Abstract: Deed from Jacob Seaman and Sutton Seaman Execr’s of the last will and testament of Robert Seaman late of Fishkill to Henry Hull of Fishkill, for $2000, two parcels of land in Fishkill, the first just over 54 acres and the other just under 20 acres, dated 20 April 1846, recorded 6 May 1846. Transcription:
This Indenture made the twentieth day of April one thousand eight hundred & forty six Between Jacob Seaman & Sutton Seaman executors of the last Will & Testament of Robert Seaman deceased of the town of Fishkill County of Dutchess & State of New York of the first part and Henry Hull of the same place of the second part Witnesseth that the said parties of the first part by virtue of the power and authority to them given in by the said last Will & Testament & for & consideration of the sum of Two Thousand Dollars lawful money of the United States of America to them in hand paid at or before the ensealing & delivery of these presents by the said party of the second part the receipt whereof is hereby acknowledged & the said party of the second part his heirs executors & administrators for ever released & discharged from the same by these presents have granted bargained sold aliened released conveyed and confirmed & by these presents do grant bargain sell alien release convey & confirm unto the said party of the second part his heirs & assigns forever All that certain piece or parcel of Land lying and being in said town & County bounded as follows Beginning at a [?] in the road twenty nine links south of a locust tree marked standing on the north side of said road being the south east corner of said Jacob Seamans land thence south sixty sixty [sic] six degrees east two chains eighty five links thence north eighty one degrees east five chains fifty seven links thence south eighty three degrees east three chains twenty five links to a stone set on the north side of the road thence south fifty one degrees forty five minutes east seven chains fifty eight links thence north forty two degrees thirty minutes east eight chains eighty links thence north twenty nine degrees thirty minutes west five chains eighty nine links to a butternut tree thence north twenty four degrees west twenty eight chains to Daniel Seamans corner thence along his line south fifty five degrees west fourteen chains seventy two links to a stone in the ground being the corner of Daniel Seamans land thence along his line South sixteen degrees east sixteen chains six links to a yellow oak tree marked being Daniel Seamans south east corner thence south seventy degrees fifteen minutes west two chains twenty three links to a stone heap thence south seven degrees thirty minutes east seven chains twenty nine links to the place of Beginning Containing Fifty Four Acres one rood [1 rood = ¼ acre] & eleven rods of Land. Also one other piece or parcel of Land lying in said town & County bounded as follows Beginning at the northeast corner of Daniel Seamans land formerly John I. Carmans being a heap of stone around two walnut sprouts thence along Daniel Seamans line south twenty degrees fifteen minutes west five chains thirty five links to a stake & stones thence north eighty five degrees west four chains forty four links to the road thence south one degree thirty minutes east four chains thirty nine links to a chesnut tree marked being the corner of land set off to the widow thence south fifty three degrees thirty minutes east seven chains thirty four links to a chesnut tree marked being a corner between Henry Lee & Sutton Seamans thence south sixty nine degrees east nine chains eighty links to a stake & stones thence north seventy one degrees east three chains eighty six links to a black birch tree marked standing on a rock being Robert Seamans Junr. south west corner thence along his line north sixteen degrees fifteen minutes west fourteen chains seventy links to a stake & stones thence north seventy eight degrees thirty minutes west three chains seventy five links to a chesnut tree marked thence north eighty six degrees west two chains thirty two links to a chesnut tree marked thence north seventy seven degrees fifteen minutes west two chains fifty links to the place of Beginning Containing Nineteen Acres two roods & thirty two rods of Land be it also remembered that a part of this last described piece of land lies in the town of Beekman. Together with all & singular the [tenements stricken out here and possibly hereditements as well] hereditements edifices buildings rights members privileges advantages hereditaments [sic] & appurtenances to the same belonging or in any wise appertaining & the reversion & reversions, remainder & remainders rents issues & profits thereof And also all the estate right title estate interest claim & demand whatsoever both in law & equity which the said testator had in his life time & at the time of his decease & which the said parties of the first part or either of them have or hath by virtue of the said last Will & Testament or otherwise of in & to the same & every part & parcel thereof with the appurtenances To have & To Hold the said premises above mentioned and described & hereby granted & conveyed or intended so to be with the appurtenances unto the said party of the second part his heirs & assigns to hold their only proper use benefit & behoof forever and the said parties of the first part for themselves severally & respectively & for their several & respective heirs executors & administrators do severally & not jointly nor the one for the other or others of them but[?] for the heirs executors administrators or acts or deeds of the other or others of them but each & every of them for himself only & for his & their heirs executors & administrators & their several & separate acts & deeds only covenant grant promise & agree to & with the said party of the second party of the second part [sic] his heirs & assigns That the said party of the second part his heirs & assigns shall & lawfully may from time to time & at all times for ever hereafter peaceably & quietly have hold use occupy possess & enjoy all & singular the said hereditements & premises & take the rents issues & profits thereof to & for their own use & benefit without any lawful let suit hindrance molestation interruption or denial whatsoever of from or by them the said parties of the first part their heirs or assigns or of from or by any other person or persons whomsoever lawfully claimed or who shall or may lawfully claim hereafter by from or under them or either of them or by from or under their or either of their right title interest or estate & that free & clear & freely & clearly discharged acquitted & exonerated or otherwise well & sufficiently saved defended Kept harmless & indemnified by them the said parties of the first part their heirs & assigns of from & against all & all manner of former & other gifts grants bargains sales mortgages judgments & all other charges & incumbrances whatsoever had made committed executed or done by them the said parties of the first part or by through or with their or either of their acts deeds means consent procurement or privity. On the fourth day of May in the year one thousand eight hundred & forty six Jacob Seamans & Sutton Seamans whom I know to be the individuals described in & who executed the within conveyance personally came before me & severally acknowledged that they executed the same Wm Homan Justice of the peace of Dutchess County.
