This day came the defendant and declared that he intends no further prosecuting the Certiorati in the above cause and thereupon assumes the payment of all cost.  Therefore it is considered by the court, that the plaintiffs recover against the defendant and Henry McElhiney and William Shockley his securities all costs in this behalf expended as aforesaid.
