A Copy of the last Will and Testament of Dorcas Phillips of the Town of Greenbush deceasd with the Proof thereof recorded 3 Aprl. 1813.

In The Name of God Amen, I Dorcas Phillips of the Town of Greenbush, County of Rensselaer and State of New York, widow, being very sick and weak in Body but of perfect mind and memory thanks be given unto God; calling into mind the mortality of my Body, and knowing that it is appointed for me once to Die -- Do make and ordain this my last Will and Testament, that is to say principally and first of all, I give and recommend my Soul into the hand of almighty God that gave it, and my Body I recommend to the Earth to be buried in decent christian Burial at the discretion of my Executors; nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God, and as touching such worldly Estate wherewith it hath pleased God to bless me in this life I give devise and dispose of the same in the following manner and form.

First I give and bequeath to James Phillips my youngest Son all my Land, my right and title to the Land or farm now possed [sic] by him lying and being in the Town of Greenbush, County and State aforesaid, upon the following conditions, viz.

that he my said Son James shall pay to my Son Timothy four years after my decease the sum of One Hundred Dollars;

that he my said Son James shall pay to my son Abner four years after my decease the sum of One Hundred Dollars;

that he my said Son James shall pay to my Son Rozzel Four years after my decease the sum of One Hundred Dollars;

that he my said Son James shall pay to my Son David four years after my decease the sum of One Hundred Dollars

that he my said Son James [the next 23 words inserted between lines in a different handwriting] shall pay to my son David [sic] four years after my decease the sum of one hundred dollars

that he my said son James [resumes normal handwriting] shall pay to my Son Joseph four years after my decease, the sum of One Hundred Dollars;

that he my said Son James shall pay to my Daughter Anner, six weeks after my decease, the sum of Thirty Dollars.

Also I give and bequeath to my Grand Daughter Dorcas Phillips my Spare Bed, standing in the chamber, and the Bed-Stead and bedding Belonging to it.

Also I give and bequeath to my Daughter Anner the Bed-Stead bed and Bedding which I have generally used, my Drawers, Chest, Beads, wearing apparel and all the Bedding not bequeathed to the aforesaid Dorcas, my churn, Tea Kettle and pewter ware all my Linen and woolen cloth.

Also I give and bequeath to my Son James all my personal property not above mentioned -

And I do hereby disallow, revoke and disannul all and every other Testament, Wills, Legacies, bequests and Executors [sic], by me in any wise before named, willed, and bequeathed, rattyfiing and confirming this and no other to be my last Will and Testament.

And I do appoint my two Sons David and James Executors of this my last Will and Testament.

In Witness whereof I have herewith set my hand and Seal this twenty third day of February in the year of our Lord One Thousand eight Hundred and thirteen.

Be It Remembered, That on the third day of April in the year of our Lord one Thousand eight Hundred and thirteen personally appeared before me Alanson Douglas Esquire, Surrogate of the said County of Rensselaer, David R. De Freest, one of the subscribing witnesses to the Will of Dorcas Phillips, late of the Town of Greenbush in the said County deceased; who being duly sworn, declared that he did see the said Dorcas Phillips seal and execute the annexed written written [sic] Instrument, purporting to be the last Will and Testament of the said Dorcas Phillips, bearing date the twenty third day of February in the year of our Lord one Thousand eight Hundred and thirteen, and heard her publish and declare the same as and for her last will and Testament; that at the time thereof she the said Dorcas Phillips was of sound disposing mind and memory to the best of the knowledge and belief of the said David R. De Freest and that the said David R. De Freest together with Richard R. De Freest and Abraham A. Fonda the other witnesses to the said will severally subscribed their hands and names to the said will, as witnessses thereto in the presence of the Testatatrix [sic] and of Each other . . . . .

NOTE from the submitter: Other documentation indicates that this testatrix Dorcas (Vickery) Phillips had a son named John S. Phillips (1774-1860), whose name is omitted from THIS RECORDED COPY of her will. Someone inserted a line into this recorded copy of this will naming son David, when son David had already been named in the will as originally recorded. It has been speculated that the insertion was intended to put back into the RECORDED version of the will not David, who was already there, but instead the omitted son, that being John. (John is not my line, so I have not pursued this in detail.) I am a member of the General Society of Mayflower Descendants based on my descent from this testatrix through her son and executor David Phillips. If you have any questions, please feel free to ask!
