Whereas, in the action of A. R. Bennett, Administrator of the estate of Amos Bennett, Deceased, plantiff against Thomas Bennett et al defendants pending in the Whitley Circuit Court, an order was entered at the november term, 1907 directing E. Foley Master Commissioner of said Court to expose for Sale at public auction, to the highest and best Bidder, the property hereinafter described and
Whereas, said property was sold in accordance with said order on the 6th day of January, 1908 for the sum of two thousand three hundred Eighty five ($2385.00) Dollars, when James Bennett became the purchaser for tract no 4 as shown in the Judgment and order of sale for the price of Nine Hundred ($900.00) Dollars, and
Whereas, the report of said Sale was confirmed by said Court at the March term, 1908 an order was entered directing said E. Foley, Master Commissioner, to execute a deed of conveyance of said property to said James Bennett but for greater certainty, the records and proceedings in said case are here referred to.
Now Therefore this Indenture made and entered into this July 11, 1908, between Thos. Bennett, Benj. Bennett, S. Bennett, P. E. Bennett, James Bennett, Amos Bennett, Vina Rickett, Wm. Rickett, Nancy Croley, Mike Croley, Katie Mays, G. B. Mays, Henry Morgan, Fannie Bird, Tobt. Bird, Ollie Blakley, Will Blakely, A. J. Bennett, Ralph Bennett, Etta Bennett and Nute Bennett. By E. Foley, Master Commissioner of said Court of the first part and James Bennett party of the second part. Witnesseth; That for and in consideration of the payment of the purchase price aforesaid, the receipt whereof is hereby acknowledged, the parties of the first part by E. Foley, Master Commissioners aforesaid, has sold and by his writings do convey to said party of the second part and his heirs and assigns forever, the following described property, to wit: A certain tract or parcel of land lying and being in the County of Whitley and State of Kentucky on the waters of Big Patterson Cr. Containing about 60 acres, more or less, and bounded as follows:
Beginning on a black oak, James Bennett's corner on a ridge, thence with Bennett's line north 18 ½ East 18 poles to a black gum and chestnut oak at the sand rock, thence N66 E. 9 ½ poles to a black gum a spotted oak, an old corner: thence with the old line N. 76 E. 60 poles to a black oak; thence S. 16 ½ E 87 poles to a chestnut on the ledge of rocks near the creek; thence crossing the creek S. 32 E. 8 ½ poles to a stake in the branch ;thence with said Branch S. 66 ½ E.29 poles to a beech Stump, the old corner thence with Whitsetts' line S.6 E.81 poles to a sourwood on top of the ridge, Whitsetts' line and Wiley Bennett's corner; thence with the top of said ridge N.29 ½ W.9 ½ Poles to a chestnut oak on top of the ridge; thence N.52 W.22 poles to two pines, sourwood and maple on a little Ledge top; thence N.73 W.13 poles to a white oak; thence N.63 W.10 poles to a small maples in a drain; thence N.66 @.17 poles to a sweet gum on a rock where the water pours over a cliff near the creek; thence N.1 E.2 ½ poles to a mulberry; thence crossing said creek N.53 W.13 ½ poles to the County road; thence N.32 E.4 poles to a stone; thence N.48 W.18 ½ poles to a hickory; thence n.43 W.34 poles to a black oak and stone in Wiley Bennett's line; thence N.28 W.53 poles to the beginning.

To have and to hold said property, with its appurtenances unto the said grantee and his heirs and assigns, the said Commissioner conveys all right, title and interest, legal and equitable of said Thos. Bennett, Benjamine Bennett, Sam Bennett, P. E. Bennett, James Bennett, Amos Bennett, Vina Ricketts, William Ricketts, Nancy Croley, Mike Croley, Katie Mays, G. B. Mays, Henry Morgan, Fannie Bird, Robt. Bird, Ollie Blakely, Will Blakely, A. J. Morgan, Sam Morgan, Henry Morgan, guardian, Angeline Bennett, Alice Bennett, Ada Bennett, James Bennett Jr., Minnie May Bennett, Rad Bennett, Amanda Bennett, Archie Bennett, Thos. Sears, guardian, Sidney Bennett, Flora Sears, Thos. Sears, Rhoda Meadors, Charlie Meadors, Lula Bennett, Ralph Bennett, Etta Bennett and Nute Bennett in and to said property and warrants the title thereto so far as he is authorized by the judgement, order and proceedings in said cause and no futher, but he does not bind himself personally by anything contained herein in any event whatever. In Testimony whereof, Said E. Foley, Master Commissioner aforesaid, has hereunto subscribed his name this 11th day of July 1908.

Witnesseth: that the parties of the first part, for an in consideration of the sum of $80.15, cash in hand paid, the receipt of which is hereby acknowledged, do hereby sell, grant and convey unto the party of the second part, his heirs and assigns forever, the following described property to - wit, the following described tract of land situated on top of the Mountain between Mulberry and Patterson Creeks in Whitley County, Kentucky, and bounded and described as follows:
Beginning on a stake where a hickory once stood, with chestnut, hickory, dogwood, and wateroak pointers on top of a mountain lying between Veatch branch and Bennetts' Fork of Patterson Creek in Whitley County, Kentucky, being the corner of the patent of land taken out by Amos Bennett in 18; said corner being also a corner of land formerly owned by Cynthia Reynolds, but recently purchased by J. N. Sharp; and is also a corner of tract of land now owned by Dr. A. Gatliff running thence N. 8630 East, 342 ft. to a black oak on the ridge; thence N 40-45 East 590 ft. to a locust stump with a hickory and two black oak pointers; thence N 36-?? East 292 ft. to a stake in the line of the old Veatch patent, (said stake lying S 42-15 West and 337 ft. from a hickory corner on a high point of the ridge) thence S42 - 15 West to a point of the beginning containing 3 25/100 acres more or less, and being a part of the same land deeded to Amos Bennett by deed bearing date (left blank) day of ? 190 and recorded in deed book (blank) page (blank) in the Clerk's office of the Whitley County Court, and which (?same) land was owned by Amos Bennett at the time of his death, and who died in Whitley County, intestate, and left the children herein before named as his children and heir at law and to whom said land descended by virtue of the laws of descendant then in force in this State. To have and to hold unto the party of the second part, his heirs and assigns, forever, with (?sovena?) of General Warranty.

D. Smith and at some acceptable place. If this boundary should touch or take any of the graveyard, it is to be exempt & is not hereby conveyed. This boundary contains 12 acres be the same more or less. To have and to hold the same together with all the appurtenances thereunto belonging unto the party of the second part, their heirs and assigns forever and the said party of the first part hereby covenants with the said party of the second part that they will warrant the title to the property hereby conveyed unto the said party of the second part and their heirs and assigns forever.

Amos Bennett, Jr. (Uncle Bud Bennett) was son-in-law of Thomas Perkins. Amos purchased the home of Thomas Perkins from his heirs and Amos & Nancy Bennett were living there in 1906 when there was a dynomite explosion in the railroad cars just below their home in Jellico, KY/TN. Amos was injured when stones fell from the chimney as he was walking around the house. He died three days later from the injuries.
