In Debt

This day came the parties by their attornies and thereupon came a Jury of good and lawful men towit: William Adair, Sharp Whitely, Middleton McDaniel, Isaac Absher, Thomas Lovelady, Morgan Deweese, Michaiel Lowrey, Jonas Turner, Anderson McFarlane, Sampson Mooney, Phillip Ussery and John Goad, who being elected tried and sworn the truth to speak upon the issue joined upon their oath do say that the defendant oweth unto the said plaintiff for the use of the sum of one hundred dollars the debt in the declaration mentioned and that the writing obligatory declared on is founded upon a fair and bonafide consideration, that the plaintiff hath sustained damages by occasion there of to the sum of twenty two dollars besides costs.  Therefore is considered by the court that said, James W. Smith to the use of John H. Marable recover against the defendant the sum of one hundred dollars, the debt in the declaration mentioned together with the damages aforesaid, in manner and form aforesaid assessed together with his costs by him about his suit in this behalf expended &c.
