Mercer County

On this 1st day of October in the year of Our Lord 1832 ???? ?? in open court before the Justices of the County Court of Mercer of said state aforesaid now sitting Charles Hart a resident citizen of said county and State aged 71 years who being just duly sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the late act of Congress.

The 7st day of June 1832 To Wit, I Charles Hart of said County do on my oath declare that I am now Seventy One years of age and that I was born in the State of North Carolina in Mecklenburg County where I resided when the Revolutionary War commenced, and I was called into the service of my country as following To Wit - In the fall of the year 1778 I volunteered for five months in Capt. William Huston's Militia, who was about to march against the Britons in South Carolina, we marched to a place called Smokey Camp and from thence to the Two Sisters in the State on Savannah River. we captured many of the Tories and suppressed several parts with whom we skirmished and when my term expired I was discharged at the Two Sisters in the Spring 1779 and returned home, and again I volunteered under Capt. John Stevens in his company of Militia? men under the command of Col. Fifer of 1779 in the month of June, our services were confined to the three Counties of Anson, Rowan and Mechlenburg to guard said counties against the seizing of the Tories in which we had constant and sever duty until the summer of 1781. At the Battle of Camden I was detached as a private guard a few miles distance I was not in the battle which took place in August 1780 and then the battle of Guilford was fought I was in North Carolina near Wilmington. In the summer of 1781 I volunteered in Capt. Joseph Chinn's company in Col. Fifer's Regiment and marched against the Tories in Wilmington North Carolina and dispersed tho we were stationed near Wilmington which was in the possession of the British. Our Company was mounted near and men and armed with guns and we was kept in constant employ scouring the county until after Lord Cornwallis was taken in October 1781. When the British abandoned Wilmington. During this service Col. Fifer returned home and we were then commanded by Capt Robert Smith and soon after the British left Wilmington. We were marched to Cross Creek now called Fayetteville (I believe) and when we were honorably discharged having been engaged nine months in this service, and in all my service I acted as a faithful soldier and was honorably discharged. I have no documentary evidence, having long since lost my discharge. After the Revolutionary War I lived in North Carolina at my old residence until 1790 -- when I removed to Kentucky where I have resided since and now reside on Chaplin River this County. I further declare that I am not receiving a pension of the United States in of any State and do thusly relinquish all claims I have to said pension except the present. One Henry Shofner, states that he is well acquainted with Charles Hart, that I knew him in 1778 as a soldier in the militia of North Carolina. We were together on several tours in the same company and regiment. We marched side and side and his statements are true.

Francis Adams, of Mercer Co. states he came to America with Count Rochambeau in June 1780 & took the oath of Allegiance to the U.S. & was placed under the command of Gen. LaFayette in Va. Shortly after the war moved to Ky. He was a trumpeter. Was dischaged at Fauquier Co where he resided until 1791 when he removed to Mercer Co., Ky.

I was living with my father at the time George Robards was in the ARW,,after his service he & his brother William Robards entered the militia sometime in 1780 in the same county..after he returned from the last southern services he commanded a part of his neighbors against the refuges & a company of refuges were at my father's house & he had to keep his brother hid out..during the whole time George Robards served I was a member of the family & he served 4 ot 5 years.

In 1791 I removed to Ky., & settled in Mercer Co., Ky. He was a Baptist Peacher.

Col Anthony Crockett: Aug 1832 in Franklin Co., Ky..While I was a Lieut. sd Rice was a soldier & fifer. I have been aquainted with him ever since.

RAY, JAMES: General James Ray, a resident of Mercer Co., Ky., I was first in ths county called Kentucky in 1775. In 1777 I was an Indian Spy for Gen. George Rogers Clark. In Sept 1780 became a Lieut..guard & Indian Spy..then made Capt.

John Gritton Sr.: 7 Jul 1832..I have known General James Ray since I came to this country in April 1780..he was an Officer & Spy for Gen. George Rogers Clark & I served under him. He was in every campaign until peace which was after Gen. Wayne's battle in 1794

Affiant 2: Moore, Thomas, Sr.
Thomas Moore Sr.: 7 Jul 1832..Have known General James Ray since 1780..he was a Spy against the Indians & I have always heard it said he was one of the most active Spies & Officers in the service of the Va. Militia.

Affiant 3: Hutton, James, Sr.
James Hutton Sr.: 17 Aug 1832, age 72..states he was an Ensign under then Capt. James Ray & I came to Ky Mar 1780..& he had been a Spy for several years. He was always the first to be called when there was danger.

Henry Wilson: Of Montgomery Co., Ky..came to Ky in 1779 and Ray was then an active Spy, engaged in constant service at Harrodsburg.

His father's BIBLE has these records: Malachi Randolph was born 17 Jan 1757. Elizabeth Fallon was born 13 Dec 1770 & married 2 Jun 1793. There is also a record: Elizabeth Fallon, dau of Peter & Mary Fallon was born 4 Feb 1770.

MARY MORRIS: Widow of Capt. John Pipes. Marriage record entered: John Pipes & Mary Morris m 23 Aug 1777, Morristown, NJ by Dr. Timothy Johns at the Presbyterian Church. She states she was then in her 17th year. My uncle Major Joseph Morris who was wounded & died at the Battle of Brandywine & buried with honors, was at the wedding. John Pipes was a Lieut during his NJ service. In 1779 or 80 we removed to NC, where his father lived & John Pipes joined the service of NC as a "minute man" & became a Capt. Her husband was in 16 battles. They had 11 children & four were born before the ARW ended. John Pipes died 6 Aug 1821.

He still suffers from injuries of the War of 1812, as testified by two doctors in Harrodsburg.

Francis Adams: Deposes on 13 Aug 1832..That he has known George Phillips before and after the ARW. They entered service together..were part of the army that captured Cornwallis.

Affiant 2: Davis, James
James Davis: 28 Aug 1875..James Davis makes an affidavit in Livingston Co., Mo & whose address is Chillicothe, Mo...he is a grandson of George Nicholas Phillips, ARW soldier, who came with the French Army with Gen. Lafayette & remained in America. George Nicholas Phillips m Sarah Bloom. The mother & father of George N. Phillips were dead before he left France, & he died 18 Jul 1834 in Floyd Co., Ind, age 77. George & Sarah had only one child, America Phillips who married William Davis & they were the parents of this deponent & 3 others. The old soldier was a stone mason by trade & at one time he lived in Rockbridge Co., Va. His widow died in 1870, in Putnam Co., Mo. James Davis is seeking help in locating the rolls of the French army who came with General Lafayette.
