Be it remembered by all to whom these presents may come that on this the seventh day of December A.D. 1887-that I Michael Maloney being of a sound and memory do make this my last will and testament That is to say that I bequeath at my death to my well beloved daughter Mary Ann Nahn the present wife of James Nahan during her life time and at her death to her children-The following described real estate to: wit: lot no. three in Block no. (65) in the county addition to the City of Rolla County and State aforesaid also lot no. six (6) in the Rolla Mill addition to the City of Rolla in the county and State aforesaid. Also all of the household and kitchen furniture that I may be possessed of at the time of my death. In testimony whereof I have set my hand and seal the day and year above written.

I hereby certify that the above will and testament was duly signed by the testator in my presence and at the time of so doing he was to all appearances sound in mind and memory I further certify that the same was signed in the presence of the subscribing witnesses given under my hand on this 7" day of December A.D. 1887.

Be it remembered that on this eleventh day of Aug. In the year of Our Lord 1892 before me William R. Keithly a notary public of the county of Silverbow and State of Montana, James T. Graver. who being duly sworn upon his oath deposes and says that I was present and saw Michael Maloney sign the foregoing instrument, purporting to be the last will and testament of him the said Michael Maloney and heard him publish and declare the same to be his last will and testament, and that at the time of signing the same the said Michael Maloney was of sound and disposing mind, and memory and that deponent and Emanuel M. Newman the other attesting witness subscribed their names thereto as witnesses to the same in the presence of the testator, and of each other, and at the request of the said Michael Maloney.

I W. J. Salts Judge of the Probate Court of Phelps County, State of Missouri having examined the foregoing instrument, purporting to be the last will and testament of Michael Maloney dec'd. and signed by Michael Maloney and heard the testimony of James G. Graeber and Geo. H. Hume subscribing witnesses thereto in relation to the execution of the same, do declare and adjudge said instrument to be the last will and testament of the said Michael Maloney deceased, late of Phelps County, Mo.

In testimony whereof I have hereunto set my hand and affixed the seal of said court at office in Rolla, Mo. this 10" of September 1892
