Last Will and Testament

This will was recorded in 1880 in Rensselaer County, NY Surrogate Court Will Book 95 pages 516-517.
It was transcribed exactly as it was written and as it was punctuated and was submitted by Lin Van Buren.

The last Will and Testament of of [sic] Jeremiah Hyser of the Town of East Greenbush, in the County of Rensselaer and State of New York:

I, JEREMIAH HYSER, of the said Town, considering the uncertainty of life and being of sound and disposing mind and memory, (blessed be Almighty God for the same!) do make, publish and declare this my last Will and Testament in manner following, that is to say:

First - I direct that all my just debts and funeral expenses be first paid out of my estate.

Second - I give, devise and bequeath to my beloved wife, HANNAH, all my real and personal property, of any and every nature whatsoever, that shall remain after payment of such debts and expenses, to have, hold, use and enjoy the the [sic] same and the rents, issues and profits thereof, for and during her natural life; this devise to be and to be accepted my her in lieu and stead of her right of dower.

Third - After the death of my said wife I give, devise and bequeath unto my daughters SOPHIA ANN, wife of WILLIAM H LINK and MARGARET ELIZA, wife of LEWIS P TRAVER, all my household furniture and the wearing apparel belonging to my said wife, to be divided between them share and share alike.

Fourth - After the death of my said wife, I give, devise and bequeath unto my son JOHN A. HYSER all that shall remain of my real and personal estate, of any and every nature whatsoever, except such household furniture and wearing apparel, (if my said son shall then be living;) to have and to hold the same to my said son, his heirs and assigns forever.

Fifth - In case my said son shall have died before the decease of my said wife, then, upon the death of my said wife, I give devise and bequeath unto my said two daughters all my real estate and personal property of any nature whatsoever which shall remain after the death of my said wife, (after payment of such debts and funeral expenses,) to be divided between my said daughters share and share alike.

Lastly - I do hereby name constitute and appoint my son JOHN A. HYSER and my sons-in-law WILLIAM H. LINK and LEWIS P. TRAVER the Executors of this my last Will and Testament and do hereby revoke all former Wills by me made.

In Witness Whereof I have hereunto set my hand and seal this fifteenth day day [sic] of January, in the year of our Lord one thousand eight hundred and seventy three.

The foregoing Instrument, consisting of three pages (2 sheets,) was on the day it bears date subscribed by Jeremiah Hyser, the testator, in our presence, and he did thereupon then and there declare to us and each of us that the same was his last Will and Testament, and we have thereupon then and there at his request and in his presence and in the presence of each other subscribed our names as witnesses thereto - the words "belonging to" in third clause being written over erasure before execution.

BE IT REMEMBERED, that on the day of the date hereof, the last Will and Testament of Jeremiah Hyser late of the Town of East Greenbush deceased, (being the foregoing written instrument), was duly proved before MOSES WARREN, Surrogate of the said County, according to law, as and for the last Will and Testament of the real and personal estate of said deceased, which said last Will and Testament, and the proofs and examinations taken thereon, are recorded in this Office, Book of Records No. 95 Pages 516 &c.

IN TESTIMONY WHEREOF, I have hereunto subscribed my name and affixed my official Seal this 6th day of July 1880

SURROGATE'S COURT.

In the matter of proving the last Will and Testament of Jeremiah A. Hyser of East Greenbush deceased.

To MOSES WARREN, Esq., Surrogate of the County of Rensselaer :

The petition of John A. Hyser one of the Executors named in the last Will and Testament of Jeremiah Hyser late of the town of East Greenbush in the County of Rensselaer and State of New York, deceased, respectfully showeth that the said Jeremiah A. Hyser died a natural death on or about the 24th day of April 1880, at the town of East Greenbush in the County of Rensselaer aforesaid, which was the place of h__ residence at the time of his death. That the instrument now presented and shown to your petitioner purporting to be the last Will and Testament of said deceased, and bearing date upon the 15th day of January 1873, your petitioner verily believe to be such last Will and Testament and that the said instrument purporting to be such last Will and Testament related to both real and personal estate, the whole value of which, to the best of your petitioner knowledge and belief, will not exceed $_______.

And your petitioner further showeth that the deceased left him surviving his widow Hannah Hyser of East Greenbush N. Y., and Children viz:
Polly E. Traver
Sophia A. Link and
John A. Hyser of East Greeenbush N. Y. all of full age
