FINLY,  James H.  28 m w fmr TN
James Henderson FINLEY / FINDLEY was born in Tennessee in 1831; s/o George William Findley & Menerva Jane Spence who m 8 March 1824. George and Menerva's Marriage Certificate was signed by James Findley and Robert Spence.  Menerva Jane Spence's parents were Robert Spence & Margrett Lovey SEXTON; Margarett Spence was born in North Carolina in 1775. Robert Spence lived in Roane Co TN at the time of George and Menerva's marriage.  Margarett is buried in the Hensley cemetery just north of Mansfield, MO.
    George and Menerva Findley had 6 children:
1. Margarett Findley was b in TN in 1828; 2. Emeley Findley was b in TN in 1829; 3. James Henderson Findley was b in TN in 1831; 4. Thursda Findley was b in TN in 1833; 5. William Findley was b in MO in 1837; 6. Louisa Findley was b in MO in 1840; George and Menerva FINDLEY moved to what was then Pulaski Co MO, but is now Wright Co MO, between 1835 and 1837. George FINDLEY shows up in the 1840 census in Pulaski Co MO and Menerva shows up in the 1850 census as a widow, so George FINDLEY must have passed away between 1840 & 1850.  George was born sometime between 1800 and 1810 according to the 1840 census he is listed between the age of 30 - 40. They may be buried in the Hensley Cemetery with just a stone as a marker. There are a lot of Spence's buried there along with James Henderson Findley's first wife Catherine (MOORE) FINDLEY.  James Henderson FINLEY 2nd m Abby J. (?) KITSELL, see 1870 Wright Co MO #802 he is 38, Aby J. 32, George N. 12, Penelope Ann 12, James H. 10, Mary L. 8, & John B. 6, California POOL 2, & Mary E. KITSELL 5;
My favorite story of all the ones we discovered in researching my Great Grand-father, James Henderson Findley: He had lost his first wife, Catherine (Moore), leaving him with five small children. A circuit riding preacher told him of a lady
in Taney County who had lost her husband in a mill accident. Her name was Abby Jane (?) Kitsell and her daughter was Mary.  James put the children in the cabin with sufficient food for a week, put the dog inside with them for protection, nailed the door shut from the outside, and rode his horse to Taney County from Wright County to get Abby and her daughter.  He supported them and she raised the kids.  Mary grew up, married a Freeman and is the mother of Oscar “Toss”, Ed, and Arthur Freeman. nee: Frances JONES b 11 Oct 1791 Wilkes Co NC d 8 Feb 1863 Wright Co MO; d/o Benjamin JONES & Elizabeth FOSTER; a marriage bond of 500 pounds was given by his father, Jesse ROBINETT Sr, and his brother Allen, before William B. ENOIR, s/o Ren William LENOIR, the bond is on file in the State Dept of Archives & History at Raleigh NC, Jesse Jr m 7 Feb 1807 Wilkes Co NC to Jesse ROBINETT Jr. b May 1870 on the James River in Botetourt Co VA d 8 Oct 1845 Wright Co MO both bur Robinett Cem on White River Trace 6 miles East of Hartville Wright Co MO, Jesse spent his youth on the Yadkin River in NC; He & his family moved from Wilkes Co NC to Bedford Co TN in 1828; shortly after 1832 he joined two neighbors in a trip to the west which they made on horseback. He headed for Springfield MO which was then the headquarters of the Land Office of SW MO. He explored even farther      to the area between Springfield & what is now Kansas City but the Ozarks area with its clear streams, springs etc appealed to him & he decided that area would be his future home; he returned to TN, sold his holdings on Duck River in Bedford Co, near Shelbyville in 1838 for the sum of $3250. He packed up with a caravan including his family, relatives & a large number of Slaves. At the TN River they constructed rafts & floated down stream to the Ohio River, thence to the Mississippi to a point locally known as Jackson’s Landing in MO where they went ashore  & began the more difficult part of the journey overland. The trails had become so rough & frozen ground lamed the oxen. On 4 Nov 1838 he was forced to halt for the winter at a place later known as Gobbler Bottom on the Gasconade River. He found a squatter & paid him to move on & took over the cabin & built others of logs. He liked the location so well he went to Springfield & bought his first holdings in what was then Pulaski Co MO but later was Wright Co.  He continued to acquire land as did others of his large family. Taken from part V B, Allen Robinett and his Descendants in America; 1850 Wright Co MO #538;

Jeremiah FLY, b ca 1773/4 married ZILPHA PIPKIN in 1798 in Davidson
Co TN. The Bond, says, "Jeremiah FLY hath prayed and obtained bond to Marry Zilpha PIPKINS." The word was "marry". The clerk indexed the document as "Jeremiah Fly m Mary Z. PIPKINS", the document itself refers to "Zilpha" three times, -"Mary" not at all. The Index is plainly wrong about the "Mary". It does say, "PIPKINS", but it is known that the family was "PIPKIN". It was a plain case of Clerk's error. The bride was "Zilpha" not "Mary Zilphia". The Elisha FLY Family Bible, shows "Zilpha"; 1870 Wright Co MO #660 Elisha age 57, Anna 57;

EATON, William  51 m w fmr TN
In the 1850 census, William, Annie, and their children are living in Wright Co
MO #425.  William is shown as 40 yrs of age, born TN, Annie, 35, also b TN, Thomas is 14, b. AR, John, 13, b AR, Tammerless, 10, b AR, and Henry, 7, b AR, Mary is 3, b MO, and Phoeba is 1, b. MO.  Four houses away from the EATONS are the ABSHIRES:  Ceton, 39, b. VA, wife Elizabeth, 35, b. TN, John, 17, b. TN, James, 16, b MO, Polly (or Dolly), 13, b MO, Milly, 11, b MO, Nancy, 9, b MO, Elizabeth 7, b MO, Catharine,4, b MO, Edina, 4, b MO, and Isaac, 4 months, b MO.  This family has two children that married two of William Eaton's children:  (Catherine) Tammerless married John Abshire, and Thomas J., married Catherine Abshire. Anna is related to the Forrest/Forrist family who also lived in Wright County at that time.  When William died, Annie's nephew James (son of her brother John Joshua James Forrest) was the probate judge and he signed the Probate Court Order in the Regular August Term in 1868. After William’s death in 1867, and the settlement of the estate in February 1869, apparently both Henry and Thomas moved with Anna south to Butler County, MO where they are found in the 1870 census in Thomas Twp. Henry’s wife Margaret and Henry are both shown as 26 years of age, with a seven year old daughter Mary, 7, born MO.  Thomas and Catherine are living next door and his mother Anna is living with them, along with Thomas' young-est brother, William A, 13 at the time. By 1880, Annie has moved to Texas, and is living in Young County, Texas, in the 4th Precinct.  Living with Annie is William A. 18. Also living with William and Annie is Betsy A. Abshire, 13, listed as daughter, born Ill; and James C. 5, grandson, born TX, father born MO, mother born AR.  Cleta Terrell (cterrell@juno.com) states that Catherine Lemaralice Eaton married James C. Abshire.  Betsy A. Abshire could be James and Catherine's daughter, and James C. 5, their son.  Where they were when the census was taken is unknown at the present. Annie’s son Thomas and daughter in law Catherine have also moved to Texas in 1880, and are living in Wise County, the 7th Precinct.  Living with them are a son, Henry M., 6, born AR, a daughter Elmira, 4, born TX, another daughter Julie A, 2, also born TX, and a one yr old daughter Rhoda D., also born TX.  Living next door to Thomas and Catherine are what is most probably her parents, Seaton (70) and Elizabeth (65) Abshire, along with their 20 year old son, Andrew J., who was born in MO.
Wright County MO Probate Court Records for 1853-1871 (FHL Film #0941340) shows the probate settlement of William Eaton’s estate, and the resulting sale of the real estate owned by William Eaton to pay debts.  This probate begins in May 1867 and concludes in the February 1869 term with the final settlement of William’s estate . . .”appearing to the satisfaction of the court from his account current herewith filed that he (admr) stands charged with the sum of one hundred and ninety three dollars and twenty three cts and it also appearing from his vouchers herewith filed numbering from one to seven that he is entitled to a credit of the sum of one hundred and ninety three dollars and twenty three cts leaving nothing in the hands of said administrator in favor said estate and it further appearing to the court that said admr has faithfully administered said estate and that he has advertised this final settlement according to law it is therefore ordered by the court that said admr be relieved from all liabilities on said estate and that he go hence without day.  This final settlement being seen and fully understood is by the court approved and the account current and vouchers filed.”
One of the records of the Probate Court that is a little distressing, is taken from the regular August term in 1868.    . . . “administrator of Wright County having in his care and custody the estate of Wm. Eaton decd and states that in obedience to an order of this court made at its February term 1868 he proceeded to sell the real estate of the said decd at the court house door in Wright County on Monday the 11th day of May 1868 after having given the notice required by law and the order of this court the following described real estate . . . containing 120 acres more or less and at said sale Marinda Moore being the highest and best bidder for the sum of one hundred and ninety three dollars and twenty five cents and the same was stricken off to her accordingly for cash in hand said land was sold subject to the dower interest of the widow of  said decd said admr further states that previously to the said day of sale the above named real estate was appraised by three disinterested householders to the sum of four hundred dollars all of which will fully appear by reference to the certificate of appraisement of said appraisers herewith filed said admr further states that he did not directly or indirectly purchase said real estate or any interest therein and that he is not interested in the real estate sold except as administrator as aforesaid.” Researcher Evelyn Canning  Tom & Ev <tomevcan@earthlink.net>
