This indenture made the sixteenth Day of January in the Year of our Lord, One Thousand Seven Hundred and Ninety four BETWEEN David Colhoun of the Town of Freehold in the County of Albany and State of New York of the one Part and Augustine Prevost of the Town, County and State aforesaid of the other Part, WITNESSETH, That the said Party of the First Part for and in Consideration of the Sum of Seventy five Pounds current Money of New-York, to him in Hand paid by the said Party of the second Part at and before the Ensealing and Delivery hereof, the Receipt whereof the said Party of the first Part doth hereby acknowledge, and himself to be therewith fully satisfied, contented, and paid; HATH Granted, Bargained, and Demised, and by these Presents, DOTH Grant, Bargain, and Demise unto the said Party of the second Part ALL the one equal half Part of a certain Saw Mill with the Tools or Implements thereunto belonging with a sufficient quantity of Land also next adjoining said Mill for the reception of Logs and their Timber which may be brought to said Mill, with sufficient also for Boards or any kind of Timber whatsoever sawed or to be sawed at said Mill, with the Stream of Water on which said Mill stands and also the one equal half Part of the Mill Dam situate lying and being at Freehold aforesaid being at the side of the main Road and lately erected and Built by the said David Calhoun, TOGETHER with all and singular the Hereditaments, and Appurtenances thereunto belonging, or in any wide appertaining; TO HAVE AND TO HOLD the same unto the said Party of the second part his Heirs and Assigns, from the Day of the Date of these Presents, for and during the Term, of one whole Year from thence, next ensuing, and fully to be compleat and ended, Yielding and Paying therefor unto the said Party of the first Part the Rent of One Pepper Corn, on the last Day of the Term, if the same shall be lawfully demanded; To the Intent, that by Virtue of these Presents, and of the Statute made for transferring Uses into Possession, the said Party of the second Part may be in actual Possession of the Premises hereby demised, and be thereby enabled to accept and take a Grant and Release of the Reversion and Inheritance thereof, to him his Heirs and Assigns, for ever.
