Last Will and Testament

This will was recorded in Rensselaer County, NY Will Book Volume 5, page 131. It was transcribed from a Sampubco copy and was
submitted by Bradford Miter. The submitter adds this note: "This will was probated just prior to that of her nephew, William Spotten. I believe she
probably died shortly after the will was dated (April 25, 1787). It was necessary to probate it then, as William was one of several heirs to her will."
(Lansingburgh was still in Albany County, NY at the time this will was written, because Rensselaer County had not yet been created.
By the time this will was recorded, Lansingburgh was in Rensselaer County, so the will was recorded there.)

The last Will and Testament of Elianor Taylor deceased together with the Probate thereof. Recorded June 17th 1815.

In the name of God Amen, I ELIANOR TAYLOR of Lansinghborough in the County of Albany and State of New York, and being at present low and weak in body, but of sound disposing mind and Memory, thanks be to God for the same, considering the uncertainty of life and certainty of death, do therefore make and ordain this my last will and Testament in Manner and form following that is to say,

First and principally I commit my Soul unto the hand of Almighty God who gave it me, and my body to the earth to be decently interred at the discretion of my Executors hereinafter named hoping for a resurrection to eternal life through the Merits and righteousness of Christ my Redeemer, and as to such worldly Estate wherewith God has been pleased to bless me I dispose thereof in manner following.

First - I will and do order that all my just debts and funeral charges be fully paid and satisfied.

Item - I do hereby give devise and bequeath unto my Niece ISABELLA SPOTTEN wife of WILLIAM SPOTTEN of Lansingborough aforesaid for and during her natural life or her widowhood the rents, issues and profits of all and singular my Estate whatsoever and wheresoever, as well real and personal.

Item - Immediately upon the death or remarriage of said Isabella Spotten I do hereby give and devise my house and Lot of ground situate and being in Roosevelt Street in the City of New York unto ELEANOR, RACHAEL, [and] ISABELLA children of the above mentioned William and Isabella Spotten To Have and to Hold for the said house and lot of ground unto the above named three children of the said William and Isabella Spotten, and to their several respective heirs, executors, administrators and assigns forever in equal parts as tenants in Common and not as Joint Tenants.

Item - I give and devise unto WILLIAM SPOTTEN son of said William and Isabella Spotten a piece or parcel of ground situate lying and being in said Lansinghborough being a part of Lot Number Two and begins at the corner of Lot Number three by Water Street and runs from Southwardly along said Water Street Forty feet, thence Easterly One hundred and Twenty feet, thence Northwardly along an Alley Forty feet to lot Number Three, thence Westwardly one hundred and Twenty feet along said Lot number three to the place of Beginning To Have and To Hold the above described piece or parcel of ground unto him the said William Spotten Son of William & Isabella Spotten his heirs and assigns forever from and after the death or remarriage of the above named Isabella Spotten.

Item - From and after the death or remarriage of said Isabella Spotten as aforesaid I do hereby give and devise and bequeath all the rest and residue of my real and personal Estate whatsoever or wheresoever unto said Eleanor, Rachael, Isabella and William Spotten. To Have and to Hold the said rest and residue of my real and personal Estate from and after the death or remarriage of my said Niece Isabella, unto them the said Elianor, Rachael, Isabella and William Spotten their heirs and assigns forever in even and equal parts as Tenants & possessors in Common and not as Joint Tenants and possessors as also I bequeath my family Bible to THOMAS SPOTTEN his heirs and assigns forever.

Item - In Case of the death of either of the aforenamed children before his her or their attaining full age and without Issue then in such as I do hereby will devise and bequeath the part and parts, share and shares of such child or children so dying within age and without I give unto the Survivor or Survivors of them their heirs and assigns in equal parts as Tenants & Possessors in Common.

Lastly - I hereby nominate constitute and appoint my Niece ISABELLA SPOTTEN Executrix of this my last will & Testament, hereby revoking, disannulling and making void all former and other wills and Testaments by me at any time heretofore made declaring this, and not other, to be my last will and Testament.

In witness whereof I have hereby set my hand and Seal this Twenty Fifth day of April in the Year of our Lord One thousand Seven Hundred and Eighty seven.

Signed, Sealed, Published, pronounced and declared by the Testatrix as and for her last will and Testament in the presence of us who subscribed our names hereto in her presence and at her request.

N.B . The words William Spotten in the first Item erased & the word Three in the Habendum in said Item wrote on erasure -

Be it Remembered That on the Seventeenth day of June in the Year of our Lord One thousand eight hundred and fifteen personally appeared before me William McManus Esquire, Surrogate of the said County of Rensselaer, Albert Pawling one of the Subscribing witnesses to the Will of Eleanor Taylor late of the town of Lansingburgh in the said County, deceased; who being duly sworn declared, that he did see the said Eleanor Taylor seal and execute the annexed written Instrument purporting to be the last will and Testament of the said Eleanor Taylor bearing date the Twenty fifth day of April in the Year of our Lord One thousand Seven hundred and Eighty seven and heard her publish and declare the Same as and for her last will and Testament; that at the time thereof she the said Eleanor Taylor was of sound disposing mind and Memory, to the best of the knowledge and belief of the said Albert Pawling and that the said Albert Pawling together with Jonathan Yates and Matthew Lyme the other witnesses to the said will, severally subscribed their hands and Names to the said will, as witnesses thereto, in the presence of the Testatrix and of each other -
