WHEREAS it is a matter of importance that highways should be laid
out
in the manner prescribed by
the law Also the proper boundaries should
be kept up, whereby the several
inhabitants living upon the several
roads may know where to lay
their fences, and overseers of highways
may know where to expend their
labor assessed upon their district in
a legal manner, and many other
reasons which might be offered, and
whereas many of the roads
in this town were laid out when (this)
country was almost covered
with timber, of which the
Commissioners of Highways
made their boundaries, and which have
since decayed and totally
disappeared so that it has become
exceedingly difficult and
in some cases impossible to ascertain where
they were situated, whereby
contentions have risen among the
inhabitants whose lands are
bounded by the roads running by them,
and the community have suffered
in no inconsiderable extent, and
whereas prudence dictates,
and experience teaches, that a remedy be
applied before the evil shall
have extended further, and to effect
which the following resolutions
is respectfully submitted
RESOLVED that the Commissioners of Highways shall traverse such
highways as may have been
laid out more than five years, and place
new boundaries wherever necessary,
and when it shall happen that
they cannot trace the old
survey, the commissioners shall lay out the
road anew upon the old route,
or as may be the best of their
judgement, and cause the same
to be recorded
