This indenture made the seventeenth day of January one
thousand eight hundred thirty five between WILLIAM MASURIS if the village of
Athens in the county of Greene and state of New York of the first part and
BENJAMIN BRIGGS of the same place of the second part. Witnesseth that the said
party of the first part in consideration of the sum of fifty dollars to him duly
paid hath sold and by their presents doth grant and convey to the said party of
the second part and to his heirs and assigns forever. All that certain piece or
parcel of land situate lying and being in the village of Athens in the county of
Greene aforesaid within a tract of land commonly called the Glebe Lands and
being the southern part of lot number eight in the said Glebe Lands on the
easterly side of Swan Street and fronting on the said street and which said part
of said lot number eight hereby intended to be conveyed is contained within the
following boundary to wit: beginning at the northwest corner of lot number seven
part of the same now in possession of the said BENJAMIN BRIGGS and on the east
side of said Swan Street and running from said corner easterly along the north
line of said lot number seven one hundred feet to a corner thence northerly
parallel with the east line of said Swan Street twenty five feet to a corner
thence westerly parallel with the north boundary line of said lot number seven
one hundred feet to Swan Street aforesaid and thence southerly along said Swan
Street twenty five feet to the place of beginning containing twenty five hundred
square feet of ground subject to the Glebe rent reserved on the same forever
which is agreed by the parties to these presents to be 62______ rents yearly on
the part of the said lot number eight hereby intended to be conveyed and which
said sum of 62________ the said party of the second part doth promise to pay
yearly hereafter to the legal ___________ of the Lutheran Zion Church at Athens
aforesaid. With the appurtenances and all the estate, title, assigns, interest
of the said part of the first part therein and the said party of the first part
doth hereby covenant and agree to and with the said party of the second part
that at the time of making this conveyance, he is the lawful owner of the
premises above granted and seized of a good and indefeasible estate of
inheritance therein that are free and clear of all encumbrances except the rent
as herein before expressed and the above__________ premises in the quiet and
peaceable possession of the said party of the second part his heirs and assigns
against every person whomsoever will warrant and forever defend.
In witness whereof the said party of the first part hath hereunto set his
hand and seal the day and year first above written.
