**The 64th, the Cattaraugus regiment, was the outgrowth of the 64th
militia and was recruited at Gowanda, Randolph, Otto, Rushford,
Ithaca, Little Valley, Wellsville, Owego Olean and Leon. It was
mustered into the U. S. service at Elmira in Dec., 1861, for
three years; left the state for Washington on Dec. 10; was
quartered near the capitol; in Jan., 1862, was assigned to the
provisional brigade of Casey's division; on March 13, it became a
part of the 1st brigade, 1st division, 2nd corps, Army of the
Potomac, and proceeded to the Peninsula with the general advance
under McClellan.

* son of Henry SAXTON was born in Vermont and came to Ellicottville as a
clerk in 1817 or '18 for Baker LEONARD
whose widow he married. He died of cholera in Louisville, Ky., in 1834, aged
thirty-four years. Mr. SAXTON possessed great energy and large natural
resources, and was a leading citizen of the town and county. He was elected
sheriff in 1828, which position he resigned at the beginning of the last
year of his term. He was a prominent merchant in Ellicottville and had
branch stores in Springville and Randolph; he was also an extensive dealer
and manufacturer of pine lumber. He leased a mill-site on the Allegheny
river where Salamanca now is and there built the first mill, and used the
river as a highway to convey his lumber to market. Henry SAXTON was
supervisor of Ellicottville in 1828.

Hannah L. SAXTON, widow of J. King SKINNER, resides on the homestead where
she was born, and which now shelters three generations of the family.
Baker Leonard SAXTON, who enlisted in Co. A, 154th N. Y. Vols., for three
years, re-enlisted in the 179th N. Y. Regt. as first lieutenant, and was
killed in front of Petersburg.

This Company was originally recruited by Capt. N.S. Scott, in the towns of
Hanover, Villenova, Cherry Creek and Arkwright. Capt. Scott commenced his
canvass for the Company July 23. The 4th of August the Company was full, and
on the 12th, he went with them to Jamestown, having 108 men. A lawyer by
profession, Capt. Scott left a lucrative practice in Forestville to accept
his position in the Regiment. His powers of endurance were overtaxed on
severe march up and down the Peninsula of Virginia in July, '63, and seeds
of disease sown, which began to develop soon after the Regiment returned to
the defenses of Portsmouth. He was sent to the County on recruiting service
July 24th, and was taken down with serious illness, from which he did not
recover for more than a year. Meanwhile, in February, '64, he returned to
the Regiment in the Department of the South, hoping in that mild climate his
system might regain its healthy tone. His hopes were disappointed and with
regret he was compelled to resign his position and retire from the service,
May 27, '64.

JOHN DEMPSTER SCUDDER AND HATCHER'S RUN
The American Civil War started in April, 1861, and the last shots, or nearly
so, were fired in April, 1865. For forty-eight long months the killing went
on, most of it in small places. Battles, "engagements" and "skirmishes" took
place at crossroads, beside creeks, in wood lots and cornfields and
orchards. The names were made famous; the larger the battle, the greater the
recognition. Some battles were big enough, or important enough, or notorious
enough to achieve a kind of immortality even among people who have little
interest in that war. Bull Run, Fredericksburg, Antietam, Gettysburg,
Vicksburg, Chickamauga, Shiloh. Events in other places are more obscure.
Hatcher's Run was one of those.
John Dempster Scudder's Civil War experience was in that place. He was
37-years-old when he enlisted on September 4, 1864. The war was winding
down, but its outcome was not by any means a certainty. The best hope the
Confederate States of America had at this point was the possible failure of
President Lincoln's bid for re-election. That was very much in doubt.
Lincoln himself was pessimistic. All knew he would prosecute the war to the
last. Whether another would do so was questionable.
What motivated a man, of that age, with a family, to sign up so late? Was it
bounty money that he felt he needed for his wife and child? Or was it
something more important to him, something to do with his immediate
ancestors and their participation in wars?
John Dempster's father was Joel SCUDDER , veteran of the War of 1812. Joel
participated in that conflict at the age of 19. Joel's father was Ezekiel,
who served as a Private in the New York Militia during the Revolutionary
War. He was in his teens. Ezekiel's father, Joel, served in the
Revolutionary War as well.
Father, grandfather, great grandfather, great-great grandfather - all went
to war in some fashion. Did John Dempster Scudder feel he needed to do
likewise? Perhaps.
John was assigned to Company A, 188th Infantry Regiment, New York, which was
mustered in October, 1864 at Rochester, New York. Within a week, the
regiment was fighting the first battle of Hatcher's Run. The second battle
in that place was three months later.
Hatcher's Run - Again
The siege at Petersburg, Virginia went on for months, with the two sides
facing each other and little real "action" taking place. There were some
dramatic moments, such as the battle of the "crater," but most of the time
not much of note - to the world at large - was happening. The excitement was
in other places, with Sherman's forces through Georgia and South Carolina,
and with Hood at Nashville. In early February, General Grant launched
another offensive aimed at cutting off Confederate supplies by ending the
wagon traffic on Boydton Plank Road. His plan was to send cavalry out to
destroy as many wagons as they could find, while the V and II Corps provided
support and kept the Confederates occupied. General Lee, fearing for the
safety of both the Boydton Plank Road and the South Side Railroad, had
Generals A.P. Hill and John Brown Gordon assume the offensive against this
movement. The Union dug in and repulsed three separate attempts to break
their lines.
The Confederates initiated the attack in the afternoon hitting the Union
troops from the east and the south. Finally, in the late afternoon, the
Confederate drive was stopped by Union reinforcements. The Union troops
struck back and in the fighting re-took their positions and drove the
Confederate forces back inside their main defenses.
After dark the Union troops fell back across Hatcher's Run and started
extending their lines once more. The Confederates had saved Boydton Plank
Road but the Union had gained a good staging point for future offensives.
This action took place over three days - February 5-7, 1865 - and is called
the second battle of Hatcher's Run. Most histories of the Civil War give it
little more than a footnote, if that. It was notable chiefly because one of
the Confederacy's favorite sons, young General John Pegram, was killed in
the action. There were a total of about 48,000 soldiers engaged, with 2,700 killed.
So those were the statistics. The engagement of Hatcher's Run was a minor
victory for the union; 33-year-old Pegram, General of the Confederate States
of America was killed; and 2,700 others lost their lives. One of the
"others" was
John Dempster Scudder.
