In
the name of God I Swear
I
Jenkin Phillips of the County of Jefferson and State of
Kentucky do make, constitute and ? this my last and
testament hereby making all the wills by me heretofore
made.
Imf???mes-
I give and bequeath to my son Thomas Phillips 616
acres and 2/3 rds? of an acre of land lying in Jefferson
County it being the land wherein the said Thomas Phillips
formerly lived to
him and his heirs forever.
I
also give to the said Thomas Phillips our lot of ground in
the ? of Louisville adjoining the public Square and
described and ? on the planner map of said ? by number
178. It being
the lot wherein a man by the name of Kelly ? resides to
him and his heirs forever.
I
likewise give to my said son Thomas Phillips the tract of
land whereon I now live which I suppose to contain 300
acres to the same more or less, by his paying to his
brothers and sister the sum of $5500 to him and his heirs
forever, but it is given to be clearly and perfectly
understood that the said $5500 is to be paid in 3 equal
and annual installments.
I also
give to my said son Thomas Phillips the following Negroes,
?, and???, John, Priscilla and her 4 children by name?
Stephen, Females Val and B?, them and their future ? to
him and his heirs forever.
? I give and bequeath to my son Richard Phillips the whole of
my land lying on the northeastwardly side of the ? ? ? and
adjoining the lands of David L Ward? & General ?
Clarkes heirs and the land wherein William Oldham at
present resides which I suppose to be 250 acres be the
same more or less. It
being the land whereon my son Richard L? Phillips formerly
lived and which said land is now occupied by a ? of the ?
belonging to my son Richard Phillips to him and his heirs
forever. I
also give to my said son Richard Phillips 200? acres of
land lying in the Illinois Grant?? now in the State of
Indiana and known by number ? to him and his heirs
forever. I
likewise give and devise to my son Richard Phillips the
equal ½ of another tract of land lying on the ? PG
155 cont’ Grant and State of Indiana and known by
number 161? and
suppose to contain 5 ? ? acres to him and his heirs
forever.
I
also give the said Richard Phillips the choice of 2 lots
in the City of Louisville one lying on Market Street and ?
and described on the planning? map by said ? by number 119
and deeded to me by John Sanders? and the other know and
described on the planning map of said ? by number 209 and
lying on Jefferson and Second ? Streets to him and his
heirs forever, but it is clearly and expressly understood
my wish that my son Richard Phillips shall declare his
said choice of the said lots within 6 months after my
death in writing and PG 156 have
the ? proved, acknowledged? and recorded
which shall ? effectively rest in him his heirs and
assigns the title to the lot

same had been ? ?

I
also give my said son Richard Phillips the following
negroes ?, John, Spence, Sall? and her 4 children by name
????????????????? and their future increase to him and his
heirs forever.
I
give and devise to the children of my deceased son Samuel
Phillips one lot in the town of Louisville known and
described by the planning? map of said town by number 175
and which said lot adjoins the Public Square to them and
their heirs forever. I also give to the aforesaid children
of my deceased son Samuel Phillips the equal half of my
tract of ? formerly known by the name of the Ilinois
Grant? now lying in the State of Indiana and known by
number 161 to them and their heirs forever.
I also give to the aforesaid children of my
deceased son Samuel Phillips the following negroes ?, ?, and Charles together with
? their present and future increase to them and
their heirs forever.
I
give to the children of my daughter Hannah Duberly 2
negroes by name Rachel and Liz with both their present and
future increase to them and their heirs forever. I also
give and devise to the children whch my daughter Hannah
Duberly now has or which she may hereafter have 200? acres
lying in the County of Jefferson and about 5 miles from
Louisville on the waters of ? Mill Creek which land is to
be taken of it South East line of my thousand ? survey and
to be laid off in a ? form and not to ? to either corner
and to begin ? 150
poles from the northeast corner to them and their heirs
forever.
I
give and devise to the children of my deceased daughter
Catherine Hunter the following negroes ?, ? and her child,
the name of which at present I do not recollect and also ?
and ? and the other negroes which I purchased of ? ? ? ? and
which said negroes I lent to my son in law Joseph Hunter ?
? his
natural life. The aforesaid negroes at the death of their
father Joseph Hunter, I leave to the children of my
daughter Catherine ?
? their present and future increase to the children
aforesaid and their heirs forever.
I
give to my daughter ?
Hamilton 1000 acres of land lying in Hardin County
? of ? ?
in the name of Rhuebin?
? and
patented in my own ?
to her and her heirs forever. I also give to my
daughter PG 157 Ann
Hamilton 3 negroes by name ?, ?, and Bill them and their
increase to them and their heirs forever.
I
give and devise to my daughter Lydia Clark 725? acres
lying in Jefferson County known by the name of the Duck
Spring tract it being the land wherein she now resides to
her and her heirs forever. I also give to my daughter
Lydia Clark 11 negroes by name of Catherine, Henry, ?,
Lucy, ?, Samuel, Evan, Mary and Kody? which said negroes I
have lent her husband
Ludlow
Clark for and during his natural life, but at his death it
is my wish and devise that they should descend with their
increase to my daughter Lydia Clark and her heirs forever.
I
give to my daughter Susan Riley the negro woman by name
Yellow Mary her and her present and future increase to her
and her heirs forever. I also give my daughter Susan Riley
the whole of the money arising from the sale of 750 acres
of land lying in Montgomery County lying in the Waters of
Grassy Lick Creek a branch of Licking River to her and her
heirs forever.
I
give to my grand daughter Lucy Ann Hamilton the only
surviving child of my deceased daughter Eleanor Hamilton
the following negroes to wit: Sylvia, Bill, Kitty, Alfred,
Dick, Charles and Nelly which said negroes I have lent her
father Charles Hamilton when he married? With my daughter
Eleanor, but at the death of the aforesaid Charles
Hamilton it is my wish that the aforesaid negroes with
both their present and future increase should descent to
Lucy Ann Hamilton and her heirs forever.
I
give to my Grand daughter Hannah Hunter one negro girl
named Violet her and her increase to the aforesaid Hannah
and her heirs forever.
I
give to my Grand daughter one negro girl named Rachel her
and her increase to the aforesaid Mary and her heirs
forever.
I
give to my Grand son Jenkin Phillips son of Thomas Phllips
one negro boy named James to the aforesaid Jenkin and his
heirs forever.
I
give to my Grand daughter Lucy Ann Hamilton one negro girl
named Matilda which said negro Matilda is now in the
possession of her father Charles Hamilton to her and her
heirs forever.
It
is my will and desire that all the rest and residue of my
estate real, personal and mixed be equally divided amongst
all my children and the Grand children of my deceased son
Samuel Phillips and also the Grand children of my deceased
daughter Catherine Hunter ?
the sharesof their deceased ?

? ? ? is to say one equal ? part ?? I hereby constitute and appoint my two sons Thomas Phillips
and Richard Phillips Executors of this my las will and
testament. It
s further my wish and devise that my Executors are not to
give security ?

In a
County Court held in this Jefferson County in a Court
house in Louisville on the eleventh day of February one
thousand eight hundred and twenty two the foregoing
instrument of writing was provided in Court and proved to
be the last will and testament of Jenkin Phillips deceased
of late County by the oaths of Samuel Churchill, John
Downing and James R. Williams the Subscribing witnesses
and thereto and ordered to be recorded and is recorded.
And on the motion of Thomas Phillips one of the Executors
therein named who made oath according to law executive and
letter testamentary of the said will was ?
? him without giving security and
? was given to Richard Phillips the other Executor
named in the said will to ? the ? if he shall choose.
