Will of Jane Heard
Pettis County, Missouri
I Jane Heard now of the County of Pettis and State of Missouri do make this my last will and testament hereby revoking all former wills by me heretofore made.
1st My funeral expenses are to be paid.
2nd I give to my Son William Wolfskill three hundred dollars.
3rd I give to my daughter Elizbeth Downing a note I hold on Washington Walker for about $50 which is in her possession.
4th I give to my son John Heard One hundred and twenty dollars.
5th I give to my son George Heard One hundred and twenty dollars.
6th I give to my grandson William W. Bowlen one hundred dollars.
7th I give to my daughter Mary Broadus two hundred dollars.
8th I give to my two grand daughters Barthena Gray & her sister Jane Downing each Fifty Dollars.
9th I give to my daughter Margaret Arnold one dollar which with what she has gotten I think her full share.
In conclusion I will remark that I hold a note on D. Gray and others for $1386.66 1/2 on which I have collected $540. I also hold a note on John Copeland for $400 which with note willed to Elizabeth Downing is all I have, out of which I owe to George Heard $38.12 for money he advanced at my request to John Copeland which is to be paid out of my said note to Gray & others.
Now if from any cause my effects should not be sufficient to pay the legacees herein bequeathed, each legatee is to lose equally share and share of the defect alike, and if more than enough to pay all said legatees, the excess is to be equally divided between the legatees herein mentioned except Margaret Arnold.
Lastly: I hereby appoint my son George Heard executor of this my last will and testament and having full confidence in his solvency and integrity. I desire that he not be required to give any bond and security for the faithful compliance with the requirements of this will.
In testimony whereof I hereunto Set my hand and affix my seal this 29th day of December 1860.
Signed, sealed and acknowledged the above Said Jane Heard to be her last will and testament in the presence of us, who at her request and in her presence and in the presence of each other have subscribed and named as witnesses thereto this the day and date above written. State of Missouri, County of Pettis
Be it remembered that on this 4th day of November 1861 personally appeared before the undersigned Clerk of the Pettis County Court, John T. Heard and H.L. Andrews two of the subscribing witnesses to the annexed will of Jane Heard and being by me first duly sworn, depose and say that the said Jane Heard the testatrix caused her name to be subscribed to the same in their presence and published the said will or instrument of writing as her last will that she the said testatrix was at the time of publishing the said will of Sound mind and more than twenty one years of age and that they the said deponents attested she said will as witnesses thereto by subscribing their names to the same in the presence of said testratrix.
