Mrs. Raab Insane. Justice Davy Consequently Vacates a Judgment Against Her.
A decision was handed down by Justice Davy in which the court vacates a judgment against Augusta Raab and the Rochester Savings Bank. George A. Raab had $990.45 in the Rochester Savings Bank in his name and that of his wife. Mrs. Raab drew out the money and redeposited it in her own name. Raab thereupon commenced an action to secure possession of the money, and judgment was taken against Mrs. Raab. It thereafter appeared that Mrs. Raab was not capable of managing her own affairs and she was examined by Dr. Eugene H. Howard, who has found out that the woman is insane and "incompetent to adequately protect her interests." Judge Davy has accordingly appointed George V. Fleckenstein special guardian of Mrs. Raab and has directed him to defend the action for her.
