Last Will and Testament Henry Brust of Brunswick |
Last Will and Testament of Henry Brust, late of the Town of Brunswick in the County of
Rensselaer, deceased, together with the proof thereof as a will of real and personal
estate. Recorded April 22, 1887.
In the name of God, Amen: I, HENRY BRUST of the Town of Brunswick in the County of
Rensselaer and state of New York being of sound mind and memory, and envisioning the
uncertainty of this frail and transitory life, do therefore make, ordain, publish
and declare this to be my last Will and Testament, that is to say:
First: After all my lawful debts are paid and discharged, I give and bequeath to my
wife MARY M. [sic] for her sole use and benefit all my estate both real and personal of
whatever name or nature during her lifetime, and upon her death to my son JACOB HENRY
- on condition that my son Jacob Henry aforesaid accept the above bequest in
payment of all debts which I am owing him at the time of my decease, and the above
mentioned son Jacob to pay each of my remaining children after the death of my wife
MARGARET M. [sic] the sum of two hundred dollars each as follows. To
OSCAR Z. BRUST,
ALMINA ROBERTS, MARY A. ROBERTS, DEXTER B. BRUST, DELILA C. DOUGLASS to the amount
of not less than twenty-five dollars each in each and every year until the full sum
of two hundred dollars each is paid.
In Witness whereof I have hereunto subscribed
my name and affixed my seal this twenty sixth day of April 1886.

The above written instrument was subscribed by the said Henry Brust in our presence
and acknowledged by him to each of us and at the same time declared to be his last
will and testament, and we at his request have signed our names as witnesses thereto
in his presence and in the presence of each other and written opposite our respective
places of residence.

In the matter of proving the Will and Testament of Henry Brust, deceased.
Cornelius A. Winship and Thomas H. Betts of the Town of Brunswick in the County of
Rensselaer being sworn in open court doth depose and say and each for himself says
that he is a subscribing witness to the last will and testament of Henry Brust,
late of Brunswick in the County of Rensselaer, deceased, and that the said Henry
Brust did in the presence of these deponents subscribe his name at the end of the
instrument which is now shown and exhibited to these deponents and which purports
to be the last will and testament of the said Henry Brust which bears date on the
26th day of April 1886. And the said Henry Brust did at the time of subscribing his
name aforesaid, declare the said instrument to be his last will and testament and
these deponents did thereon subscribe their names at the end of the said will as
attesting witnesses thereto at the request of said testator in his presence and
in the presence of each other. And at the time when the said testator subscribed
his name as aforesaid, he was of sound mind and memory, of full age to execute
a will, and was not under any restraint but competent in all respects to devise
real estate.
Subscribed and sworn this 22nd day of April 1887 before me

At a Surrogate Court, County of Rensselaer at the Surrogate office in the city of
Troy in said county on the 22nd day of April 1887.

In the matter of the last Will and Testament of Henry Brust, deceased.
On reading and filing proof of the due service of the citation herein on the
parties therein named and upon due proof of the execution of the papers
propounded as the last will and testament of Henry Brust, late of the Town
of Brunswick in said county, deceased, bearing date on the 26th day of April 1886.
And MARY M. BRUST, widow, JACOB H. BRUST, DEXTER B. BRUST, OSCAR Z. BRUST,
ELMINA ROBBINS, DELILAH C. DOUGLASS, and MARY C. ROGERS, heirs at law and next
of kin of said deceased appearing, and it appearing by such proofs that the said
will was duly executed, that the testator at the time of executing the same was
of full age for making a will, was of sound mind and memory, and not under
restraint, and in all respects competent to devise real estate and the probate
thereof not having been contested. It is considered. . . . [last page missing]
