Last Will and Testament of Samuel Bidelman

I, Samuel Bidelman of Gaines N.Y. being of sound mind & memory do make publish & declare this my last Will & Testament in manner following that is to say:

First:

I direct my executor to pay all my just debts and funeral expenses.

Second:

I direct my executor to pay to the Commissioners of Mount Albion Cemetery the sum of $100.00 & said Commissioners are to invest the same & to apply the income thereof to the repair & preservation of the lot in said Cemetery purchased by me. In case I should pay said Commissioners the sum of #100.00 at any time before my death, such payment to render this clause void & no further payment to be made by my executor.

Third:

I give to my wife Eliza all my household furniture & supplies & provisions I may have at the time of my death. And also the use & occupation of my house & lot in Gaines during her natural life. And I also direct my executor my executor to invest the sum of $6000 on bond & mortgage in Orleans Co & to pay the interest thereof semi-annually to my said wife during her life. This bequest to be accepted by her in lieu of dower or right of distribution & a full satisfaction of all claims against my estate.

Fourth:

All the residue of my estate I give & devise to my six children, Leander Bidelman, Henry O. Bidelman, Eli Bidelman, John Bidelman, Hattie E. Anderson, & Charles Bidelman to be equally divided among them share & share alike as soon as may be after my death. The amounts heretofore advanced loaned or paid to either of my children to be reckoned as part of my estate & the amount received by each to be charged against him with interest from the time it was received.

Fifth:

The said $6000 so to be invested for my wife & the said house and lot to be equally divided among my said six children share & share alike, after her death.

Sixth:

I hereby revoke all former Wills by me made.

Seventh:

I hereby appoint Charles Bidelman executor of this my last Will & Testament.

In Witness Whereof I have here to set my hand & seal this 14th day of Sept 1876.

The above instrument consisting of two half sheets was at the date thereof signed, sealed published and declared by the said Samuel Bidelman to us & in our presence as 7 for his last Will & Testament & we at the same time at his request in his presence & in the presence of each other have subscribed our names as witnesses hereto:

Codicil:

I Samuel Bidelman of Gaines, N.Y. being of sound mind & memory do make publish & declare this instrument as a Codicil and addition to my Will heretofore made on the 14th day of Sept: 1876 & to be construed & executed as a part of said will. Since the execution of said Will my son Henry O. Bidelman therein mentioned as a legatee has died leaving quite a large estate to his only child who is thus as well or better provided for than either of my other children or grandchildren & as I desire to do equal & exact justice to all my children & grand children I make the change provided for in this Codicil & not for any want of love & affection for my grand-child Edwin S. Bidelman.

First:

The fourth Clause of said will is hereby changed so as to read as follows: All the rest & residue of my estate I give & devise to my five children Viz. Leander Bidelman, Eli Bidelman, John Bidelman, Hallie E. Anderson & Charles Bidelman to be equally divided among them share & share alike as soon as may be after my death. Should I hold any obligations against any of my children at the time of my death, I desire the same to be reckoned as part of my estate & to be charged to the one against whom, said obligation shall be held. This Codicil is designed to give to my five other children the share which in said Will is given to Henry O. Bidelman.

Second:

The 5th clause of said will is hereby changed so as to read as follows. The said $6000 so to be invested for my wife & the said house & lot or the avails thereof to be equally divided among my said five children mentioned in this Codicil share & share alike as soon a may be after her death.

In Witness Whereof I have hereto set my hand & seal this 19th day of November 1877.

The above instrument & codicil consisting of one half sheet was at the date thereof signed, sealed, published & declared by the said Samuel Bidelman to us & in our presence as & for a Codicil or addition to his will & testament & we at the same time at his request in his presence & in the presence of each other have subscribed our names as witnesses thereto.

Be it Remembered, that on the day of the date hereof the last Will and Testament and Codicil of Samuel Bidelman late of the Town of Gaines in said County deceased, being the foregoing written instruments hereunto annexed was duly proved before John G. Sawyer Esq. Surrogate of the said County according to Law, is and for the Last Will and Testament and Codicil of the real and personal estate of said deceased. Which said last Will and Testament and Codicil and the proofs and examinations taken thereon are recorded in this office. And further that the administration of all and singular the goods chattels and credits of the said Samuel Bidelman deceased and the execution of the said last Will and Testament and Codicil were on the same day duly granted and committed by me to Charles Bidelman of Gaines Orleans County N.Y. Executor named therein he having first duly taken and subscribed on oath that he would faithfully and honestly discharge the duties of such Executor,which oath is filed in the office of the Surrogate aforesaid.
