I, William Rice of the Tovnship of Elk Creek, County of Erie, State of Pennsylvania, being of sound mind and memory do make and ordain, publish and declare this my last will and testament in manner and form following to wit; that is to say:
First: I give and bequeath unto the American Board of Foreign Missions the sum of one thousand dollars to be used for the spread of the Gospel in Foreign Countries.
Second: I give and bequeath unto the American Home Missionary Society the sum of one thousand dollars for the use of Home Missionary purposes.
Third: I gave and bequeath unto my son Almon Rice the use and occupancy of thc farm on which he now lives; also all the land formerly owned by Alsina Battles; Also all the land I bought from Ann Morgan; also the land I bought from Betsey McCumber being situate in Elk Creek Township, Erie County, State of Pennsylvania, during his natural life and at his decease to be divided equally between his four youngest children now living.
Fourth: I give and Bequeath unto my son Joseph Rice the use of the farm on which I formerly resided in Taylor, Cortland Co., N.Y. being part of Lot 99 and supposed to contain one hundred acres during his natural life and at his decease to be divided between his three heirs by his first wife share and share alike.
Fifth: I give and bequeath to my brother Stillman Rice the use of eight acres of land on Lot #28 in Cincinnatus, Cortland Co., N.Y. bounded as described in a deed from Orrin Harrison to me during his natural life and after his decease to go back to my sons Jason, Joseph and William Rice and their heirs.
Sixth: I give and bequeath to my sister Polly Burch the use and occupancy of the farm on which she now lives together with her husband during their natural lives or so long as they live and remain on said farm and no longer and at their decease the same to revert to my sons Jason, Joseph and William Rice or their heirs.
Seventh: I give and bequeath unto Russell Armstrong forty acres of land situate in Cincinnatus, Cortland Co., N.Y. taken off from the north line from the lot which I purchased from Michael Merrical running a parallel line from the east line to the west line of said farm during his lifetime and then to go to his children and to them only.
Eighth: I give and bequeath to my daughter Phebe Ann Clark the sum of $5.00.
Ninth: I give and bequeath unto my daughter Betsey McElvain the use of the farm on which she now lives situate in Cincinnatus, Cortland County, New York excepting forty acres as above disposed of to Russell Armstrong during her natural life and at her decease to be divided equally with her children and to them only.
Tenth: I give and bequeath to my sister Lydia McWhorter if living and can be found $200.
Eleventh: I give and bequeath to my daughter Betsey McEliaire in addition to the above bequest a yearly annuity of $50 payable as follows: $25 on May 15 and Nov. 15 of each year during her natural life.
Twelfth: I hereby further ordain order and determine that after paying all my debts and funeral expenses that then all my remaining estate both personal and real if any shall be divided between my four sons as follows to Almon Rice 1/4; of all my personal and real estate; to Jason Rice 1/4 of all my personal and real estate during his natural life and at his decease to be equally divided among all his children and to William and Joseph Rice each -1/4 of all my personal and real estate.
Thirteenth: I do hereby constitute and appoint Jason Rice of Cincinnatus Cortland Co., N.Y. to be the Executor of this my last will and testament hereby revoking all other Wills by me at any time heretofore made.
