Whereas,
James Van Etten and Rebecca his wife of the town of Catskill in the county of
Greene have this day sold and conveyed to Abraham Dedrick of the place aforesaid
the following piece or parcel of land viz :
All that certain piece or parcel of land situate in the town of Catskill
in the county of Greene being part of lot No. 5 of the subdivision of lot No.14
. Catskill patent, beginning at a small black oak tree, with stones around it,
being the south west corner of lot
NO.4 and running from thence south two degrees and thirty minutes east sixteen
chains and fifty links to a stake
and heap of stones about two and one half feet west of a Rock oak tree marker, then south eighty one degrees and fifteen
minutes. East, twenty four chains
to a Rock oak tree with stones around it, then north twenty four degrees and
forty five minutes, East sixteen chains and eighty five links, to a stake and
stones and then North eighty
one degrees and fifteen minutes west thirty one chains and
sixty one links to the place of beginning, containing forty four and 3/10
acres of land for the consideration of three hundred and twenty dollars being
the fair value of the same: And Whereas
by the reason of the advanced age and infirmities of the said James VanEtten
doubts exist as to his competincy to convey real estate, and
Whereas Lavinia Timmerman the wife of Jacob Timmerman, Leah Barlow
the wife of Benjamin Barlow, Maria Whitney the wife of Robert Whitney and
Abraham Timmerman the son of said Jacob Timmerman by Rachel Timmerman his former
wife, (which said Abraham Timmerman is under the age of twenty one years) are
the legal heirs of the said James
Van Etten: Now therefore
this Indenture Witnesseth, that the said Jacob Timmerman and Lavinia his
wife, Benjamin Barlow and Leah his wife, Robert Whitney and Maria his wife, for
in consideration of the premises and for and
in consideration of the sum of Three Hundred and Twenty Dollars to them
in hand paid by the said Abraham Dedrick, the receipt where of is hereby
acknowledged, have and do hereby remise, release and for our Quit-claim, unto
the said Abraham Dedrick his heirs and assigns forever the afore said premises
piece or parcel of land. Together with all and singular the privileges,
advantages hereditaments and appurtenances to the said premises belonging or in
any wise appurtaining: and the version and reversions, remainder and remaining
rents issues and profits thereof; and all the estate, right, title, interest,
property claim and demand whatsoever, both in law and equity of the said Jacob
Timmerman, and Lavania his wife, Benjamin Barlow and Leah his wife, and Robert
Whitney and Maria his wife, or either of them of in or to the same, every or any
part or parcel thereof, to have and to hold, the above released premises with
appurtenances, unto the said Abraham Dedrick, his heirs and assigns to the only
proper use of the said Abraham Dedrick his
heirs and assigns forever and the said Jacob Timmerman and Lavinia his wife,
Benjamin Barlow and Leah his wife, Robert Whitney and Maria his wife, for
themselves and their heirs, all and singular the premises, mentioned to be
hereby released and every part and parcel thereof, with the appurtenances unto
the said Abraham Dedrick his heirs and assigns, against all and every person and
persons whomsoever lawfully claiming or to claim the same from by or under them,
shall and will warrent and forever defend
by these presents and the said Jacob Timmerman and Neely Lawrence specially
covenant, with the said Abraham Dedrick his heirs and assigns that they will
forever warrent and defend the said released premises from all and every
claim of title or demand by from or under the said Abraham Timmerman and
willfully indemnify and save harmless the said Abraham Dedrick, his heirs and
assigns from all damages, costs and charges, by reason or on account of any
claim or assertion of title to the said premises which shall or may be made by
the said Abraham Timmerman or any other person or persons claiming or to claim
under him, in witness whereof the parties to these presents have hereunto set
their hands and seals the eighteenth day of March in the year
of our Lord one thousand eight hundred and twenty six.
