Goods, Chattels and Credits of
Nellie M. Root
To the Surrogate’s Court of the County of Orleans:
The petition of William Allport on the Town of Gaines, in the County of Orleans and State of New York, respectfully showeth:
That your petitioner is the father of Nellie M. Root late of the Town of Ridgeway in said County of Orleans, now deceased.
That the said deceased died on the 6th day of November in the year of our Lord one thousand nine hundred twenty-one; that at the time of her death she was a resident of said County of Orleans.
That your petitioner has made diligent search for a Will among the business papers of said deceased, since her death and has inquired of the members of her family and others most conversant with her business affairs, concerning such Will; that said deceased left no Will as far as your petitioner has been able to discover. The said deceased left John Root (husband) who resides at Cleveland, in the State of Ohio.
That the following are her only next of kin and heirs-at-law, the degrees of relationship to the said deceased, and their places of residence and postoffice addresses:
Christine Root, daughter, an infant of the age of 14 years who resides with her Aunt, Mrs. Truman Albright at Ridgeway, Orleans County, N.Y.
That the said John Root, husband of said decedent, left the said decedent and the said infant in October 1919 and that his whereabouts were until after the death of said decedent, unkown to the said decedent or any of her relatives and that a warrant for his arrest on a charge of abandonment of his wife and child was issued sometime ago and is now outstanding, he never having been arrested in pursuance thereof.
That all of the above names persons are of full age and sound mind except the said Christine Root.
That the value of decedent’s personal property will not exceed the sum of one hundred dollars and they the value of decedents real estate will not exceed the value of no dollars.
