This day came as well the Solicitor for the County of White as the defendant in his proper person being arraigned and charged upon the bill of indictment
pleaded not guilty thereto and for his trial put himself up on the Country whereupon came a jury of good and lawful men Towit: William May, Cornelius Broyles, Thomas Lewis, Isaac Absher, Jacob Beam, Phillip Ussery, John Nash, and
Wyatt Russell, who being elected tried and sworn the truth to speak upon the issue of traverse joined upon their oath do say that the Defendant is guilty in manner and form as charged upon him in the bill of indictment as the
Solicitor in replying hath alleged - it is therefore considered by the Court that the State of Tennessee for such offense of the Defendant recover against him the sum of one dollar with the costs in this behalf expended and be in
the mercy &c.Whereupon the Defendant is prayed in custody of the sheriff of White County there to remain until he pays the fine and costs where give security for the payment of the same whereupon came David L. Mitchell and
John Goard and agreed and become responsible for said fine & costs and that execution may issue against and jointly with the defendant for the collection thereof. |
