Will of Methodore Stone In the name of God! Amen.
I, Methodore Stone of this town of Clarendon in the County of Orleans and State of New York, of the age of seventy-one years, and being of sound mind and memory, do made and declare this my last Will and Testament in manner following, that is to saying
First I give and bequeath to my daughter, Polly Niles, the sum of twenty-five dollars; to my daughter, Melinda Judson, the sum of twenty-five dollars; to my daughter, Tryphina Colby, the sum of twenty five dollars; to my daughter, Betsey Ward, the sum of twenty-five dollars; to my daughter, Alvira Cooley, the sum of twenty-five; and to my daughter Clarinda Hollister the sum of twenty-five dollars.
Second I give and devise to my wife, Mary Stone, the use and occupation, rents and profits of all my real and personal estate and the unmolested enjoyment of the same after paying the aforesaid legacies during the term of her natural life.
And Thirdly I give and devise to my son, Theodore B. Stone, after the decease of my wife, Mary Stone, all of my real estate together with all the remainder of my personal estate, goods, and chattels of what name or kind whatsoever.
And Lastly I do hereby nominate and appoint Warren Glidden to be the sole executor of this my last Will and Testament hereby revoking all former wills by me made. In witness whereof I have hereinto set my name and seal this twenty-eighth day of April in the year of our Lord one thousand eight hundred and fifty-nine.

The above instrument consisting of one sheet was on the date thereof declared to us by Methodore Stone the testator, therein mentioned to be his last Will and Testament, and he at the same time acknowledged to us, each of us, that he had signed and sealed the same; and we thereupon at his request and in his presence and in the presence of each other signed our names thereto as attesting witnesses.

Orleans County, N. Y., I certify that the foregoing is a true copy and record of the last Will and Testament of Methodore Stone late of the town of Clarendon in said County deceased, as admitted to probate before me and recorded September 2, 1861. signed Arad Thomas, Surrogate
Orleans County Surrogate Court In the matter of Proving the Last Will and Testament of
Named in a certain instrument in writing purporting to be the last Will and Testament of Methodore Stone late of Clarendon in said County, deceased applied in this Court to have the said instrument which relates to real and personal estate proved as the last Will and Testament of the said deceased; and thereupon the surrogate of said County did ascertain by satisfactory evidence, the facts required by law; and did issue a Citation in due form of law, directed to the proper persons by their respective names, and stating their places of residence, requiring them to appear before him at his office in Albion in said County on the second day of September 1861, to attend the probate of the said instrument. And afterwards, to wit, on the day and at the place last aforesaid, due proof by affidavit was produced and filed in said Court of the service of the said Citation, in the mode prescribed by law; appeared in person ..Geo. Porter Special Guardian of the infant heirs also appeared and no other parties or persons appearing, such proceedings were thereupon afterwards had, on the said second day of September 1861 that the said Surrogate took the proof in support of the said instrument as follows:
Orleans County, SS. Henry C. Martin and David N. Pettingill of the town of Clarendon in said County witnesses produced in this matter, being duly sworn and examined before Arad Thomas, Surrogate of said County, depos and say that they were acquainted with Methadore Stone late of Clarendon now deceased and that they are subscribing witnesses to the last Will and Testament of said deceased. And deponents further say that the said testator did, in the presence of these deponents subscribe his name at the end of the instrument which is now here exhibited to deponents and which purports to be the last Will and Testament of the said Methodore Stone and which bears date on the 28th day of April in the year of our Lord one thousand eight hundred and fifty-nine. And deponents further say that the said testator did, at the time of subscribing his name as aforesaid, at the end of said Will, declare the same to be his last Will and Testament; and deponents did thereupon subscribe their names at the end of said Will, as attesting witnesses thereto, in the presence and at the request of said testator. And deponents further say that at the time the said testator subscribed his name to the last Will as aforesaid, and at the time of these deponents subscribing their names as attesting witnesses thereto, said testator was of sound mind and memory, of full age to execute a Will, and not under any restraint. And that said Will not appears in all respects as when so executed, without any alteration whatsoever.
