAIN resided at
the time of his death.

Ordered that a further time of six months be allowed the commissioners
appointed to receive and audit claims presented against the estate of
JAMES CAIN decd.  & reported insolvent, and that the said commissioners
of insolvency be continued said further six months and that said
commissioners appointed at the May term of this court 1838 publish
further that they will meet at the house of Daniel McGahee in Wilkinson
County on the first Saturday in each month for the ensuing six months for
the purpose of receiving and auditing claims presented against the estate
of the said JAMES CAIN dec. reported insolvent aforesaid.

deceased to show cause if any they could why a certain tract of land of
said deceased containing one hundred and fifty three acres being the same
tract whereon said deceased resided at the time of his death should not
be sold to pay the debts of said deceased & it appearing to the
satisfaction of the court that the personal estate of said decd. is
insufficient to pay his debts & no person appearing to resist the
application for such sale, it is therefore ordered that William H.
Vaughan the administrator de bonis non of said JAMES CAIN estate sell
tract of land to pay the debts of said dec. on a credit of twelve months
agreeably to law first giving notice of said sale as directed by law.

   We the undersigned appraisers of the Estate of WILLIAM CAIN deceased
certify that the above Inventory exhibits a true statement of the
property of said deceased and the value thereof annexed so far as the
said property came to our sight and knowledge.

administrator of the Estate of WILLIAM CAIN dec.  who being duly sworn
deposeth and says that the above and foregoing account of the sales of
property belonging to said estate as therein set forth is true and
correct to the best of his knowledge and belief, so help him God.

Whereas at the final settlement of the account of the Estate of WILLIAM
CAIN dec. made by the admx of Thomas Bacon dec. at the March term 1843 of
the Probate court of Wilkinson County, she made an error in the account
of $75.00.  There being that sum due to the said Estate not charged in
said account also the interest of $65 for eighteen months amounting to
$7.80 which amounts she acknowledges to be due the said estate and holds

27 Jul 1833  John Butler of Amite co., on the 27th, who killed his
nephew-in-law John Knox, fled to Texas, but has been taken, and on Monday
last was lodged in the jail in this county.  The reward will fall to Mr.
Moses Seale & Mr. William Montgomery of Amite.  (Originally from the
Natchez Courier).

acres.

secure Jesse Jones & William Hall, co-administrators of the ALLEN CAIN
estate, for the sum of $4,280.25.  HUGH & WILLIAM CAIN'S 163 acres was
deeded to them by ALLEN CAIN, out of his 205 acres and bouded by lands of
Mrs. Penelope Stewart, James A.  Ventress.  Also a share of and undivided
85 acre tract on which WM. CAIN, SR.  lived at the time of his death --
all to be sold to clear debt.  Lewis Cason, trustee.
