By the Grace of God, Free and Independent:
To all to whom these Presents shall come, or may concern, and especially to
Sally Fairchild (daughter) wife of Edward Fairchild, of Sealysburgh Cattaraugus
County, Anna Wolcott (daughter) wife of Aaron Wolcott of Fitchville Huron
County, Ohio State, Cordelia Woodworth (daughter) wife of Hilan Woodworth of
Sealysburgh Cattaraugus County, Mary Loop (daughter) wife of David Loop Junior
of Hunter Greene County, Hannah A. Woodworth wife of Joseph Woodworth daughter
of Elizabeth Mead, a deceased daughter of the said Mathew Winter of Sealysburgh
Cattaraugus County, George W. Clark of Catskill Greene County, Elizabeth Winter
wife of Horace Winter children of Lydia Mead a deceased daughter of the said
Mathew Winter of Mentz Cayuga County, Robert Winter (son) of Hunter Greene
County & Your petitioners his legatees & next of kin of Mathew Winters
late of the town of Hunter & County of Greene deceased
Send Greeting: -- Whereas,
Moses Winter & Mathew Winter heirs of Mathew Winter deceased have presented
to the Surrogate of Greene County a certain instrument in writing purporting to
be the last will and testament of the said Mathew Winter deceased, and relating
to real & personal estate, has applied for the proof thereof, before our
Surrogate of our County of Greene. You are therefore hereby cited and
required personally to be and appear (if You shall see fit) before said
Surrogate at the Surrogate's Office, in Catskill, on the 18th day of October at
ten o'clock in the forenoon of that day, then and there to attend the probate of
said Will.
In Testimony Whereof, we have caused the seal of office of our said Surrogate to
be hereunto affixed - Witness Malbone Watson Esquire, Surrogate of our said
County of Greene the 14th day of June in the year of our Lord one thousand eight
hundred and forty one.

The last Will and testament of Mathew Winter of the town of Hunter County of
Greene and State of New York. I Mathew Winter considering the uncertainty
of this mortal life and being of sound mind and memory (Blessed be Almighty God
for the same) Do make and publish this my last Will and testament in manner
& form following that is to say. First I give & bequeath to my beloved
Wife Ann Winter my whole Estate Real & Personal during her natural life and
after her decease I give & bequeath to my daughters Sally Fairchild a
certain note of hand I now hold against Edward Fairchild her husband of twelve
dollars due on the same & the sum of thirty Eight dollars besides.
Item I give & bequeath to my daughter Ann Wolcott the sum of fifty dollars.
Item I give and bequeath to my daughter Cordelia Woodworth the sum of fifty
dollars. Item I give & bequeath to my daughter Mary Loop the sum of
fifty dollars. Item I give and bequeath to Hannah Ann Woodworth, heir of
my daughter Elizabeth now deceased the sum of fifty dollars deducting however
the sum of fifteen dollars already received by her. Item I give &
bequeath to Daniel Mead & Elizabeth Wood children of my daughter Lydia now
dead the sum of twenty five dollars each. Item I give & bequeath to my son
Robert Winter the sum of four hundred dollars, two hundred and nineteen dollars
by him already received to be deducted out of the four hundred dollars.
Item I give & bequeath to my son Mathew my large Bible & my silver watch
and forty dollars and lastly I give and bequeath to my two sons Moses Winter
& Mathew Winter jun all the Real Estate being & lying in the town of
Hunter County of Greene & State of New York and also all my personal Estate
when Ever it may be of Every name or nature Except the Bible & Watch &
note before bequeathed Equally to be divided between them after having paid the
aforesaid legacies and sums of money which is Chargeable on my whole Estate both
Real & personal. And which legacies & sums of money as herein made
-- in case of my Wife Anne departing this life previous to my decease then I
charge them payable in Six months after my decease other Ways Six months after
her decease. In Witness Whereof I have hereunto set my hand and Seal the
Eleventh day of May in the year of our Lord one thousand Eight hundred and

last Will and testament in presence of us who have hereunto subscribed our names
as Witnesses in the presence of the testator

I Malbone Watson Surrogate of the County of Greene do hereby Certify that in
pursuance of Chapter 6 title 1st Article 7th Part 2nd of the Revised Statutes of
the State of New York and the subsequent amendments thereto, upon proofs and
Examinations taken in the County aforesaid on the 6 day of December 1841 by the
oaths of John Beach and Caroline F. Beach the subscribing Witnesses to the
foregoing Will as Well as the person who had had the Custody of the Same, that
the foregoing Will was duly Executed, that the testator at the time of Executing
the Same was in all respects Competent to devise Real Estate & not under
restraint.
And I the said Surrogate do further Certify that the said Will is recorded in my
office in the book F kept by me for recording Wills testaments & Codicils
proved before me & the proofs thereof on pages from 482 to 492 inclusive.
In Witness whereof I the Surrogate aforesaid have hereunto affixed my Official
Seal this 6th day of December 1841 at the town of Catskill & County of
Greene
