Dec. 10, 1852

In the Name of God Amen. I, John Howe of the State of Missouri and County Pettis do make my last Will and Testament.

1st That all my lawful debts be paid.

2nd That my dwelling house with half my plantation land and timber be given to my daughter Mary Jane Creel and her offspring that the other half of said plantation land and timber be given to my Grandson John Howe Miller to be theirs forever after my decease. I give my other children what I conceive to be their portion of my earthly substance.

3rd I will that my servant man Isaac be freed from the ownership and bond service of all human beings down to the end of his natural life.

Given under my hand and seal the day and date written above.

Witnesses - Ezra Landau Sen'r, Joseph H Howe

State of Missouri, County of Pettis

This affiant Ezra Landau Sr upon his oath stated that he is a subscribing witness to the last will and testament of John Howe late of Pettis County dec'd (to which this is attached) that he subscribed his name thereto at the request and in the presence of the testator, that the said testator acknowledged and published the said writing as his last Will and Testament, and that at the time of Testator so publishing and acknowledging of the same affiant believed him to have been of sound and disposing mind. This affiant Joseph H Howe, upon his oath states that he is a subscribing witness to the last Will and Testament of John Howe, late of said county dec'd (to which this affidavit is attached). That he subscribed his name thereto at the request and in the presence of the testator, but at a different time from the other subscribing witness, that the said testator acknowledged and published the said writing as his last Will and Testament and that at the time of testator so publishing and acknowledging the same affiant believed him to have been of sound and disposing mind. Missouri to wit: At County Court held for Pettis County at the Court House in Georgetown the 2nd day of February last.

The last Will and Testament of John Howe dec'd proven in vacation was this day presented in Court the affidavits and proofs thereof examined & being approved by the Court is ordered to record.

Whereupon the same is truly recorded in my office.
