The Last Will and Testament of Jacob Springer with the probate thereof Recorded October 12th 1818

In the name of God Amen. I JACOB SPRINGER of the town of Brunswick in the county of Rensselaer & State of New York, farmer, being weak in body but of sound & perfect mind & memory blessed be Almighty God for the same, do make & publish this my last will & testament in manner & form following, that is the say -

Firstly I give and bequeath to my son HENRY SPRINGER the sum of one dollar -

Secondly I give and bequeath my my son LODEWICK SPRINGER the sum of one dollar.

Thirdly I give and devise unto my two sons JACOB SPRINGER JUNIOR and MARTIN SPRINGER, their heirs and assigns all that certain farm of land upon which I now live situated in the town of Brunswick aforesaid and bounded as follows, to wit,
Beginning at a marked beech sapling standing in the west side of the stream of water commonly called Quackenkill & at the --- east --- --- or S.E. corner of the farm of PHILIP & JOHN DATER and --- thence north sixty-one degrees west thirty-three chains, thence South twenty-seven degrees, west forty-six chains & fifty-five links, thence south sixty-seven degrees east thirty chains to a marked hard beech sapling standing on the west side of the said QuackenKill and thence up the stream of the said QuackenKill as it winds & turns to the place of beginning, containing one hundred & twenty five acres of land exactly

[Fourthly] Nevertheless out of the above-described farm twenty-five acres for my son GEORGE SPRINGER to be surveyed out of the southwest corner of the said above-described farm unless my said sons JACOB & MARTIN shall convey to the said GEORGE SPRINGER his heirs & assigns, twenty-five acres of land out of the farm which they the said Jacob & Martin now own jointly with the said George, situate in the said town of Brunswick, in which case the foregoing exceptions shall be void & of no effect, and the preceding devise to the said Jacob & Martin in full force for the whole of the said one hundred & twenty-five acres To have & to hold the above-devised premises in manner aforesaid with the appurtenances unto the said Jacob & Martin to the sole & only proper use, benefit & behoof of them & their heirs & assigns forever. Unless the last-preceding devise to the said George is upon this express condition that if the said Jacob & Martin shall within six months after my decease convey to the said George twenty-five acres of other land out of the farm of the said Jacob & Martin as aforesaid in lieu of the said twenty-five acres of land above-devised to the said George then & in that case the said devise to the said George shall be void.

Fifthly I give and devise the one equal half part of all that certain lot of wood land situate in the town of GRAFTON in the County & State aforesaid & containing Five & one half acres unto my said sons Jacob & Martin and the other equal half part of the said lot unto my said son George Springer and their respective heirs & assigns, and for them, him & their used & benefit forever. -

Sixthly notwithstanding anything hereinbefore contained, I give & devise unto my beloved wife MARY SPRINGER the free, sole & exclusive use occupation & enjoyment of the west room of my now dwelling house, with free way & passage into & out of the same, together with the fire stove now in the same & the appurtenances thereto belonging for & during her natural life.

And in consideration of the devises of real estate hereinbefore made by me to my said two sons JACOB & MARTIN, I do hereby will & order them the said Jacob & Martin & their heirs & assigns to support & maintain my said wife during her natural life, in a decent, comfortable and proper manner according to her rank & condition, and furnish & provide for her suitable & proper meat, drink, lodging, washing, mending, medicine & attendance during her natural life and further that they shall pay her twenty dollars yearly & keep for her use during her natural life if she shall require the same, one milk cow & four sheep - And I give & bequeath to her during her natural life all the household furniture, bedding & clothing now in her possession which at this time is considered to belong to my said wife.

Seventhly, I give & bequeath to my two daughters FRENAUGH SIMMONS & MARY SHARP all the household furniture and other personal property herinbefore given & bequeathed to my said wife, to be equally divided between them after the death of my said wife, when they are to receive the same and not before, except one good feather bed & bedding, in case my son JACOB shall remain unmarried to that time, which feather bed & bedding I do in that case give & bequeath to my said son Jacob, but not otherwise -

Eighthly, and as to the rest and residue of my personal estate, I give & bequeath the same to my said two sons JACOB & MARTIN to be equally divided between them.

Ninthly I do hereby order my executors hereinafter named to pay my son LODEWICK the sum of three hundred dollars over and above legacy before bequeathed to him, unless I give him the same in my lifetime, which sum will make him equal with the amount of the note paid by me to DANIEL SIMMONS for my son HENRY. -

Tenthly I do hereby charge the real estate by me devised to my said sons JACOB & MARTIN with the support & maintenance of my said wife as aforesaid.

And lastly I do hereby constitute & appoint my said son JACOB SPRINGER & my trusty friend WILLIAM MCMANUS of Troy in the County of Rensselaer aforesaid Executors of this my last will & testament, hereby revoking all former wills by me made.

In witness whereof I have hereunto set my hand & seal this nineteenth day of August, in the year of our Lord one thousand eight hundred & fifteen -

Signed, sealed, published & declared by the above-named Jacob Springer to be his last will & testament, in the presence of us who have hereunto subscribed our names as witnesses, in the presence of the testator & of each other.
