In the matter of proving the Will and Testament of WILLIAM ALLEN deceased
Filed Dec 30, 1850
To the people of the State of New York, by the Grace of God Free and Independent
You, and each of you, are hereby cited and required personally to be and appear
before our Surrogate of our County of Rensselaer, at the Surrogate's Office,
in the City of Troy, in said County on Monday the 8th of January 1851
at ten o'clock in the forenoon of that day, to attend to the probate of the
last will and testament of the said William Allen deceased, which will then
and there be offered, for that purpose by AMOS ALLEN one of the executors
named in said Will, and who has applied to said Surrogate for the proof of
said Will, and which Relates to Real and Personal estate.
In testimony whereof, we have caused the Seal of Office of our Surrogate to be
hereunto affixed.
Witness - GEORGE T. BLAIR, Esquire, Surrogate of the said County, at the City of Troy,
the 30th day of December, 1850.
I admit our service of the written citation and a copy thereof dated December 30, 1850.

Petition January 8, 1851
To AMY ALLEN and WILLIAM O. ALLEN of Petersburgh and AMBROSE H. SHELDON of the
City of Troy the Special? Guardian of MARY M., HANNAH R., LUCINDA, AMY P., THOMAS W.,
ANDREW ALLEN minors, heirs at law and next of kin of WILLIAM ALLEN late of the
town of Petersburgh in the county of Rensselaer, deceased, Greeting:

SURROGATE'S COURT
In the matter of proving the Last Will and Testament of William Allen of Petersburgh
deceased}
To George T. Blair, Esquire; Surrogate of the County of Rensselaer:-
The petition of AMOS ALLEN one of the Executors named in the last Will and Testament
of William Allen late of the town of Petersburgh in the county of Rensselaer and
state of New York, deceased respectfully sheweth, that the said
Amos Allen
[NOTE from the transcriber: This error was in the original; it should
say William Allen] died a natural death, on or about the 19th day of October, 1850
at the town of Petersburgh in the said County of Rensselaer aforesaid, which was
the place of his residence at the time of his death: that the instrument now presented
and shown to your Petitioner, purporting to be the last will and testament of the
said deceased, and bearing date upon the 10th of July 1850, your Petitioner verily
believes to be such last Will and Testament; and such last Will and Testatment
relates to both real and personal estate, and the same was delivered to your
Petitioner after Execution who has kept the same in his possession from and after
the time he so received the same as aforesaid until this day, and until he delivered
the same to the Surrogate of the County of Rensselaer for Probate. And your
Petitioner further shows that the deceased left him surviving AMY ALLEN his widow,
and the following children viz
your petitioner of Grafton,
WILLIAM O.,
MARY M.,
HANNAH R.,
LUCINDA,
AMY P.,
THOMAS W. and
ANDREW ALLEN
all of Petersburgh and who are all minors except William O. aforesaid and who are
all and the only heirs at law and next of kin of the said deceased.
Your petitioner therefore prays that a citation may be issued to the widow (and?)
heirs at law and next of kin to the said deceased requiring them to appear before
the said Surrogate, at his office in the city of Troy in the County of Rensselaer
aforesaid on the 8th day of January, 1851 at 10 o'clock in the forenoon of that day,
to attend the Probate of the said last Will and Testament according to the form
of the Statutes of the State of New York, in such case made and provided.
And your Petitioner as is duty bound, will ever pray. &c.

AMOS ALLEN, the above named Petitioner, being duly sworn upon his oath that the
facts stated and sent in the above petition by him subscribed are true according
to the best of his knowledge and belief.

In the matter of proving the Will and Testament of William Allen deceased}
COUNTY OF RENSSELAER} ss
SAMUEL PECKHAM and NATHAN BROCK of the town of Petersburg in the County of Rensselaer,
being duly sworn in open Court, doth depose and say and each for himself says that
he is a subscribing witness to the last Will and Testament of William Allen late
of the town of Petersburgh in the County of Rensselaer, deceased. And that the said
William Allen did, in the presence of this deponent, subscribe his name at the end
of the instrument which is now shown and exhibited to this deponent, and which
purports to be the last Will and Testament of the said William Allen and which
bears the date on the 10th of July in the year of our Lord one thousand eight
hundred and fifty And that the said William Allen did at the time of subscribing
his name, as aforesaid, declare the said instrument to be his last Will and Testament;
and this deponent did thereupon subscribe his name at the end of the said Will
as an attesting witness thereto, at the request of said testator And that at
the time, when the said testator subscribed his name as aforesaid, the said
William Allen was of sound mind and memory, of full age to execute a Will, and
was not under any restraint, but competent in all respects to devise real estate.
And that these deponents severally did at the same time subscribe their names to
the said Will as witnesses thereto, at the request of the said testator in his presence,
and in the presence of each other: and further this deponent saith not.

I AMBROSE H. SHELDON of the town of Troy in the County of Rensselaer do hereby consent to become the special Guardian if I shall be appointed by the Surrogate of said County of MARY M. HANNAH R., LUCINDA, AMY P. THOMAS W. and ANDREW ALLEN who are all minors and heirs at law and next of kin of William Allen late of Petersburgh deceased, and do agree to serve as such special Guardian, in the matter of proving the will of said deceased.
