Last Will and Testament Elijah Millard of Berlin |
The last will of Elijah Millard late of Berlin recorded 11 June 1821.
In the name of God, Amen, I ELIJAH MILLARD of the town of Berlin, County of Rensselaer,
State of New York, being weak in body but of sound and perfect mind and memory do make
and publish this my last Will and Testament in manner and form following, that is to say
First I give and bequeath unto my wife ELISABETH one horse, man's saddle and bridle,
two cows and all my household furniture that belongs to me in the house where I now
reside, said stock to be kept on my farm winter and summer, and the use of the house
where I now reside, thirty five bushels of Indian corn and five bushels of
wry [sic - rye] yearly and every year,
apples for her own use where there is apples, one third of the cider made out of the
orchard yearly every year, two yearling hogs, the garden west of the house, forty
bushels of potatoes yearly and every year, twenty seven pounds of sheep's wool and
forty pounds of flax yearly, the above is in lieu of my wife's right of dower and
powe[?] of this I give
and devise to my sons JOHN MILLARD, ELIJAH MILLARD JUNIOR and WILLIAM C. MILLARD all
my land lying and being in the town
of Berlin, their heirs and assigns forever. John's share of the farm I now live on
on the west part of said farm, William C. Millard adjoining John's to the east taking
in the house where I now reside and Elijah part of said farm on the east
to be divided equal[ly] between them according to quantity and quality the house
that my sons John and Elijah Jr. now
reside in to be equal between them to be divided north and south, the land in the
west wood to be divided same way
between my sons John, Elijah Jr. and William C. Millard.
My will is that my daughters CATHARINE and HANNAH shall
[have] a privilege and a right to live in the house where they now reside as long
as they live single and if they should
need help for their support my sons shall help them.
I give and bequeath to my daughters ABIGAIL, SARAH, SUSANNAH and BETSEY one dollar
apiece to each of them and
further my will is that my sons Elijah and William C. Millard shall have an equal
right in any barn and corn crib. I further
order that my personal property that is not given away to be used to pay the residual
debts and if not enough my
sons shall pay the residue. If any over I give it to my wife and
lastly I do make and consitute my trusty friend and son-in-law JABEZ BURDICK JUNIOR
my sole Executor of this my last will and testament hereby revoking all further
wills by me made.
In witness whereof I have hereunto set my hand and seal this twenty-fifth day
of May in the year of our Lord one thousand eight hundred and twenty one.

Signed dated published and declared by the above named Elijah Millard to be his
last Will and Testament in the presence of us who have hereunto subscribed our
names as witnesses in the presence of the testator.

Be it remembered that on the Eleventh day of June in the year
of our Lord one thousand eight
hundred and twenty one personally appeared before me Thomas Clowes Esquire Surrogate
of the said County of
Rensselaer, Silas Sweet Junior, Joshua Smith and Gideon Palmer subscribing witnesses
to the will of Elijah Millard
late of the town of Berlin in the said county deceased who being duly sworn
declared that they did see the said Elijah
Millard sign and execute the annexed written instrument purporting to be the last Will
and Testament of said Elijah
Millard bearing the date the twenty fifth day of May in the year of our Lord one
thousand eight hundred and twenty
one and heard him publish and declare the same as for his last will and Testament
that at the time thereof the said
Elijah Millard was of sound disposing mind and memory to the best knowledge and
belief of the said Silas, Joshua,
Gideon and that they, the said Silas, Joshua and Gideon, severally subscribed
their hand and names to the said Will
as witnesses thereto in the presence of the testator and of each other.
