This Indenture Made the twenty third day of August in the Year of
our Lord one thousand eight hundred and sixteen Between Justus Bennett
of the town of Wayne in the County of Steuben and state of New York of
the first part and Nathaniel H. Frisbee of the town County and state aforesaid
of the Second part Witnesseth that the said party of the first part, for
an in Consideration of the sum of sixty dollars to him in hand paid by
the Said party of the second part the receipt whereof is hereby Confessed
and acknowledged: hath granted, bargained, sold, remised, released, and
confirmed, and by these presents doth grant, bargain, sell, remise release,
alien and confirm unto the said party of the second part, and to his heirs
and assigns forever: All that Certain piece of parcel of land lying and
being in township number five in the first range of townships in the County
of Steuben and state aforesaid, Beginning at a stake in the west line of
Connat Location and north thirty nine degrees East ninety four links from
the North east corner of the School House and running thence North two
and a half degrees East thirty perches to a stake – thence south eighty
seven and a half degrees East sixteen perches to a stake, thence south
two and a half degrees, west thirty perches to a stake thence north eighty
seven and a half degrees, west sixteen perches to the place of beginning
Containing three acres of land as surveyed by John Arnold, – Together with
all and singular the hereditaments and appurtenances thereunto belonging
or in any wise appertaining and the reversion and reversions, remainder
and remainders, rents issues and profits thereof and all the Estate, right,
title, interest claim and demand whatsoever of the said party of the first
part either in law or Equity, of, in, and to the above bargained premises
with the said hereditaments and appurtenances – To have and to hold, the
said above described premises unto the said party of the second part his
heirs and assigns, to the sole and only proper use benefit and behoof of
the said party of the second part his heirs and assigns forever:
And the said party of the first part, for himself, heirs executors &
administrators, doth Covenant, grant, bargain, promise and agree, to and
with the said party of the second part, his heirs and assigns that the
above bargained premises in the quiet and peaceable possession of the said
party of the second part, his heirs and assigns against all and every person
or persons lawfully claiming or to claim the whole or any part of the above
mentioned and described premises will forever Warrant and Defend, In witness
whereof the said party of the first part hath hereunto set his hand and
seal on the day and in the year first above written.

Steuben County: On the seventh day of June in the year one
thousand eight hundred and seventeen before me John Dow one of the Judges
of the Court of Common pleas of the said County personally appeared John
S. Bennett one of the subscribing witnesses to the within instrument and
who is to me known who being duly sworn, saith that he saw the within named
grantor Justus Bennett execute the within instrument as his voluntary act
and deed for the uses and purposes therein mentioned that he knew the said
Justus Bennett that he is the person described in and who executed the
same and that he this deponent and Peter S. Lewis subscribed their names
respectively as witnesses to the said Justus Bennett executing the same
– And I being satisfied from the evidence aforesaid that the said Justus
Bennett is the same person described in and who executed the same allow
it to be Recorded.
